The City Council'met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, • Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken.and City Attorney Andrews present on roll•call. • The Invocation was given by Councilman Keith. • • The minutes of the regular of July 28, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor • Larson declared said minutes approved as recorded. • In accordance with action taken at the previous meeting on .August 4,', 1969, and an Ordi- nance prohibiting parking on the North side of Summitview Avenue from 16th Avenue to 31st . Avenue, having been prepared, it was MOVED by. Keith, seconded_by McNeice:that Ordinance No. 1148 prohibiting said parking, and amending the Yakima, Municipal Code, be passed as read..-City Manager McMicken referred to his Report #60 regarding this matter and ex- plained that copies of this report had been mailed to' residents on each side of the street from 16th to 31st Avenues, the School District and ; other ' interested •parties and had • invited them to come to this hearing today. He stated that he had received letters from several people regarding this matter. Public Works Director John Mayo explained that if the parking is,removed, striping will be for four 11' lanes and two 3'. buffer lanes,, and to get this done by the time school starts,, work needs to be .started right away. Several property owners spoke to this matter. Pat Carroll, 2107 Summitviewsuggested that barri- cades be used in two of the lanes from. 16th to 24th Avenues during the peak hours when children are going to and from school.• Mr. Wes Britt requested that the hearing -be con- . tinued to the next evening meeting so that_ more people can be present.to speak to the matter. Mrs. Desmond, 2205 Summitview, and Mr. John Nicholson, N. 24th Avenue, indicated that they are in'favor of this Ordinance removing the parking from Summitview and restrip- ing as recommended. Mr. John Vandenbrink, Principal of Roosevelt School, reported on the various streets which children travel to reach Roosevelt School, and mentioned fact • that there is very little room for parents to drop children off and pick them up.• After due discussion, it was MOVED by Kurbitz that this Hearing be continued to an. evening meeting so that more people may attend. The Motion died for want of . a second. Councilman Brown indicated that although this may not be the answer to the problem, it seems to be • the hest that can .be done at the present time. Councilman Kurbitz stated that he realizes this is certainly'an attempt.to remedy -'a situation that everyone feels is hazardous, but doesn't think it the proper solution, and can't vote against the attempt'to remedy the • situation, .so will abstain from voting on the matter. Mayor Larson indicated that he doesn't feel that ;this is,a perfect solution. Councilman Robinson stated that he does not • feel that this is the solution, but doesn't think there is any 'solution. He further stated that he does.not favor a limited use of the street. Mayor Larson then called for the roll • call vote on the Motion to pass Ordinance No.. 1148 prohibitingparkingon Summitview Avenue 16th to 31st Avenues, amending the Yakima Municipal Code, and declaring an'emergency. Brown, Keith, Lambert, Larson and McNeice voting, aye roll call. Robinson voting nay on roll call. Kurbitz abstaining from voting. City Attorney advised Council - members, that since this is an emergency Ordinance,' all votes cast must be for the Ordi- nance in order for it. to pass. Councilman Robinson stated..that.although.he is convinced that this is not the solution to the problem, he will,change his nay vote to an aye vote, so that the Ordinance will pass, and work may be started .on the project at once. Then the . Motion. to pass said Ordinance' carried. Councilman. Brown stated that he feels it is the responsibility of the School to use part of their property to make room for parents to be able to leave their children and•pick them up. Mr. Vandenbrink stated that .Roosevelt School now has the, smallest playground of any school in the City, and to use some' of it in this way would make it smaller, but agreed that there should-be some remedy.fo•r.this pro - blem. ... . • ORDINANCE NO. 1148, AN ORDINANCE relating to traffic control; regulating the stopping, standing or parking of motor.vehicles on certain streets and amending subsection'9.75.040 - (ii) of the City of Yakima Municipal Code, and declaring an emergency. Petition No. 639 ;.having been filed with the City'Clerk on July 31, 1969; by Lester and Ruth Slagle, requesting annexation of property situated on 16th Avenue, between Mead • Avenue and King Street, it was MOVED by Robinson, seconded by Keith that the Petition for Annexation filed by Lester and Ruth Slagle, being Petition No. 639, be approved a.s. meeting the requirements of law;. that said Petition be referred.to the City Manager and Planning Commission for study and recommendation; that the Mayor be authorized to obtain waivers of. a meeting by a Review Board; and that August 18, 1969, be Set as the date for'a.public • hearing by.the.City Council on this Petition: - carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. • Petition No. 640, having been filed with the City Clerk on