HomeMy WebLinkAbout07/28/1969 Business Meeting 593 JULY 28, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert and McNeice, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Robinson absent on roll call, having been excused at the previous meeting of July 21, 1969. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of July 21, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Councilman Kurbitz excused at 3:10 P.M. In accordance with action taken by the City Council at the previous meeting on July 21, 1969, and this being the time fixed for the continuation of the Hearing on the Rezone Application filed .by Glascam Builders, Inc., requesting rezone of property situated at North 56th Avenue and West Chestnut, it was MOVED by Keith, seconded by Lambert that Ordinance No. 1145 accepting the recommendation of the Planning Commission and rezoning said property, be passed as read: carried, Brown, Keith, Lambert, Larson and McNeice voting aye on roll call. Kurbitz and Robinson absent. Ed Loidhamer of the Planning Department explained that the Planning Department and the Planning Commission had re- commended approval of the request for reclassification from R -1., One Family Zone, to a Planned Development Zone, conditioned on the applicant agreeing to rent'or lease the general storage units for the storage of boats, campers, trailers and household goods only, and that these units not be rented or leased as business premises, Mr. Lee Campbell presented -a letter agreeing to the requested conditions for reclassification and thanked the Council for their action in granting this rezone request. ORDINANCE NO. 1145,, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated on North 56th Avenue between Chestnut and Summit - view, in the City of Yakima, Washington, from R -1, One Family Zone, to a Planned Develop- ment . Zone. . This being the time fixed for the Hearing on the Rezone Application filed by Wallace R. Klingele, requesting rezone of'property situated at 2906 W. Nob Hill Boulevard, and since Mr. Klingele has been denied rezoning of this property several times, and the Planning Commission is now recommending that said rezone be granted, Mr. Ed Loidhamer of the Planning Department reviewed the'matter. He reported that a request for rezoning this property was denied by the Planning Commission on November 7, 1967 and by the City Council on November 27, 1967.. He further reported that a second petition with the same request was recommended for approval by the Planning Commission on August 6, 1968 but the City Council did not concur and referred the matter back to the Planning Commission and that on September 3, 1968 the request was reconsidered and a denial recommended, with the City Council upholding the denial on September 30, 1968. Mr. Loidhamer stated that a new application was submitted on October 8, 1968 again requesting rezoning. from R -2, Two. Family Zone to B -2, Local Business Zone and in addition to the Klingele applications, numerous other requests had been submitted which involved the question of strip commercial zoning and its impact on arterial streets. He stated that the Planning Staff recommended at that time, that before the application be considered, a study of Nob Hill Boulevard should be completed and a policy adopted by the Planning Commission and City Council regarding future zoning on Nob Hill Boulevard, and that at the Planning Commission meeting on November 12, 198, this matter was continued until such a study could be made. Mr. Loidhamer reported that a study of Nob Hill Boulevard has now been completed and as a result of the preliminary findings, since this area is spotted with commercial development, it seems that it will be developed as strip commercial zoning, and at their meeting of July 1, 1969, the Planning Commission recommended that this rezone now be granted. Coun- cil.members asked questions about the Nob Hill Boulevard study and indicated they would like to see it. Councilman Lambert indicated that in the past she has been very much against any further commercial zoning on Nob Hill Boulevard and asked questions regarding the study and the policy of the Planning Commission in the future. She stated that she would like to see the City Council and Planning Commission meet and discuss this study, so that the City Council will understand the thinking of the Planning Commission regarding zoning on Nob Hill Boulevard. Mr. Loidhamer indicated that when the final draft of the Nob Hill study -is finished, the City Council will receive copies and agreed that it would be a good idea to have a joint City Council - City Planning Commission meeting on this matter. Councilman Brown indicated that he had voted several times against this rezone, but is glad to see a more liberal view being taken regarding zoning on Nob Hill Boulevard. After due discussion, it was MOVED by McNeice, seconded by Keith that Ordinance No. 1146 accepting the recommendation of the Planning Commission and rezoning said property, be 0 passed as read: carried, Brown, Keith, Lambert, Larson and McNeice voting a ?e on roll call. ORDINANCE NO. 1146, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 2906 West Nob Hill Boulevard, in the City of Yakima, Washington, from R -2, Two Family. Zone, to B -2, Local