Councilman Robinson'absent on roll call, having been excused at a previous meeting. • The Invocation•was given by Councilman Kurbitz. •' • The minutes of the regular meeting of September 22, 1969, having been duly certified accurate by two,Councilmen.,.and no one present wishing to have said "minutes read publicly, Mayor Larson declared said minutes approved as recorded. - . This being the time fixed for the continuation of the Hearing on the Appeal from the Plan- ning Commission's decision in denying the rezone. application of Harry Borland, requesting rezone of property situated at 916 and 918 Avenue, and City'Manager McMicken indicating that this matter needs to be further continued to allow time for a meeting with the Board of Adjustment, it was MOVED by Keith, seconded by, McNeice that this hearing be . further continued to October 1969: carried, Brown, Keith, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Robinson absent. • This being the time fixed :for. the Hearing on the Appeal from the Planning Commission's • decision in denying the rezone: application of Mrs. Mary Brewer,.requesting rezone of pro- perty situated at 810'and.812 S. 14th Avenue, filed by Mr. Edwin L. Emerick, representing Mrs. Brewer, Bruce Finke, Director of Planning and Community Development :rev_iewed this • m atter.'• He 'reported that the.City Council had referred the. Brewer rezone. request back to . the City Planning Commission for further consideration. Mr. Finke briefly reviewed the • Land Use which' was done in the vicinity of Yakima Valley College, stating that the. Planning Staff had. recommended against a change in the General Plan or R -2 zoning, but that one of the. proposed amendments to the Zoning Ordinance which: was also_ considered at • th_e Planning Commission meeting, would permit. multiple family dwellings .in at R -2 zone when approved:by the Commission. He further'stated that this amendment,' if adopted, would permit the Brewers to.construct an apartment on their property, subject to approval of Specific by th,e Commission and certain density and other'dimensional requirements. Mr..Finke reported that the:Pl•anning Commission recommended that the rezone request be denied and that the.matter be referred back to the City Council along with the explanation of the proposed Zoning Ordinance Amendments. Councilman Kurbitz stated that..he felt that .although the density would be somewhat increased by changing the requirements of an R -2 Zone, that it would not be enough as there needs to be allowance. for more people in this close proximity to the College.• Councilman Brown and other Council'inembers questioned Mr. Finke regarding Mrs: Brewer's request and 'asked if he felt Planning Commission will allow her to construct an apartment on her property if rezone request is denied and . Mr. Finke stated that it was felt that - she would able to do this, since the Zoning • Ordinance will allow this construction. After due discussion, it was MOVED by Brown, seconded by Lambert that Resolution No. D -1398 affirming the action of the Planning Com- mission in denying the application of Mary Brewer to rezone certain property, be passed as read: carried, Brown, Keith,. RESOLUTION NO, D- 1398,,A RESOLUTION affirming the action of the Planning Commission .in denying the application of Mary Brewer to.rezone.property at_.810•and 812 South .14th Avenue, • Yakima, Washington, from R -2, Two - Family Zone, to R -3, Multiple Family Zone,. • • This being the time fixed for'the Hearing on the Planning Commission's Resolution of Intention to'amend'Title 12 - Zoning of the Yakima Municipal Code, Bruce Finke, Director of Planning & Community'Development ' explained'that this matter was discussed at a joint City Counci .- City Planning Commission meeting and the proposed amendments to the Zoning . Code were concerned mainly with adding to the R -2,' Twd Family Zone, additional usage which . may be allowed 'by a special permit of the Planning :Commission, "and an addition to' the Zoning Ordinance of a new RM,. Medium"Density Residential Zone, which is'between the R -2, Two Family Zone and the R -3, Multiple- Family Zone.. ORDINANCE "NO..` 1163, AN ORDINANCE to zoning; defining terms; designating classes • •of zones; prescribing use regulations and off - street parking-regulations applicable to various zones; creating an RM, Medium Density Residential Zone, and prescribing regulations and requirements therefor; amending Sections 12.08.010, 12.16.010, 12.52.010, 12.56.010 • and 12 :56.110 of the City of Yakima Municipal Code;' and creating and adopting Sections 12.04:301 and 12.04.317, and Chapter 12.18, consisting of Sections 12.18.010, .020, :030 and .040 as.a new chapter and new sections of the City of Yakima Municipal Code. • Petition No. 647, having been filed with the City Clerk on September 22, 1969, by Robert B. City Manager McMicken explained that this Ordinance amends the Code to change lot and residence numbering from the City Engineer's Office to the Office of the Building Inspector.. - ORDINANCE NO. 1165, AN ORDINANCE relating to streets'and sidewalks; providing for the num- bering of lots and residences in the of•Yakima; and amending Sections 8.52.020 and 8.52.040. of the City of Yakima Municipal - Code. • In- accordance with action taken at the last regular meeting of the City Council.on September 22, 1969, and an Ordinance having been prepared amending the Yakima Municipal Code in accordance with the recommendations of the City Manager's Report No. 64 - L.I.D. ORDINANCE' NO. 1167, AN ORDINANCE,fixing'the