HomeMy WebLinkAbout08/25/1969 Business Meeting 607 AUGUST 25, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert, McNeice and. Robinson, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Lambert. S The minutes of the regular meeting of August 18, 1969, having been duly certified accurate ' by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on the Appeal from the Plan- ningCommission's decision in denying rezone application of Harry Borland, requesting re- zone of property situated at 916 and 918 South 3rd Avenue, filed by Ted Roy, Attorney for Harry Borland, and Mr. Roy having requested" that this matter be continued until Tuesday, September 2, 1969, it was MOVED by Robinson, seconded by Brown that said Hearing be con- tinued for one week, or until Tuesday, September 2, 1969: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. This being the time fixed for the Hearing on the Vacation of a portion of N. 4th Street and certain alleys, filed by Yakima Mall Shopping Center,. Inc., and City.Attorney Andrews ex- plaining that it is necessary to further postpone the effective date of said Vacation, it was MOVED by Brown, seconded by Lambert that Ordinance No. 1155 providing for said Vacation . and postponing the effective date to February 1, 1970, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1155, AN ORDINANCE providing for the vacation of a portion of North 4th Street and certain . alleys in the City of Yakima, Washington; amending Section 1 of Ordi- nance No. 1012 of the City of Yakima passed March 11, 1968, Section 1 of Ordinance No. 1038 of the City of Yakima passed June 24, 1968, Section 1 of Ordinance No. 1074 of the City of Yakima passed October 28, -1968, and Section 1 of Ordinance No. 1125 passed April 28, 1969; and declaring an emergency. This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 972, North and South First Street Water District, and there being no protests in writing or otherwise, it was MOVED by Keith, seconded by Brown that Ordinance No. 1156 confirming said assessment roll and every part thereof, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Public Works Director John Mayo ex- plained.that the final charges are higher than the estimates because it had been previously figured to .include a much larger area and over one -third of the proposed local improvement district was protested out, and the overhead costs had to be fixed for fewer owners. Mr. George Hirahara, property owner in this district, was present to ask questions about hook- ing on to the water main and about the method of payment of his assessment. ORDINANCE NO.1156, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 972 as created and established by Ordinance No. 1062, as amended by Ordinance No. 1070, of the Ordinances of the City of Yakima. Petition No. 643, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on August 22, 1969, by Glascam Builders, Inc., requesting annexation of property situated northwest of the intersection of 58th Avenue and Barge Street, and Mr. Peter Murphy, representing Glascam Builders, Inc., being present, it was MOVED by Robinson, seconded by Keith that this date be set as the time for a meeting with the initiating party as represented by Mr. Murphy: carried, Brown,.Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Mr. Murphy, representing Glascam Builders, Inc., stating that they are willing to accept the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by petition No. 643 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebted- ness. The above MOTION was made by Robinson, seconded by Keith and carried: Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Petition No. 643, having been filed at this meeting by Mr. Peter Murphy, representing Glascam Builders, Inc., requesting annexation of property situated northwest of the inter- section of 58th Avenue and Barge Street, it was MOVED by Robinson, seconded by McNeice that the Petition for Annexation filed by Glascam Builders, Inc., being Petition No. 643, be approved as meeting the requirements' of law; that said Petition be referred to the City Manager and Planning Commission for study and recommendation; that the Mayor be authorized to obtain waivers of a meeting by a Review Board; and that September 8, 1969, be set as the date for a public hearing by the City Council on this Petition: carried, Brown,. Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. An Ordinance authorizing the loan of $10,000 from the Transit Fund to the Airport "Fund and appropriating $10,000 to the 1969 Airport Budget, having been read in its entirety at the previous meeting on August 18, 1969, and being read by Title only at this meeting, it was MOVED by Keith, seconded by Lambert that Ordinance No. 1157 authorizing said loan and appropriation, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1157, AN ORDINANCE authorizing a temporary loan of $10,000 from 410- Transit Fund to 390 - Airport Fund, and providing for the repayment thereof; and appropriating the amount of $10,000 to the various accounts within 390 - Airport Fund for expenditure during the year 1969. An Ordinance appropriating $23,000 Federal Funds for "701" Housing and Family Survey, having been read in its entirety at this meeting, was laid on the table for one week, or until September 2, 1969. Bruce "Finke, Director of Planning and Community Development explained that this is a follow -up on the planning studies which have begun, and for which Federal reimbursement will be made upon the progress being shown. He further explained the work being done on the two studies that are under way, the Housing and Family_:- - study, and the Land Use study being done close to the College. City Manager McMicken explaining that the City owns approximately 450 tons of hay, wire baled and stacked, ready for sale, that bids for the sale of said hay had been called for, but no bids were received and it now seems in the hest interests of the City to authorize the sale of said hay without calling for further bids, it was MOVED by Brown, seconded .by Robinson that Resolution No. D -1381 authorizing the sale of said hay without calling for further bids, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. ) 608 AUGUST, 25; 1969 . RESOLUTION NO. D- 1382, A RESOLUTION authorizing and directing the sale of surplus personal property owned. by the City of' Yakima. . City Manager McMicken referred to the item on the Agenda. regarding the Street Improvement Project, requested by Petition No. 634, on 36th Avenue,'Summitview to Chestnut, stating that for the information of the Council members, petitions filed protesting being included in this proposed Local Improvement District, the protests amounting to •74.4% of the project, which means this Local Improvement District will not be formed as requested.' , City Manager McMicken stated that a request has been made for outside City sewer service at 1602 South 7th Avenue by Mrs. Chris Jensen,' and investigation.has been made regarding annexing this It has been found that until other property owners are interests d in annexing, it is not feasible to annex this property at this time,,bpt that the property • owner is willing to sign an outside hookup agreement, and the staff recommends approval •of this request. After due,discussion, it was MOVED by Robinson, s.econded.by Kurbitz, that the request for outside sewer service at 1602 South 7th Avenue be approved upon the signing of the outside hookup agreement by the applicant: carried, .Brown, Keith, Kur- bitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMic1en•explaining that the Yakima Valley Shrine plans to have a parade on Saturday, September 20, 1969 at.3:00 P.M., and that the Staff recommends that this parade. be. authorized by the. City Council in accordance with the Yakima Municipal • Code, it was MOVED by Robinson, seconded by'Lambert, that authorization be given for . this parade to be held as requested: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.. City Manager McMicken reported that Bids were received and considered by a Bid Board on , ill , West Washington Avenue Arterial Improvement. S. 16th. to S. 28th Avenues, on August '22, 1969 as follows ' . Superior Asphalt & Concrete Co. $166.462.50 Yakima Asphalt'Paving Co. &:Hans M. Skov Const. Co $183,898.20 The City Engineer recommending that the contract be awarded to Superior Asphalt and Concrete Company, the low bidder on this project, it was MOVED by Keith, seconded by McNeice, that the recommendation of the City Engineer be accepted and that the bid be • . awarded to Superior Asphalt & Concrete Company in the amount of $166,462.50, an that the City Manager be authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried Brown, Keith ' Kurbi,tz,.JLambert, - - Larson, McNeice and Robinson voting .aye by voice vote. . John Mayo reported.that the 1969 Overlay program is progressing as planned and that most of.it is being done without completely closing any. streets to traffic. He stated that. When doing the intersection at First Street and Nob Hill on either. Friday,morning, August . 29, 1969 or .Tuesday morning, September 2, 1969, barricades will have to be put up for four to six. hours and traffic re- routed, which includes traffic over the Nob Hill. Over- pass, and that this information will go out through all news media.