July 25, 1969, by]R.G. Mac - Kintosh, Veterinary Hospital, 401 S. l,st Street, requesting, improvement of property, Park- ing, South.side of East Pine. Street' from SoUth,lst „Street,..east.to alley, it was MOVED by Keith, seconded by McNeice that said Petition for the creation of 'a Local Improvement Dis- trict, be referred to the City Manager and Staff for study and recommendation: carried, Brown, 'Keith, Kurbitz, Lambert, Larson, McNeice and Robin.son,votin,g..aye.by voice'vote. A Damage Claim having been. filed with the City Clerk on July 30, 1969, by Walter Boisselle, 2112 S. 8th Avenue, -in the amount of $38.46 for damages to his pickup at the City Garbage .dump, it was : MOVED by Brown, seconded by Robinson that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lam - • Bert, Larson, McNeice and Robinson voting aye by voice vote. It was MOVED by Brown, seconded by Lambert that Ordinance No. 1149 relating -to•the licen- sing of heating and /or comfort cooling•installers,'be passed as'read. City Manager McMicken explained that this Ordinance has been drawh up to amend the wording in the Yakima Munici- • pal Code, to include service men_working'on heating and cooling,systems as well as in- stallers, in the requirements'for a bond and liability insurance. Councilman Robinson • i • 597 AUGUST 4, 1969 stated that he is not convinced that this is a necessary Ordinance. Councilman McNeice stated that he feels we might be discouraging service men by requiring them to pay these extra fees for bonding and insurance. After due discussion, Mayor Larson called for the roll call vote on the Motion to pass Ordinance No. 1149 relating to licensing of heating and /or comfort cooling installers and it carried:. Brown, Keith, Kurbitz and Lambert voting aye on roll call. Larson, McNeice and Robinson voting nay on roll call. ORDINANCE NO. 1149, AN ORDINANCE relating to the mechanical code of the building regula- tions of the City of Yakima; requiring the licensing and bonding of heating and /or comfort cooling installers; and amending Section 11.32.090 of the City of Yakima Municipal Code. A letter from the Yakima Valley Senior Citizens, Inc., has been received by the Council Members, requesting financial assistance, since it appearsthat•Federal Funding will not • be continued after September 30, 1969. Mr. John R. DeLaney, President of the Board of Directors, and Mrs. Martin Friedline were present to speak to this matter. Mr. DeLaney explained that the Center has been funded the past three years under Title III of the Older Americans Act with the Center providing 25% of .the funding the first year, 40% the .second and 50% the third and current year. He explained that .they will need funds for the last quarter of the year and requested that the City Council give consideration to the inclusion of the Senior Citizens Center Budget as a part of the Park Department budget for • 1970. Council members indicated that they felt this was a very worthwhile organization and are interested in doing what they can to help it continue.. After due discussion, it was MOVED by Keith, seconded by Brown that this matter'be referred to the City Manager, to be further studied and suggestions brought back to the City Council for consideration: carried, Brown, Keith, Kurbitz; Lambert, Larson, McNeice and Robinson voting aye by voice vote. • . Airport and asked Airport Manager Jim Eakin to explain each one. Mr. McMicken further stated that Mr.• Eakin and Assistant City Martin Friedline have worked together on these agreements.' Mr. Eakin.explained that James A. Sellers occupies ground space at-the.Yakima Municipal Air port by virtue of an.Airport Fixed Base Operator's Lease, as modified from time to time, and- at_this time the City and Mr. Sellers wish to further. modify said agreement so as to • reduce the area of ground space to be occupied by Mr. Sellers. Sellers Councilman Kurbitz excused at 4:55 P.M. • Airport Manager Jim Eakin explained that on February 25,.1965, the City leased premises in the Central Building. at the•Yakima Municipal Airport to Alex and Jean Berkes, which • Lease Agreement was to expire on February 22, 1971. Clerk to. execute a Termination of Lease Agreement with Alex and Jean Berkes, husband and wife. • ' Airport Manager.Jim Eakin explained that the City has space in the Central Building at • the Yakima Municipal Airport available.for lease, and the United States Government wishes to occupy said space. He referred to a drawing'on the board and explained the modifica- tions and improvements required by the U.S. Government before leasing this space, stating that the proposed Lease Agreement will begin October, 1969 and the annual rental will be $6300.. Mr. Eakin stated that approximately $8500 to $9000 worth of work will need to be P • done to get this space ready for the U.S. Government to occupy, but that .the rental col t" lected from them will be over double that which is being collected at the present time. City Manager McMicken-stated that the Fire Department, pumper #1 needs to have. some repair work done on it, and since.it seems to. be better-to drive it to Cornelius, Oregon, for . this repair work, he is•requesting that authorization be given for Fire Department person- nel to make this. trip.