time of delinquency of installments of•assess- ments levied for the payment of the cost of the' improvement in Local Improvement District No. 969 and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. • It was MOVED by Brown, seconded by Lambert that Ordinance No. 1168 fixing the time of delinquency and • providing for the issuance of bonds for the payment of the unpaid portion of L-.I.D. -No. 974, King Street Addition and Others Sanitary Sewer District, be passed as read: carried Brown, Keith, Kurbitz Lambert, Larson and - McNeice.voting aye on roll call. - Robinson absent. • . • ORDINANCE NO. 1168, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District - No. 974, and providing-for the issuance of bonds with coupons attached fo_r the payment of the unpaid portion thereof. • Mr. Herb Schoff, who spoke at the last City Council meeting on September.22 1969, .regarding the hiring practices of the City Council and Planning Department, read another statement prepared by him regarding this matter. (A copy of his written statement is on file.) City McMicken asked that the matter of his report of Employee practices for hiring for the Survey of East Yakima, which was to have been discussed later in the meeting, be brought before the City Council at this time. It was MOVED by Keith, seconded• • • by McNeice that said matter be brought before the City Council; carried, Brown, Keith, Kurbitz, Lambert, Larson and McNeice voting.aye by voice vote. Mr. McMicken then related that the application relative to the East Side Survey is made to the State of Washington, and through them to the Federal Government, for Federal funds, . and this survey is to merely get facts and figures to make said application. .He further stated that this Housing and Family Survey of southeast Yakima includes land lying out- side the City limits as well as inside the City. People present to.discuss and criticize the matter of hiring practices of the City, were Mr. Larry Robinson, Mr. Fred Easter, • Mr. Walter Dauber, Mr. James Smith, Mr. .Ivan Williams, Mr. Elwin Kelting -and Mr. Arlin Wilson. Mr. Carter and Mr. Fred Sweitzer complimented the City Council on their defense of the accusations made agains -t. those people employed to do the Survey. ..City Manager McMicken, Councilman Lambert -and: other Council members spoke in favor of the hiring prac- tices of the City and indicated that from time to time the City's hiring practices may be modified when they involve part -time workers. • •- City Manager McMicken referred to the matter of authorization to engage a Consulting Actuarial for the valuation of. the Firemen's Pension Fund.. He stated that all existing • policemen and firemen will come under the new 1969 Pension law, which will include some assistance on its funding...-After due discussion, it was •MOVED by Keith,. seconded by Lambert that Resolution No. D -1399: authorizing the engaging of Milliman & Robertson, Inc., for said valuation services, be passed as read: carried, Brown Keith, Kurbitz, Lambert, . Robinson absent. • RESOLUTION NO. 1 -1399, A RESOLUTION authorizing the City Manager to engage professional • services of Milliman & Robertson, Inc., consulting actuaries, for an actuarial valuation of the Firemen's Pension Fund of the City of'Yakima.. • City Manager McMicken referred to the matter of authorization to submit Prospectus to Urban Arterial.Board for the following projects: . He explained that the Prospectus for each of the projects must be submitted to the Urban ,.Arterial Board of the State of Washington,. to request funds for the construction of said projects. After due discussion, it was' MOVED by Lambert, seconded by Brown that Resolu- tion No. D -1400 authorizing the execution of said Project Prospectus for each of the four projects, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson and McNeice f voting aye on roll call. City Manager McMicken referred to,the report.showing the comparison of.Ambulance service rates of the two companies operating in Yakima,.and stated that this report is submitted • for information'only. , City Manager McMicken requesting authorization for two detectives Bill Thomas and Richard •Clark to attend a Northwest Check Investigators Seminar at Vancouver, it was MOVED by ;,am- Bert, seconded by Brown that said travel be allowed with expenses paid: .carried, Brown, Keith, Kurbitz; Lambert, Larson and McNeice voting aye by voice vote. City Manager McMicken referred to the matter of the lighting project underway along Washington Avenue and stated that a change had been discussed at a meeting of a subcommitt.e appointed to consider the proposed lighting mast installation. Public Works Director John Mayo explained that concern has been expressed that the proposed 20 -foot lighting masts at . the intersection of 16th and Washington Would be. hazardous. to aircraft. He stated that those masts will remain as designed 20 feet in height, but that the. 20 -foot masts west of 16th for about 1,000 feet, will be reduced in height and will be placed in the center median strip, rather than on the sides of Washington Avenue, which will then make the overall height, including :the elevation of the four -foot strip, 12 feet. Mr. Mayo stated • that this change'will cost about $600 more, and.recommended that the City Council approve a change order.for Said' project. Mr. Fred Schweitzer, a flight operator at the airport, • was present.and indicated that this- suggested change.is a good compromise, although he does not like to see poles placed at the ends of, any runway.
