The City Council met in regular session, - Mayor Larson presiding, Councilmen 'Brown, Kurbitz, Lambert and McNeice, City 'Manager McMicken and' C"ity,.Attorney Andrews. ' present' on roll, call. Councilmen Keith and Robinson absent on'roll call, having' been excused at a'previous meeting. " The Invocation - was given by Councilman Lambert. The minutes of the regular meeting of September 8, 1969, having.been duly certified a ate by two`Councilnien; and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. " This being the time fixed'for the continuation of the Hearing on the Appeal from the Plan- ning Commission's decision in denying the rezone application of.Harry Borland, requesting rezone of property situated at 916 and 918 South 3rd Avenue, filed by.Ted Roy, ,Attorney for Harry Borland; City Attorney` Fred Andrews reviewed this matter. He stated that the previous meeting when City Council requested that he investigate the possibility of finding - some way to allow a building permit so that Mr. Borland may do what .he wants to without "the'•necessity of any•rezone, he has reviewed the law, had conferences with the Building Inspector and others, and'as'a result found'that Mr. Borland had filed an'applica- tion for variance with the Board.of Adjustment some time ago, then withdrew the applica- tion before filing - the rezone application:, Mr. Andrews further reported that Mr. Borland now plans "to - re - submit his application for a variance with'the'Board Of Adjustment and.in order to allow time for this meeting and other technicalities involved, requests.,that this Hearing be continued to a date certain, with the possibility that at that time it may have to be further continued. After due discussion, it was MOVED by McNeice, seconded by Brown, that this Hearing be continued for two weeks or until September 29, 1969: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Keith and Robinson absent. City Attorney "'Andrews reported that the City Clerk has advised, him, that Petitions were filefl by. West Va11ey'Cablevision, Yakima Cable TV, 'Inc., requesting'that ' a proposed Cable TV franchise ordinance.be 'submitted to a'vote'of the people, 'and that there are a sufficient number of qualified signatures on the two:Petitions. He further' reported that these two Petitions will be acted upon on this date, with Resolutions calling for an Elec- tion on November 4, 1969. Mr. Andrews.stated that these are the same two - companies that previously filed, petitions requesting that a Cable TV "franchise"ordinance' be' submitted to a vote of the people, wh°ich'.were'both subsequently voted down, and that their proposed ordinances'are 'the'same as the time, West Valley Cablevision, Inc. proposing.a 4% franchise tax to the City Yakima Cable TV, Inc.; proposing to'pay 5 %; and both re- questing•a nonexclusive, twenty -year franchise. After due discussion, it was MOVED by Sown, seconded by McNeice, that Resolution'No. D -1389 requesting the County Auditor t� hold and Election to submit to the electors a proposition as to whether a television distribution system franchise shall 'granted to West Valley Cablevision Inc.; be passed as read: car- ried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye on roll call. D -1389, A RESOLUTION providing for the submission to the electors of the City of Yakima, Washington, of a proposition as to whether or not a television,distribu- tion system franchise shall be granted to West Valley Cablevision, Inc.; and requesting` the Auditor of Yakima County, Washington, to hold an election. It was MOVED by McNeice, seconded by Brown, that Resolution No. D -1390 requesting the County Auditor to hold an Election to submit to the electors a proposition as to whether a television distribution system franchise shall be granted to Yakima'Cable TV, Inc., be passed as read: carried, Brown," Kurbitz, Lambert, Larson and'McNeice voting aye on roll call. Keith and Robinson absent. • • RESOLUTION NO. D -1390, A RESOLUTION''providing for the'submission to the electors of the City of Yakima, Washington, of a proposition as to whether or not a television distribu tions system franchise shall be granted to Yakima Cable TV, Inc.; and requesting the Auditor of Yakima County, Washington, to hold an election. , Petition No. 645, having been filed with-the City Clerk on September 9, 1969, 'by Dr. M.M. Korach & Others, requesting improvement of property by the paving of an Alley in Block 350 - Capitol Addition, it was MOVED by McNeice, seconded by Kurbitz, that Petition No. 645 for the creation of a Local Improvement District be referred to the City Manager and Staff for study and recommendation: carried, Brown; Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Keith -and Robinson absent. An Ordinance appropriating the amount of $12,000 from