City Manager McMicken and. City Attorney•Andrews absent on roll call, having ' been excused at a previous meeting. . The Invocation was given by Councilman Keith. • The minutes of the regular meeting of October 6, 1969,. having been duly certified accurate by two Councilmen, and no one present wishing,to have .said minutes read publicly, Mayor Larson declared said minutes approved as recorded.. This being the time fixed for the continuation of the Hearing on the Appeal from the Plan- ning Commission's decision in denying the rezone application of Harry Borland, requesting rezone of property situated at 916 and 918 S. 3rd Avenue, Assistant City Manager Friedline • reported that the Board of Adjustment has granted Mr. Borland a variance which will enable him to make the requested improvements to his property, which makes his request for rezone 'of his property unnecessary. After due discussion, it was MOVED by McNeice, seconded by • Keith that this matter be tabled: carried, Brown, Keith, 'Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote.. • An Ordinance authorizing the loan of $14,500 from the Transit Fund to the Airport Fund and appropriating $14,500 in the Airport Fund, having been read in its entirety at the last meeting of October 6, 1969, and being read by Title only at this meeting, it was MOVED by Brown, seconded by McNeice that Ordinance No. 1173 authorizing said loan and said approp- riation, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. • ORDINANCE NO. 1173, AN ORDINANCE authorizing a temporary loan of $14,500 from 410- Transit Fund to 390- Airport Fund' and providing for repayment; and appropriating the amount of $14,500 to Account 7 -340, Stationary Equipment, Land, Building and Plant - Maintenance and Operation, within the 1969 Budget for 390 - Airport Fund. It was MOVED by Brown, seconded by McNeice that Ordinance No. 1174 annexing city owned • property to the'City of Yakima, for Municipal Airport clear zone and municipal road purposes be 'passed as read:- carried, Brown, Keith, ..Kurbitz, Lambert, Larson,: McNeice and Robinson voting aye on roll call. •Assist'ant City Manager Friedline explained that:the City owns the property described'in this Ordinance, which is situated outside of but contiguous to the city, a portion of which property constitutes part of a required airport clear zone and a portion of which property constitutes road right-of-way for Washington Avenue in the • vicinity of the Yakima Municipal Airport, and that it seems to be in the best interests of the city that said property be 'annexed to the city for 'said.municipal'purposes.' ORDINANCE NO, 1174, AN-ORDINANCE-annexingi city owned property to the city of Yakima for Municipal Airport clear zone and municipal road purposes; and declaring an emergency. It was MOVED by Lambert, seconded by Keith that Ordinance No. 1175. relating to traffic control -and rfixing the speed limits on West.Washington Avenue',•be•passed as read:: carried, Brown, •Keith, Kurbitz, Lambert; Larson, McNeice and • Robinson . voting .aye on. roll, calla Assistant City Manager' Friedline explained that this will be..the only -fifty mile per hour • speed limit in the Yakima city limits at the present. time and is on West Washington Avenue from 28•thvAvenue.to thewest city •limits. r ORDINANCE NO. 1175, AN ORDINANCE relating to traffic control; setting speed limits on West Washington Avenue; adding Subsection 9.75.010 +(f) i(1') to the'City of Yakima Municipal Code , and dec lar-ing ).an emergency, 1 • It was MOVED by Keith, seconded by Robinson that Ordinance No. 1176 relating to irrigation maintenance assessment procedures and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on . roll call'. Assistant City Manager Friedline referred to city Attorney Andrews' Memo re- garding the•amendment's td-Irrigation • System Maintenance Ordinances, in.which.he. explained the two changes being made. He explained that one change consists of including a refer- ence to the parcel number assigned by Yakima County which may be used by the City in lieu • of complete legal descriptions in record keeping and giving notices pertaining to irriga- tion system maintenance. He further explained that the other change is in the number of times that the City Treasurer is required to publish a notice stating that the assessment roll is in his hands for collection. He stated that previously it was required to be published in ten consecutive daily issues and a state law now requires that the local pro- . cedure in this regard conform to the procedures required to create a local improvement district which now provides for one publication each week for two consecutive weeks. ORDINANCE NO. 1176, AN ORDINANCE relating to public services and utilities; providing for the preparation of assessment rolls to impose costs of, irrigation system maintenance to property specially benefited; requiring and specifying notices to be given of hearings on such assessment rolls; requiring and specifying notices of assessments be given; and amend- ing'Sections 7.24:030, 7.24.040, 7.24.055 and 7.24.060 of-the City of Yakima Municipal Code. It was MOVED by Robinson, seconded by Lambert that Ordinance No. 1177 fixing the time of