Councilman Keith absent on roll call, having been excused at a previous meet ing. The Invocation was given by Councilman Brown. The minutes of the regular meeting of September 2, 1969, having been duly certified accur- ate by two Councilmen, and no one present wishing to have said minutes read publicly,' Mayor Larson declared said minutes approved as recorded. • This being the time fixed for the Hearing on Petition No. 643, filed by Glascam Builders, Inc., : requesting annexation of property situated. northwest of the intersection of 58th • Avenue and Barge Street,.Bruce Finke, Director'of Planning and Community Development, reviewed this matter, stating that the annexation area contains approximately 6.1 acres.. and is presently in orchard. He reported that on September 2, 1969, the Planning Commis- . sion recommended that the annexation be accepted and zoned a Planned Development Zone, subject to conditions to the zoning as follows: • (1). that the maximum number of residential units 'shall be 43. (2) .that guest parking shall be provided according to the Development Plan with a minimum of 40 spaces and that landscaped islands shall be added to the guest parking areas. (3) that written.access agreements with property to the west of the proposed development, subject to the approval* of the City,Attorney, shall'be secured • ' prior to the issuance of a City Building Permit. . (4) that a firm written agreement with property owners to the south of the proposed development regarding vacation of Barge Street between 58th and 60th Avenues and the. development of cul -de -sacs at North 59th and North 60th Avenues at Barge Street be obtained prior to the approval of the annexation and zoning,by the • Yakima City Council. . (5) that approval of the cul -de -sac design shall:be obtained from City . and County Engineers prior to approval by the City Council. • • (6) that} •if items •3, . 4 arid. ::5 cannot be accomplished as required, the developer shall be required to set the entire project in 20 feet from all service roads.on the north, south, east.and west and dedicate a minimum of 25 feet of public right - of way. II (7) that an adequate water supply shall be supplied for domestic and fire fighting • purposes and that six fire hydrants shall be provided around the exterior of the • development, - subject :to the-approval of the :Fire :Chief:. The Yakima City :Fire Department recommends that one hydrant be located at each.corner.'of the ,develop- ment, with hydrants at the midpoint along the north and south sides of the development. (8) that the access'road to- Summitview tAvenue shall be screened as indicated by the Development Plan and that a four foot sidewalk shall be..c.onstructed on the west, • east and.south.sides of the subject property outside of the perimeter fence. The sidewalk on the west shall extend to Summitview Avenue.' • (9) that the entire project, with the!lexception of access driveways orpublic,:rights- .ofways, shall be surrounded by a four foot.landscaped buffer strip and fence. • This strip shall be used for the landscaping and screening of the project. Final design of the screening and fencing shall be r subj ect.: to_: the approval- of the De- partment Planning , and -Community- Development ... : .. . . is i . i • (10) that all buffer areas and open space that abut a service road shall.be enclosed within . a concrete curb. _ Public Utilities Director Frank Stein explained the water system in the vicinity,. stating that it will be best to use Nob Hill Water as it would be a duplication■of lines to require this annexation area to use City water. Mr. Ron Whitaker,' Attorney representing Glascam Builders, Inc: referred-to the:ten conditions:that:have been suggested. by -the Planning Commission and asked the- City -Council- toc change;or• eliminate.. some of. them: ., He•, expla•ined- • the reasons for not being able to comply with all of these conditions. Mr. Whitaker re- ferred to the third condition, (listed above) stating that they have been unable to obtain a written- access• agreement - -from: Mr -. :Pickens., as he _± _out of town c and they have .no idea. when they wil•1 'be able to contact him. - He - =ind ica.ted .that :they would like-to-make some kind • of arrangement whereby when 'he :i s reached.,_: they are.:will-ing to give shim any access that he may want: -Mr. Whitaker referred to condition number 4, in which thelPlanning.Commission proposed the construction of cul -de -sacs at the end of north 59th and 60th Avenues, stating that they would like to propose an alternate plan, which would make a through street of . Barge and would dedicate an additional 20 fee.t.:to give Street a 50 -foot right -of -way. • . Property owners in this vicinity .