The City Council met in regular. session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call, having been excused at the previous meeting. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of June 30, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Petition No. 637, having been filed with the. City Clerk on June 30, 1969, by Lawrence E. Deardorff, President. of Good Samaritan Nursing Home, Inc., & Others, requesting annexation of property in the vicinity of North 16th Avenue and Jerome Avenue, it was MOVED by Robin- son, seconded by Brown that said Petition for Annexation, be approved as meeting the requirements of law ;, that said Petition be referred to the City Manager and Planning Commission for study and recommendation; that the Mayor be authorized to convene a Review Board, as required by law, for a hearing and review of this proposed annexation; and that August 18, 1969, be set as the date for a public hearing by the City Council on this Petition: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. Petition No. 638, having been filed with the City Clerk on July 1, 1969, by Century Plaza Associates and H.C.R.. Inc., requesting alley paving improvement, it was MOVED by Robinson, seconded by Lambert that said Petition for the creation of a Local Improvement District, be referred to the City Manager and staff for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. A recommendation having been received from the Planning Commission, on the Rezone Applica- tion, filed by Glascam Builders, Inc., requesting rezone of property situated at N. 56th Avenue, between Chestnut and Summitview, it was MOVED by Robinson, seconded by Brown that July 21, 1969 be set as the time for a hearing by the City Council on the matter of said rezone application, and that the City Clerk give notice of such hearing as required by law: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Klingele, requesting rezone of property situated at 2906 West Nob Hill Boulevard, it was MOVED by Robinson, seconded by Lambert, that July 28, 1969, be set as the time for a hearing by the City Council on the matter of'said rezone. application and that the City Clerk give notice of such hearing as required by law: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. In accordance with action taken by the Council at the Hearing on June 9, 1969, on the appeal from the Planning Commission's decision in denying the rezone application filed by Mrs. Mary Brewer, requesting rezone of property located at 810 and 812 South 14th Avenue, and a formal Motion disapproving the denial, having been passed by the Council and referring said matter back to the Planning Commission, the Planning Commission reported that at its public hearing on July 1, 1969, it was moved to continue the reconsideration of the Brewer application to their August 5, 1969 meeting and that they will report back to the Council on August 11, 1969. City Attorney Andrews indicating that the letter from the Planning Commission at this meeting constitutes a report to the Council within the forty days specified in their formal Motion, it was MOVED by Robinson, seconded by Brown that the continuance by the Planning Commission of its reconsideration of the Brewer rezone application, be approved: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. An Ordinance regarding licensing of heating and /or comfort cooling installers, having been prepared, and City Manager McMicken stating that more information is needed regarding this matter, it was MOVED by Robinson, seconded by McNeice that said matter be continued for one week, or until July 14, 1969, to gather further information: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. It was MOVED by Brown, seconded by Lambert that Ordinance No. 1141 relating to parking in alleys, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. City Attorney Andrews explained that this suggested amendment to the 'Traffic Code was brought about because a roofing company truck had received a citation while in an alley to roof a building and that this roofing could only be done by use of equipment on this truck. Mr. Cecil Anderson, who is in the refrigeration service and repair business, requested that service vehicles such as his be allowed to park in alleys while performing services to businesses. Council members indicated that they feel that this Ordinance amending the Code will cover Mr. Anderson's situation and that the use of the alleys fall under the jurisdiction and administration of the Police Department. • ORDINANCE NO. 1141, AN ORDINANCE relating to traffic control; governing parking of vehicles I/ in alleys; and amending Section 9.37.020 of the City of Yakima Municipal Code. Keith absent. -This being the year for the election or re- election of three Councilmen to the Yakima City Council, and in accordance with State Statute, the City Clerk provided numbers for the drawing for positions on the ballot. Kurbitz • . • City Manager McMicken explaining,that earth moving work has been performed in connection with the installation of industrial waste discharge pipelines at the Sewage Treatment Plant which required that emergency work be hired at a cost in excess of $500, using equipment not owned by the City and recommending that the Council ratify this work and authorize payment for said work, it was MOVED by Lambert, seconded by Brown that Resolu- tion No. D -1363 ratifying the hiring of work in connection with industrial waste discharge pipeline installation in the amount of $809.88, without calling_ for bids, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll • call. D -1363, A RESOLUTION ratifying the hiring of work for the installation of industrial waste discharge pipelines, and authorizing payment therefor, without calling • for bids. . City Manager McMicken explaining that the lease agreement with the Yakima Valley Transpor- tation Company for facilities for the City Transit Department, expires on October 2, 1969, and that both parties wish to extend said lease agreement for one year, recommended that authorization be given to execute and Extension Rider Agreement. After due discussion, it �' was MOVED by Brown, seconded by Lambert that Resolution No. D -1364 authorizing the exe- cution of an Extension Rider agreement with Yakima Valley Transportation Company for the lease of car barns, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and RObinson voting aye. on roll call.. Keith absent.. RESOLUTION NO. D -1364, A RESOLUTION authorizing and directing the City Manager and City Clerk to execute an Extension Rider agreement with Yakima Valley Transportation Company for the lease of property to the City. City Manager McMicken referred the matter of commencing legal proceedings for collection of damage to the City sewer, to City Attorney Andrews. Mr. Andrews explained that in July of 1966, a city .sewer was damaged during the course of constructing a building, a building contractor for a property owner, and it had been necessary for the City .to repair the damaged sewer at expense to the city of $676.46 for which the city should be repaid by the parties responsible for the damage. He stated that attempts to recover have been unsuccessful, and he is therefore recommending that authorization be given to commence legal proceedings for collection of said expenses incurred by the City in repair- ing the .sewer main damaged by said contractor. After due discussion, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1365 authorizing the City Attorney to commence legal proceedings to recover for daizaje to a city sewer main, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call... Keith absent. • • RESOLUTION NO. D -1365, A ,RESOLUTION authorizing and directing the City Attorney of the City of Yakima to commence legal proceedings to recover for damage to.a city sewer main. Councilman Brown stated that the City has been requested again by the State Deartment of Federal Food Stamp Plan, to sell food stamps.: He further stated that the banks no longer provide this. service, and recommended that the City enter into the program of dis- pensing and selling of Federal Food stamps. ..After due discussion, it was MOVED by Brown, seconded by Lambert that the City Manager and staff do whatever is deemed necessary to enter into the program of selling and dispensing of Federal Food Stamps, carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.• Keith absent.