delinquency, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion of L.I.D. No. 970, Alley Paving - Block 6 Loma Vista Addition and Block 2 Highland Addition, be passed as read: carried, Brown, Keith, Kurbitz, . Lambert, Larson, McNeice and Robinson voting aye on roll call. . ORDINANCE NO. 1177, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 970, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. Mr. James E. Mclain, President, Yakima Education Association, read a letter from the Yakima Education Association, representing nearly 600 educators in School District #7, a copy of.which is filed with the City Clerk. The letter expressed their concern with • problems facing the Yakima fire and police departments and urging the City Council to make every effort possible to see that these departments are adequately funded during the • .\ 629 •October 14, 1969 • coming fiscal year, and stated that at their representative council meeting of October 9, 1969, the following resolution was passed: "We the members of the Yakima Education.Associa- tion wish to give our support to the police and fire departments of the City of Yakima in their efforts to obtain the financial support necessary for maintaining and upgrading fire and police services in the community. Council members indicated their appreciation of the concern and interest of the Yakima Education' Association. Mr. Kenneth' Groth, representing' the Yakima Fire Fighters Association, stated that several months ago the members of the Yakima Fire•Department Alarm Division sent in a•request, a copy of which was sent to the Firemen's Relief and Pension Board, that they be transferred to the Firemen's Relief and Pension System from the Statewide Retirement System as they believe they are now eligible to come under the new' 1969 Pension Act, and have not received any information : regarding this request. Mr. Groth further stated. that they haves drafted an Ordinance for consideration of the City Council, which they feel may be used for guidance in preparing the proper Ordinance which in substance changes the designation of "alarm operators" to that of "fire dispatchers ", and amending the Yakima Municipal Code, and which . would enable the present alarm operators to transfer or change from the Statewide Retire - .ment System to the Firemen's' Relief and P,ension System in accordance with the new 1969 Pension Act. He presented copies of this proposed Ordinance' to City Council members. Council members indicating that they would like to study this matter further, and discuss it with the City Manager and City Attorney, it was MOVED by Robinson, seconded by Lambert that this matter be referred to the Staff for study and recommendation: carried, Brown, Keith, Kurbitz,' Lambert, Larson, McNeice and Robinson voting aye by voice vote. Mr. Bill Horst, representing the Yakima Fire Fighters Association, stated that they have met with the City Manager three times in the past three weeks regarding wages, and would like to meet with the City Council in either a closed or an open meeting regarding this matter. Council members indicated that they would prefer an open Council meeting and at a time when City Manager McMicken can be present. After' due discussion, it was MOVED by Robinson, seconded by Keith that October 27., 1969, be fixed as the time for a meeting with - theakima Fire Fighters Association: carried, Brown, Keith, Kurbitz, Lambert, Larson,. McNeice and Robinson voting aye by voice vote. • Assistant City Manager Friedline referred the matter of authorization to execute an agree- ment with Washington State Highway Department re ,relocation and reconstruction of a por- tion of a 'City irrigation reservoir to Public Utilities Director Frank Stein. Mr. Stein explained that they have been working with members of the State Highway Department regard- ing changes in the' irrigation reservoir in connection with the construction of State Route No. 12, Fruitvale Interchange to. North 1st Street Interchange. He referred to a map of. this area and explained the changes that will be made in -the slope of the reservoir, stat- ing that they will lose very little in volume by making these changes. After due dis- cussion, it was MOVED by Brown, seconded by McNeice that Resolution No. D -1402 authorizing the execution of an. agreement with the State Highway Department regarding relocation and reconstruction of a portion of said irrigation reservoir , be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1402, A RESOLUTION authorizing and directing the City Manager and City. Clerk of the City of Yakima to execute an agreement with the State of Washington regarding relocation and..reconstruction of part of a city owned irrigation reservoir. Assistant City Manager Friedline referred to Building Inspector Newell Pock's report of expenses in demolishing the dangerous building at 509 E. Adams, and stated that the next action to be'taken.regarding this matter is to fix a date of Hearing on this report. After due discussion, it was MOVED by Lambert, seconded by McNeice that October . 27, 1969, be fixed as the time for a Hearing by the City Council on this matter and that the City Clerk give notice of such Hearing as required by law: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.