unappropriated money in the Firemen's Relief and "Pension Fund to various accounts within that Fund, having been read in its en- tirety at this meeting, was laid on the table for ohe week, or until September 22, 1969. City Manager McMicken explained that this appropriation is necessary due to unanticipated service and disability retirements and payments for medical costs over and above those budgeted. • Mr. Del Trimble, representing the United Transportation Union, was present and again re- ferred•to the Petition by the Northern Pacific for the I.C.C. to take off the Mainstreeter. He stated that there will be Hearings on this matter in the County Court House on Tuesday, September 16, 1969, to have people who are in favor of keeping the train onto appear be- tween 9:30 A.M. and 5:00 P.M. He further stated that he hoped the City of Yakima officials' will want to keep this train on. Council members indicated that they are interested in • this matter and Mayor Larson stated that -he will attend the Hearing at some time during the I/ day. After due discussion, it was MOVED by Lambert, seconded by Brown, that a letter or statement of support to keep the train on be written to be read at the Hearing by the Mayor: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Keith and Robinson absent. City Manager McMicken referred to memos, regarding advancing the thresholds on Runways 16 and 22 at the Yakima Municipal Airport in connection with Airport improvements:,_ protesting the advancing of the thresholds, from Howard Hettinger, because he feels that some of the runway footage will be lost; and from Fred S. McKnight of the Federal Aviation Administra- tion, stating that the thresholds on these two runways must be replaced before the pro- posed West Washington Avenue Street Lighting, Traffic Signals and ower Relocation construc • tion can be started. He explained that Air West did not protest the proposed advancing of • . • 618 ' • • SEPTEMBER 15, 1969 of the thresholds and that the experts.in air safety are the F.A.A. and the procedures have been gone over with them on the design of the runways and the safety of the runways. Airport Manager, Jim Eakin, was present and stated•that he had talked with three people from the District Airport Engineers' Office and they indicated that they felt that the City of Yakima is doing the right thing. The Public Works Director described the proposed electrical project, stating that this electrical contract includes street lighting and signalization of 16th and Washington Avenues. He stated that the third phase of the con - tract is that there will be undergrounding of all the pole mounted utilities, which in- volves both telephone and power -- everything adjacent to the Airport Terminal Building, providing for beautification at the airport, and that a sizable part of the bid on this project is the undergrounding. Mr. Mayo further explained that the contractor, immediately, upon the award of the contract, will put in the underground duct work, then the grading and other work can go ahead,.and the electrical contractor would then install the lights, etc., later in the fall. He further explained that the City will own completely and main -, tain completely this system of ornamental lights, because in this case it will be economical: Ty better than 'if it were utility owned. City Manager McMicken explained that the pro- cesses of funding this project begins now but won't be complete until next, year and to do that we must show the appropriation in 1969 and carry it over and in order for us to properly enter into contracts, we must have an appropriation, which will come before the Council next week. City ManagerMcMicken then referred to .a proposed Resolution post- . the-.repayment of temporary loans of. $90,000 from''the Water -Sewer Fund to the Airport Improvement. Fund, to be acted upon at this meeting, and explained that these loan payments must be extended for awhile longer because a federal grant anticipated to be paid to the Airport Improvement Fund to apply to the repayment of said lonas has not yet been received by the City. City Manager McMicken referred to the Bid Summary on the West Washington Avenue Street Lighting, Traffic'Signals & Power Relocation, South 15th to South 25th Avenues, stating that bids were received and considered by a bid board on September 12, 1969 on this project as follows: • Knobel's Electric, Inc. $72,911.82 . Wilsons Electric 77,635.87 • Smith Electric .79,197.46 • The City Engineer, recommending that the contract be awarded to Knobel's Electric, Inc., the low bidder on this project, it was MOVED by Kurbitz, seconded by McNeice, that the recommendation of the City Engineer be accepted and that the bid be awarded to Knobel's Electric, Inc. in the amount of $72,911.82, and that the