HomeMy WebLinkAbout10/06/1969 Business Meeting 625 • OCTOBER 6, 1969 The City Council met in regular session, Mayor Larson presiding,'Councilmen Brown, Kurbitz, Lambert and McNeice, City Manager:McMicken and City Attorney Andrews present on roll call. Councilmen Keith and Robinson- absent'on roll call, having been. excused at a previous meet- ing. • The Invocation was given by Councilman Brown. The minutes of the regular meeting of September 29,,,,1969 having been certified accu- rate by two Councilmen, and'no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 643 filed by. Glascam Builders, Inc., requesting annexation of property situated northwest of the intersection of 58th Avenue and Barge Street, Planning Director Bruce Finke explained that the Planning Com- mission considered this matter in public hearing on October 2 1969 and recommended the annexation of said property. He further explained that the Planning Commission recommen- . ded the approval of the conditions pertaining to the development, suggested'.by the Council, with the exception that sidewalks be constructed by the developer on the south and west sides of the development and extending to Summitview Avenue, and that a sidewalk easement • be provided on the east•side•of the property as planned. Mr. Finke stated that the Plan- ning Commission also recommended that the property be zoned PD, Planned Development, Zone in accordance with the final development plan and program attached to the annexation or- dinance and in accordance.with the final plan map of the development attached to the City Clerk's copy of this report as modified by the sidewalk construction : Mr. Ron Whitaker, • Attorney representing Glascam Builders, Inc., stated that they concur with all the sugges- ted conditions except the recommendation by the' Planning Commission that they be required to build the sidewalks on the south and on the - east. He filed with City Attorney Andrews a Quit Claim deed dedicating 20 on the south, and 4 feet on the east and west sides for sidewalk purposes. He stated that at the Planning Commission meeting was the first time they had heard of a developer building a sidewalk, which benefits others, outside the development as much or more than those living there and feel that•such a sidewalk should be constructed as part of.an L.I.D.., and not by the builder at this time. Discussion by Council members indicated that they do not feel that Glascam Builders, Inc. should be re- quired to build the sidewalks as recommended by the Planning Commission, or that it is even necessary for Glascam to give easements on the east and west sides of the development. After due' discussion, it was MOVED by McNeice, seconded by Lambert, that the four foot . easements and sidewalks on the east and west sides of the project be deleted from.the con- ditions recommended by the Planning Commission and that on the south side, the 20 foot easement be dedicated for public street purposes: carried, Brown, Kurbitz, Lambert, Lar- son and McNeice voting aye by voice vote. Keith and Robinson absent. Mr. Whitaker re- ported that Builders, Inc..has given Mr. Pickens and Mr. Rosenkranz easements as previously requested in these conditions. It was then MOVED by Lambert; seconded by McNeice, that Ordinance No: 1169 annexing said property to the City of Yakima be passed as read: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye on roll call.. Keith and Robinson absent. • ORDINANCE NO. 1169, AN ORDINANCE annexing property to the City of Yakima, and zoning said property, and declaring an emergency. • This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 971, Richey Road and Others Paving District, and there being no protests in writing or other- wise, it was MOVED by McNeice, seconded by Lambert, that Ordinance No. 1170 confirming said Assessment Roll and every part thereof, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye on roll call. Keith and Robinson absent. ORDINANCE NO. 1170, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 971 as created and established by Ordinance No. 971 as created and establishe. by Ordinance No. 1059 of the Ordinances of the City of Yakima. • An Ordinance authorizing the loan of $14.,500 from the Transit Fund to the Airport Fund and appropriating $14,500 in the Airport Fund, having been read in its entirety at this meeting, was laid on the table for one week or until October 14, 1969. It was MOVED by Brown, seconded by McNeice, that Ordinance No. 1171 fixing•and levying ad valorem taxes necessary to balance the 1970 Budget, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye on roll call. Keith and Robinson absent. City Manager McMicken referred to the Budget Calendar and stated that as a result of chang =s in the 1969 Laws, the Budget is later this year. He further stated that the Preliminary Budget will be filed with the City Clerk and submitted to the City Council on November 3, 1969 but at this point it is necessary to file this tax Ordinance with the County for levy ing the necessary taxes. Mr. McMicken reviewed his report on the estimated revenue and estimated expenses for the 1970 Budget and stated that within the next few weeks the bud- get will be balanced, Hearings held, and the final Budget prepared for adoption. ORDINANCE NO. 1171, AN ORDINANCE fixing and levying the amount of ad valorem taxes neces- sary to balance estimated revenue with estimated expenditures for the 1970 Budget for the • City of Yakima. It was MOWED by Lambert, seconded by Brown, that Ordinance No. 1172 fixing the time of delinquency and providing for. the issuance of Local Improvement District Installment Notes for the payment the unpaid portion of L.I.D. No. 972, North and South First Street Water District, be passed as read: carried, Brown, Kurbitz, Lambert, Larson 'and McNeice - voting aye on roll call. Keith and Robinson absent. ORDINANCE NO. 1172,. City Manager McMicken referred to his Report #65, 24th Avenue Street Improvement Project, and the attached Memos from John Mayo, Director of Public Works, and Bruce Finke, Direc- tor of Planning and Community Development regarding this matter. He explained that South . 24th Avenue from Hill Boulevard to Washington Avenue is proposed for improvement next summer and fall as an Urban Arterial project and is jointly funded with the County.. He referred to the strip map of the project prepared by the traffic engineer under the direc- tion of the Director of Public Works,•showing the proposed travel lanes, sidewalks and park strips. Mr. McMicken stated that on- street parking is not proposed, although this matter should be decided by the City Council after public hearing, but that he feels that all four lanes should be used for arterial traffic as no costs for the project will be assessed against abutting properties and therefore they should derive no special - parking benefits. He recommended that after review and recommendation by the City Planning Com- mission, that the City Council hold a public hearing, and at the direction of the City Council, direct mail notice to the abutting property owners and residents will be given. City Manager McMicken explained that on February 16, 1965 the City of Yakima purchased at its Local Improvement District foreclosure sale, several parcels of property situated in the City of•Yakima, whxh are subject to liability for general taxes and other special. assessments and that these parcels are subjects of current tax foreclosure proceedings by Yakia County. He further explained that it is necessary that the City pay delinquent taxes and assessments in the amount of $53.81 and recommended authorization to pay said amount-. It was MOVED by McNeice, seconded by Brown, that Resolution -D -1401 authoriz- ing the payment of said real estate taxes andassessments, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye on roll call. RESOLUTION-NO..D -1401, A RESOLUTION directing the City Treasurer to pay the amount of $53.81 to Yakima County for delinquent general taxes and special assessments on real pro- perty now owned by the City.
