Councilman Keith indicating that he has always been reluctant to send such 'matters back to the 'Planning Commission _and has strongly supported the decisions:they have made regarding zoning, but in this case 'feels that they . . did not have accessto all the information at their previous meeting and to be fair to • the applibants,' all information should be considered. Councilman Kurbitz explained that although he has a :small. drug-store Summitview_Avenue, it is of a .completely different type of operation froni-the one inthe*prOposed•shopping center and feels he, can vote on ' the Motion without prejudice. This being the time fixed for the continuation of the Hearing on the Chief Building In- • spector's Report.of Expenses in demolishing a dangerous building at-529 East AdamsStreet, .City Manager McMicken referred to a mem6 from City Attorney Andrews reviewing this matter. Mr. Andrews explained that at the previous meeting October 1969, Mr. Lloyd Porter, owner of this property, had . filed astateMent of complaint'prOteating the assessment of - II any charge against him or his property for the demolition cots because more than the one . building described in the Dangerous Building Notice. and Order, had been destroyed and he • felt that he should instead make a claim for damages.against the City, Mr. .Andrews fur- ther explained that in reviewing the Building Inspector's file, that Mr. Porter's posi- tion was well taken because the Dangerous' Building Code requires that the property to be demolished be described with certainty, and thatthenotices sent to Mr. Porter by the City referred to "a building" and specifically described the residence building ' • any reference to any accessory building or structurese that at last week's . . • meeting Mr. Porter indicated that he would Waive any claim he might make against the City for unauthorized destruction of his property, if the City Would demolition • costs against him, and Mr. Andrews recommended that the City waive the demolition costs • and obtain a release from Mr. Porter of his claim against the City. Mr. Andrews further . reported that the City probably:wOuid'not be able to CoileCt this'amoUnt there are already several other liens . against this property. McNeice absent. Chief Building Inspector Newell Pock gave a Dangerous Building report, stating that 84 III notices have been sent out, with the result that 58 buildings have. been demolished, 13 . have been repaired or are in the process of being repaired and on 12 there has been. no action by the owners. He stated that he has had good cooperation with the owners in most . cases.. Mr. Pock indicated that. these dangerous buildings are in all, parts.of City, from the southeast portion.to as far west as 42nd Avenue. . An Ordinance appropriating $16,.633 in the Street Fund, having. been read'.in its.entirety - • at this meeting, was laid on the table for one week or until November 10, 1969. Public ' Works. Director John Mayo explained that this appropriation is necessary to funds used for the construction of Longfibre Road, and to be used for. the purchase of salt and . gravel for winter expenditures. . It was MOVED by Brown, seconded by Keith that Ordinance No. 1179 regulating speed limits on certain streets, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson and *Robinson voting aye on.roll call. McNeice absent. Public Works Director John Mayo explained that a request had been received from the business manager at Yakima Valley . • College to reduce the speed limits in the vicinity of the College.on the following - .. streets: . a. South 14th Avenue between Nob Hill Boulevard and Prasch. . b, •South 15th Avenue Nob Hill Boulevard and Prasch. • • . c. Prasch Avenue between S. 12th Avenue and South 16th Avenue, ' • and after investigation and discussion with the President, the Police Department and:Traffic'Engineering personnel recommended that the speed limits.be - reduced as re- quested. ORDINANCE NO 1179, AN ORDINANCE. relating to traffic control, setting. speed limits on ' .certain city, streets; and amending. subsection 9.75.010 (a) of the City of Yakima Muni- , ., cipal Code.. . . . Mrs. Lottie Vale, 809 S. 4th Street, referred to a dangerous traffic problem, at 6th Street and East Nob Hill Boulevard and asked if some kind of light or signalization could be put at this corner, before someone is 'hurt. Discussion brought out that there are several other such "blind" corners and possibly some investigation should be, made to - contact owners 'of the obstacles or buildings that jut out so far as 'to be a, traffic ' - hazard. After due discussion, the matter was 'informally referred to.the'City Manager and Staff for study and' recommendation. In accordance with the Yakima City ,Charter and the Washington State Laws.of. -1969, Ch. 95, c City Manager McMicken Submitted the.preliminary budget for the City of Yakima. for the year of 1970,..a copy having also been filed with the.City Clerk on this date. Mr. • • McMicken referred to his_.Budget message and reviewed portions of the Preliminary Budget • for 1970. In summarizing these, Mr. McMicken indicated that a balanced budget -in the total amount of $8, 968,119 is proposed, which is up $1,184,549 6r:15:3%. He • stated. • that the tax rate necessary to support the budget is 19.8 mi.11s,•up'.2.mills and that the Cityhas levied the full 16 mills allocated to it under the constitu'tional..limit., plus 3.8 mills for bond debt retirement. Mr. McMicken explained that in order to balance . the budget, a total of $826,041 was cut from.departmental requests, an amount which did not include the increases, and that a 72% salary adjustment is recommended -for all 'City employees, amounting to $231,071. He reported that the City will assume full financial responsibility for parks and recreation in 1970 with•the creation of a Park and Recrea- tion Department and an advisory commission. Mr. McMicken stated that there will be . meetings regarding the 1970 Budget with the City Council and various City Departments, as needed,.and a•Notice of Hearing on Adoption of the Final Budget for.1970 will be pub- lished twice, fixing the time of a:public heating ;by—the City Council for Monday, Decem- ber 1, 1969, for the purpose of,fixing the final budget for the City of the fiscal year of 1970, in accordance -with State Statute. . He further explained that he has a copy of a Resolution passed Friday, October 30, 1969, by the County Commissioners that authorizes the County to petition alon it .the C•t o for dissolution of the Metropolitan Park District, as requi ty raw, c /' hr Mr_l Andrews stated that the County has further offered to convey and transfer to the City of Yakima . all of the assetsof the Metropolitan Park District that would otherwise be distributed to Yakima County, in of the assumption by the City Yakima of all lia • bilities of the Park District. He explained that they will meet with the.Park Board • this week to present the joint petition of dissolution and to take. care of .any other mechanical things that have to be done to effect the dissolution of the Metropolitan Park District.