City Manager be authorized to enter into a contract with said contractor upon the filing of the proper bond and insur- ance: carried, Brown, Kurbitz,.Lambert, Larson and McNeice voting aye by voice vote. Keith and Robinson absent. • • Councilman Lambert stated that she feels that a letter explaining what is being done re- garding these Airport Improvements and reasons for said actions, should be sent to the people who received a .copy of the letter.from Howard Hettinger. It was MOVED by Brown, seconded by Lambert, that Resolution No. D -1391 postponing the re- payment of temporary loans of $90,000 from the Water -Sewer Fund to the Airport Improve- ment Fund, be passed as read: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting • aye on roll call. Keith and Robinson absent. . RESOLUTION NO. D -1391, A RESOLUTION postponing the repayment of temporary loans of $90,000 from 520-Water-Sewer Fund to 912 - Airport Improvement Fund; and amending Resolutions No. D -1255, passed September 16, 1968, and D -1285, passed December 16, 1968. City Manager McMicken explained that for a year and a half the matter of a Collective . Bargaining Agreement with the Fire Fighters Association Local 469, I :A.F.F. has been discussed, meetings have been held on and off with the Union to negotiate a proposed agreement, and have finally arrived at the proposed agreement as now submitted. After due discussion, it was MOVED by McNeice, seconded by Lambert, that Resolution.No. D -1392, authorizing the execution of said agreement be passed as read: carried, Brown, Kurbitz, Lambert, Larson and. McNeice aye on roll call. Keith and Robinson absent. RESOLUTION NO. D -1392, A RESOLUTION authorizing. and directing the City Manager and City Clerk of the City of Yakima to execute a Collective Bargaining Agreement with the Yakima. Fire Fighters Association Local 469, International Association of.Fire Fighters A.F.L. - C.I.O. City Manager McMicken referred to the request for outside City utility service by 'Mr. Thomas E. Pitts at 1122 West "I" Street, stating that at the present time it is not • practical for him to annex, and that he has agreed to abide by the city's.codes and • . building regulations.. Mr. McMicken recommending that this outside hookup be allowed, it was MOVED by Kurbitz, seconded Lambert, that Mr. Pitts' request for outside City utility service be granted upon the signing the Outside Hookup Agreement: carried,• Brown, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Keith and Robin- son absent. . • City Manager McMicken reported that in accordance with action taken by the City Council at the meeting of September 2, 1969, when an agreement proposed by the Washington State Board Against Discrimination was reviewed and referred to City Attorney Andrews with sug- gestions for minor modifications, the proper legislation has now been prepared. Mr. • McMicken stating that this agreement must be adopted according to'the recent Legislature, in order to effect coordination between the State Board .and the local Board, it was MOVED by Lambert, seconded by Brown, that Resolution No. D -1393 authorizing the execution of said Agreement with theWashington State Board Against Discrimination be passed as read: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye on roll call. Keith and Robinson absent. • • RESOLUTION NO. D -1393, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an Agreement with the Washington State Board Against Discrimination. City Manager McMicken. referred to his Reports #62, Proposed Nob Hill Water Company Merger and #63, Proposed Westside Annexation, stating that these two items are inter- related. He reported that there have been many meetings between the City's staff and officials of the • • i 619 SEPTEMBER 15, 1969 Nob Hill Water Company concerning merging the two water systems and the Staff has studied the matter of the proposed Westside annexation, and it now seems that there should be some neighborhood meetings on these two matters. There were several people present at this meeting asking questions about the Proposed Nob Hill Water Company Merger and the Propo- .sed Westside Annexation. After due discussion, it was MOVED by Brown, seconded by Lambert, that the City Manager be authorized to organize meetings in the Westside area to explore •the possibility of some annexations and the merging of the water systems: carried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Keith and Robinson absent. City Manager McMicken requesting that out -of -State travel be allowed. for two fire inspec- tors, Ed Lexa and Richard Harris, to attend a Plastics Seminar in Portland, Oregon, it was MOVED by Lambert, seconded by Brown, that said travel be allowed with expenses paid: car ried, Brown, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote.