•present and : Ito this matter. were Mr.: :Fred Reiner, Mr. Jim Rosenkranz, Mrs. Pool, Mr. Stan Paxton, Mr ::' Bob: Brus;ic and Mr :E-Bob Ware::, They indicated that are' concerned that there are. too many condominiums being built in this area and will create traffic problems, and are not too anxious to have.such a development in their area. Council members reviewed the conditions as recommended by the Planning . Comm'ission 'and• suggested 'amendments to .sotefof.'rthe conditions City.:: AttorneyFred Andrews explained • that in the existing ,Ordinance on Planned ,Development, :.are itemized: many re.- quirements and' details - tha't must' be-included as 'a? par't`` of :the .plan for . that development. He explained -that :the Planning Commission :has the:duty, either of granting the zoning, disapproving it, or granting it with modifications, and that they have now recommended the zoning of this annexation with certain .mod if.ications.. s:ubj ect to_ :certain, other :conditions, to be taken care of prior -to ;the annexation. - .Mr. - Andrews :indicated. that rom . a legal stand- point, the plan is not quite ready•to be submitted to and passed on by the City Council yet, and that the -conditions finally :cons idered should.:.be =made . :a -part : of . the • plan: He recommended that the. conditions as discussed and suggested amendments be referred back to the Planning Commission for their further study and recommendation. SEPTEMBER 8, 1969 • i was MOVED by McNeice, seconded by Robinson that. this matter be remanded to the Planning Commission for its further consideration and that the following list of suggested changes in conditions recommended by the Planning Commission, be considered by the Planning Commission as part of its Hearing, and that upon the conclusion of the Planning Commission' Hearing, that the matter then be heard again by the City Council for its final action; the conditions, and changes thereto, considered by.the City Council and referred to the Plan- ning Commission are as follows: . • (1) No change recommended. . • (2) No change recommended. (3) that written access agreements with property owners Pickens and Rosenkranz to the • west and east respectively of the proposed development, shall be secured prior to approval of the Plan, which agreements shall be subject to the approval of the City Attorney. • • (4) that one of the following alternative provisions be accomplished: (a) that a cul -de -sac be developed on 58th, 59th and 60th. Avenues on the south boundry of the development • (b) that cul -de -sacs be developed on 59th and 60th Avenues and direct access into the Village Square be provided from 58th Avenue (c) that the developer dedicate 20 feet on the south side of the development • between 58th. and 60th Avenues to allow the opening of Barge.. Street and the intersection of 58th, 59th and 60th Avenues with Barge Street, with the necessary dedications and agreements to be executed prior to the Planning Commission's meeting. . • (5) No change recommended. • • (6) recommend that this condition be deleted. (7) No change recommended. (8) that the access road to Summitview Avenue shall be screened.as indicated by the Development Plan and that a four foot strip .,on .,the west, east and_ south sides of the development, be dedicated to the.public for sidewalk purposes, .which strip shall be situated outside the perimeter fence. The sidewalk dedication .on the west shall extend to Summitview Avenue. . (9) that the entire project, with the exception of access' driveways or .public rights-of-ways, shall be surrounded by a sight screening fence, five or six • feet in height. • (10) No change recommended. • • carried: Brown,- Lambert, Larson, McNeice and Robinson'voting aye by -voice vote. Keith and Kurbitz absent. (Councilman Kurbitz excused during this Hearing at 5:00.P.M.) • Petition No. 644, having been filed with the City Clerk on August 29, 1969, by J. P. Pavlick & Others, requesting improvement of property by the paving of an alley, 19th to 20th Avenues between Tieton & MacLaren, and a Petition'protesting this requested improve- ment, having been filed with the City Clerk on September 8, 1969, by Thomas J. Cavanaugh & Others, Public Works Director,'John Mayo, reported that protests on this Petition amount- ed to 53.9% of the proposed improvement. In discussion it was pointed out that 60% protest legally protests out a district, but in the past Council members have felt that if over 50% of the property owners do not wish an improvement, then it should not be improved, and whereas. this