Business Zone. Petition No. 639, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on July 28, 1969, by Lester and Ruth Slagle, requesting annexa- tion of property situated on 16th Avenue, between Mead Avenue and King Street, and Mr. Fred Hammerstad, representing the Slagles in this matter, being present, it was`MOVED by McNeice, seconded by Keith that this date be set as the time for a meeting with the ini- tiating parties, who signed the notice of Intention to Commence Annexation Proceedings dated July 28, 1969, as represented by Mr. Hammerstad: carried, Brown, Keith, Lambert, Larson and McNeice voting aye by voice vote. Kurbitz and Robinson absent. Mr. Hammer - stad, stating that they are willing to assume the City's existing indebtedness, it was/ duly moved, seconded and passed that the annexation proposed by Petition No. 639 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. • 594 • • • JULY 28, 1969 •.. Discussion brought out the fact that if a Primary Election is hot held, then this Resolution can be amended to call the Special' Election on this•matter for the same time as General Election, on November 4, 1969. . • RESOLUTION NO: D -1368, A RESOLUTION providing for the submission to the electors of the. City of Yakima, Washington, at a special election, of a proposition as to whether or not an electrical franchise shall be granted to Pacific Power &Light Company; and requesting the Auditor of Yakima County, Washington, to hold a special election. An Appeal from the Planning Commission's decision in denying the Rezone Application of Harry Borland, requesting.rezone of property situated at 916_ and 918 South 3rd Avenue,• having-been filed by Ted Roy, Attorney for Harry Borland, it was MOVED by Lambert, seconded by Brown that August 18, 1969, be fixed as the time for a Hearing by the City Council on said matter and the City Clerk give notice of such hearing as required by law: carried, Brown, Keith,. City Manager McMicken explained that the Urban Arterial Board has allocatedfunds to the City of' Yakima, for three street improvement projects, in accordance with earlier appli•- cation by the City, and in order that the allocated'funds may be distributed to the City, it is necessary that the City execute a Project Agreement with the. Urban Arterial Board for each project and recommends that authorization be given to execute said Project Agree- . ments for the following street improvement projects: South 24th Avenue, "B" Street, and Lincoln Avenue. After due discussion, it was MOVED by Brown, seconded by •Lambert that Resolution No. D -1369 authorizing the execution of said Project Agreements with the'State of Washington Urban Arterial Board, be passed as read: carried, Brown, Keith,'_Lambert, Larson and McNeice voting aye on roll call. Kurbitz and Robinson absent. • RESOLUTION NO. D -1369, A RESOLUTION authorizing and directing the.,Mayor of the 'City of • Yakima to execute Project Agreements with the State of Washington Urban Arterial Board. • City Manager McMicken reported that a course in Supervisory Methods has been completed by. a number of City Supervisors, and he has certificates. to be presented to these men by the' Mayor. Assistant City Manager Martin Friedline, who instructed the course, explained that . the course covered fifteen meetings, with fifteen different aspects of.supervision, plus a final examination. He stated that the attendance was very good and there was good parti- cipation by all who attended. Several of the Supervisors present indicated that they felt the course was very valuable;. not only because of the many aspects of supervision which were discussed, but because they had a chance to meet with other City employees.. City Council members indicated that they feel courses as this are valuable to the City of • Yakima. City Manager McMicken referred to his report #60, Safety Measures for Summitview Avenue -- 16th Avenue to 31st Avenue - Supplement, which is a supplement to. his Report #54, dated April 24, 1969. He stated that in accordance with action taken by the City Council at the Hearing held on May 19, 1969, on this matter, the Traffic Engineer has submitted a report regarding the suggestion of installing fencing along the south side of Summitview Avenue, west of 16th Avenue, recommending against this proposal, and has proposed four 11' driving lanes and two 3' buffer zones, be striped on this portion of Summitview Avenue,. City Manager McMicken, proposing in line with the recommendation of the Director of Public Works, that parking be eliminated on the north side of Summitview Avenue between 16th Avenue and 31st Avenue, and that the street be restriped to utilize the full curb -to -curb width for four traffic lanes, it was MOVED by Keith, seconded by Lambert that an Ordinance • following these suggestions be prepared to present to the City Council at the next meeting on August 4, 1969: carried, Brown, Keith, Lambert, Larson and McNeice voting aye by voice vote. City Manager McMicken stated that a notice will be • sent to the property owners in this vicinity notifying them that the proposed Ordinance will - be brought before .the City' Council at their meeting of August 4, 1969. • City Manager McMicken referring to the City Engineer's report on the completion' of L.I.D.
