The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, McNeice and Robinson, Assistant City Manager Friedline and City- Attorney Andrews . present on roll call. Councilman Kurbitz and City Manager McMicken absent on roll call. . • City Manager McMicken was excused at a previous meeting. It was MOVED by Keith, seconded by Robinson that Councilman Kurbitz be excused from this meeting: carried, Brown, Keith, . • Lambert, Larson, McNeice and Robinson voting aye by voice vote. The Invocation was given by Councilman Lambert. . The minutes of the regular meeting of October 14, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said. minutes read publicly, Mayor Larson declared said minutes approved as recorded. . This being the time fixed for the Hearing on Resolution of Intention No. D -1394, to improv property by the paving of certain streets and alleys,•and_there being some protests in writing, it was MOVED by Lambert, seconded by Keith that Ordinance No. 1178 creating L.I.D. • No. 976, 1969 Street and Alley Paving L.I.D., be passed as read. A number of protests • having been received in writing, Public Works Director John Mayo reported on the percen- tages of protest on the'various streets and alleys in this proposed'L..I.D., as follows: Prasch Avenue from S. 16th Ave. to S. 20th Ave.. 35.25% N. 58th Ave. & Marilane - Irr.Canal to Scenic Drive 39.61 . East "I" St. - N. side between 3rd & 4th,Sts. 66.67 • Alley - Blk. 1, Ray's Nob Hill Add. • 16.93 Alley - Bet.l6th & 17th Aves-. MacLarento Lombard . 10.0. Alley, Blk. 350, Capitol Addition . 16.43 . • He explained that the people still have 30 days in which to protest and that a final report of the protests will be made. Mr. Mayo further explained how a local' improvement district such as this is formed and reported that where several streets and alleys in various parts of the city are included in a district, each street is figured separately in order to obtain an accurate percentage.of protest. He stated that according to •State Statute 60% protest of an L.I.D., or a portion of a district if figured separately, protests out that district or portion, and to date one portion of this proposed L.I.D., • East "I" Street, North side between 3rd and 4thStreets,, has received 66.67% protests in writing, which automatically protests out this portion of the district. Mr. Mayo reported that if the percentage of protest` is over 50 %, the City.Council usually deletes that portion even though it takes 60% protest under the law to be automatically deleted. He further explained that in some cases where the majority of protests is.at one end or the II other of a proposed district or portion, the City Council may give authorization to delete that portion from the.proposed District. Those present speaking for and against this proposed district, or a portion of it, and others asking questions regarding construction of various street and alley improvements, interest rates, and requesting other pertinent information, were Mr. Gerald E. Carls, Mrs. Blackburn, Mr. Ferdy Valdez, Mr. Urgel Cartier, . Mr. Marks, Mr. & Mrs. Lawrence R. Young and.Mr. Guy Huston. There being 39.61% protest in writing on.the North 58th Avenue & Marilane, irrigation canal to Scenic Drive portion and the major part of the protest being at one end, Council members suggested deleting that portion from the .District. After due discussion, it was MOVED by Robinson, seconded • • by Keith that this proposed Ordinance be amended by eliminating the East "I" Street, North side•between 3rd and.4th Streets portion and reducing the portion leading. Kurbitz absent. • ORDINANCE NO. 1178, AN ORDINANCE providing for the improvement of certain'streets and . . •alleys by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local • Improvement District, providing for the method of payment thereof, and creating_a special • fund. 0 • This being the time fixed for the Hearing on the 24th Avenue Street Improvement Project, Public Works Director John Mayo explained in detail the proposed project and referred to a map showing the property that will need to be acquired to have enough right -of -way to construct this improvement. . He explained that this is a joint City of Yakima and • . Yakima County project, and funds have been allocated from th`e U.A.B. for the major part of the construction.' He further explained that the balance of the City portion will be paid • by gasoline taxes and matching City funds,.which means that this project will not have any assessments against the property owners. Mr. Mayo stated that each property owner involved will be met with privately to discuss the matter of right -of -way acquisition of the property needed for this project. He answered general questions about this project. Those present asking questions about the construction, irrigation lines, water and sewer lines, street lighting and in general expressing approval of the project, where Mr. A.P. Freimuth, Mr. Hugh Davis,.Mr. M.E. McCarger, Leo Henning, Mrs. Walter Shoot, Mr. Galen Sutton, Mr, George Gaiser, Mrs. Cramer, Mr. Harold Mattson, Mr. Glenn Hardman and several ° ill other- -s. After due discussion,. Mayor Larson closed the Hearing. • • ' Petition No.•648, having been filed with the City Clerk on October 16, 1969, by Glascam Builders, Inc., requesting improvement of property by the construction of curbs, gutters and surfacing of Barge Street - between N. 58th and 60th Avenues, it was MOVED by Robin- son, seconded by Brown that said Petition be referred to.the City Manager and Staff for 0 study and recommendation: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz absent. Assistant City Manager Friedline reporting that Police Chief Madden is requesting authori- zation for Sgt. Jenkins and Sgt. Nesary.to attend a Polygraph Seminar'at Portland, Oregon, • 631 . • OCTOBER 20, 1969 • from November 3 to 7, 1969 at a estimated cost to the City, of :$50 per man, it was MOVED by Keith, seconded by McNeice that said travel be authorized with expenses paid: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye. by voice vote. Kurbitz absent. • Assistant City Manager'Friedline reported bids were received and considered by a bid board on October 10, 1969, on S. 24th Avenue Storm Drain construction, as follows: • DeBlasio Construction Co., Inc. $28,106.00 McVey Plastering Co. 29,575.00 Ray C. Pickins, Inc. 35,495.50 • Bill's Septic 43,705 The City Engineer recommending that the contract be awarded to DeBlasio ConstructionCo., Inc., the low bidder on this project, it was.MOVED by Robinson, seconded by Brown that the recommendation of the -City Engineer be accepted and that the bid be awarded to DeBlasic Construction Co., Inc., in the amount of $28,106.00 and that the City Manager' be authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Brown, Keith, Lambert, Larson,•McNeice and Robinson voting aye by voice vote.
