The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
Kurbitz, McNeice and Robinson, City 'Manager 'McMicken and City Attorney Andrews pre -, e'nt on
roll call. Councilman Lambert absent on roll call, having been excused at the pre "ious
meeting.

The minutes of the regular meeting of.April 28, 1969, having been 'duly certified a4curate
by two Councilmen, and no one present wishing to have said minutes read publicly, ayor
Larson declared said minutes approved as recorded,
Petition No. 634, having been filed with. the City Clerk on April 28, 1969, by Mr.-lames T.
McCafferty & Others, requestingimprovement of property, by the construction of cures,
gutters and surfacing.of 36th Avenue, Chestnut to Summitview Avenues, it was MOVED by
Brown, seconded by McNeice that said Petition be referred to the City Manager and itaff
for study and recommendation: carried, Brown, Keith, Kurbitz, Larson, McNeice and •obin-
son voting aye by voice vote. Lambert absent.
It was MOVED by Brown, seconded by Robinson that Ordinance No. 1130 prescribing pe alties
for violations, for the Penal'Code and amending said Code, be passed as read: carr ed,
Brown, Keith;.Kurbitz, Larson,_McNeice'and Robinson voting aye on roll call'. Lambert
absent. City Attorney Andrews explained that this Ordinance will change the law to
conform to the State law.

ORDINANCE NO. 1130, AN ORDINANCE relating to public'safety, welfare and morals, prescrib-
ing penalties for violation'of Title 6, PUBLIC SAFETY AND MORALS, of the City of Yakima
Municipal Code; adding new Section 6.02.030, Severability; adding new Section 6.02 040,
Defining_Person; adding new Section. 6.02.050, Prescribing Penalties; .repealing Sec ions •
6.04.590, 6.04:595,"6.16.030, 6.20.140, 6.20.160, 6.22.070, 6.24.070, 6.24.080,'6.'8.020,
6.32.050, 6.36.030, 6.48.020, 6.52.040, 6.56.250, 6.56.260,'6.56.270, 6.60.040, 6...4.060,
6.70.030, 6.72.040, 6.74.020, 6.74.030 and 6.76.030, all of the City of Yakima Municipal
Code.
It was MOVED by Brown, seconded by McNeice that Ordinance No. 1131 prohibiting unn-cessary
noises in the operation of motor vehicles, be passed as read: carried, Brown, Keit , Kur
bitz, Larson, McNeice and Robinson voting - aye on roll'call. Lambert absent. City'Attor-
ney Andrews explained that this Ordinance will add a section to the recently enact-d
Traffic Code, which section was inadvertently omitted from the new revised Code, w en it
should have automatically been carried over from-the previous code.
ORDINANCE -NO. 1131, AN ORDINANCE relating to traffic control; regulating motor vehicles,
traffic, travel and transportation and their incidence, upon the streets, sidewalk ,
roadways, highways, public highways and other ways open to the public; adopting ne Sec-
tion 9.50.100 Unnecessary Noise of the City of Yakima Municipal Code, and declarin• an
emergency.
Mayor Larson referred to a letter received from the Metropolitan Park District Boa'd
expressing appreciation to the City Council and all City departments for their cooi•era-
tion and action in providing funds to assure the continuance of Yakima's swimming •ools
and summer recreation program for the year 1969.

City Manager McMicken stating,that.Police Chief Madden requested authorization for Sgt.
• John Jenkins to attend the Washington State Division, International. Association of Identi-
fication Seminar, June 4 - 7, 1969, in .Vancouver, B. C., and recommending that
this travel be allowed, it was MOVED by Robinson; seconded by.McNeice that said travel be
allowed, with.expenses paid: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson
voting aye by voice vote. Lambert absent.
. City Manager McMicken referred to a matter regarding the construction of the 48" water •Il
transmission main, namely, a "right of entry "permit for the contractor to enter upon the
Northern Pacific railroad property for installation of that transmission line. He stated
that the'railroad.is ready. to submit to us the formal easement right, which they call a
Permit, (permission to use the right-of-way for this 48" water transmission main a ong a
strip of land about six miles long,) for the sum of $15,000, and.requests the Coun4il's
authorization to sign a letter accepting. said "right of entry" 'permit. Public Wor s •
Director John Mayo, explained that they have been negotiating with the railroad fo over
a year to acquire this right-of-way and favorable reaction by the railroad was giv °n
verbally, over the past months. He stated that' now the contractor is ready to star con-
struction and a document has been sent that has been signed by all approving depar ments
of the railroad, except the President of the railroad, indicating that they will g antt.a
• "right of entry" permit upon. receipt of the acceptance from the City Manage Mr.
Mayo-further stated: that although the Railroad did not previously charge for such ights-
ofway, they now have a new policy and do not give them away any more, but he beli °ves the
amount of $15,000 for about six miles of right-of-way is a token amount, as we hav- paid
as much as $3,000 and . $6,000 for only several hundred feet right-of-way. He st.:ted
that although it was not anticipated to have to pay anything for this right-of-way money
is set up in the budget to cover rights -of way, so we have ample money to pay for ■t.
City Attorney Andrews read portions of the contract, and explained that this is no an .
easement, in which we are vested with any right of ownership, but rather is a revo able
permit, which can be terminated, upon notice, and 60 days to correct any problems, if the
railroad deems it necessary. He further stated that it is different from a Title d•r
Easement, but is adquate for our purposes. After due discussion,.it was MOVED by •obin-
son, seconded by Keith that the City Manager' be authorized to sign a letter accepting the
"right of entry" permit on behalf of the City of Yakima, as has been discussed and
recommended at this meeting: carried, Brown, Keith, Kurbitz, Larson, McNeice and R.binson
voting aye by voice vote. Lambert absent.
Councilman Brown asking to be excused from the next meeting of May 12, 1969, and C•uncil-
man Keith asking to be excused from the meetings of May 12 and 19, 1969, it was MO ED by
Kurbitz, seconded by McNeice that they be excused from said meetings: carried,Kur•itz,
Larson, McNeice and Robinson voting aye by voice vote. Lambert absent.
There being no further business to come before the Council, it was MOVED by-Kurbit ,
seconded by Keith that we do now adjourn at the hour of 3:40 P.M.: carried, Brown, Keith,
Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Lambert absent.