protest has :come in before the District has been formed, they feel that it should not be formed. It was then MOVED by Robinson, seconded by Lambert that this re- quested alley district not be formed and that Mr. Pavlick and the others that filed Peti- tion No. 644 requesting this improvement, should, be so' i_nformed :carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith and Kurbitz absent. Mr. Charlie Huff and Mr. Del Trimble were present representing the Transportation Union of the Northern Pacific Railroad, to report that it is proposed to discontinue the service of the.Mainstreeter through the City of and they are seeking to present the case for maintaining this service before the people because they feel. the service is needed and will be especially needed in the future as other modes of transportation become over crowded. They stated that the County Commissioners are. in accord with them and would like the City Council to go on record as supporting this move to keep this train on. Council members indicated their interest in this matter, but no formal action was taken at this • meeting. • • A report having been received from the Planning Commission on its Resolution of Intention to amend Title 12 - Zoning, of the Yakima Municipal Code, it was MOVED by Robinson, seconded by Brown that September 29, 1969, be fixed as-the time for a Hearing ,by the City Council on this matter: carried, Brown, Lambert,.Larson, McNeice and Robinson voting aye by voice vote. A report having been received from the Planning Commission on its reconsideration of the Rezone Application, ;filed by Mrs. Mary Brewer,. for the rezone of property - situated at 810 and 812•South 14th Avenue, it was MOVED by Robinson, seconded by McNeice that September 29, 1969, beset 'as the time for a hearing. by the.City Council.on the matter of::.the• rezone of certain real property as requested by Mrs. Mary Brewer, and that the City Clerk give notice of such hearing as required by law: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Manager referred to the Damage Claim, filed by H. E. Cushing, requesting payment for damages caused by a fire hydrant leaking into his basement, and to City Attorney Andrews' Memo regarding this matter. .Mr. Andrews explained that Mr. Cushing had filed the claim in the amount of.$288.54, and after investigation and a more detailed accounting was made of actual costs. incurred, this amount was reduced to $146.93, and recommends that this claim should be paid in the reduced amount. After due discussion, it ' was MOVED by Robinson, seconded by McNeice that Resolution No. D -1388 authorizing the pay- . ment of said damage claim to Mr. H. E. Keith and'Kurbitz absent. • .. . • • City Manager McMicken reported that in accordance with action taken by the City Council at its meeting of August 4, 1969, when John DeLaney, chairman of the .Senior Citizens Board of Directors, requested financial assistance, since funding by the Federal Govern- ment ends September the.City staff has been studying the problem. He further . reported that the Metropolitan Park Department has provided' funds in the 1970 Budget suffi- cient to finance the Center, and that under the Park Department, the Center would not have its own director,.but would have a hostess working under the guidance of the Park Depart- . • ment's recreation director. ..Mr. McMicken stated that there is no way for the City to • donate funds to the Center for the next three months, and recommended that a meeting be arranged with the Board of Directors of the Center and see if there is some way they can trim expenses for the next three months until the problem can be resolved through the Park Department budget at the beginning of next year. Council.members'indicating that they feel that all the help possible should be given to keep this program going, it was MOVED by •Lambert,.seconded by Brown that City. Manager McMicken be directed to meet with the Board of Directors of the Center, in accordance with Mr. McMicken's recommendation: carried, Brown, • Lambert, Larson and McNeice Voting aye by voice vote. Robinson not voting because of a conflict of interests. Keith and Kurbitz absent. • City Manager McMicken reported that Mr. Walter Philipp's.term on the .Planning Commission expires as of August,.1969.and that he has indicated'that he is willing to serve another. term. .After due discussion, it was MOVED by Lambert, seconded by Robinson that this matter be continued for one week in order to give further' consideration to the appointment: carried,-Brown, Lambert, Larson,. McNeice, and Robinson voting aye by voice vote. .Keith and Kurbitz absent. • ..
