Lambert, McNeice and Robinson, City Manager McMicken and City-Attorney Andrews present on roll call. Councilman Keith absent on roll call. It was MOVED by Brown, seconded by McNeice that Councilman Keith be excused from this meeting: carried, Brown, Kurbitz, Lam - 111 Bert, Larson, McNeice and Robinson voting by voice vote. • The Invocation was given by Councilman Lambert. . . The minutes of the regular meeting of April 21', 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have,said minutes read publicly, Mayor -. Larson declared said minutes approved as recorded. • This being the time fixed for the continuation of the Hearing on the request for the proposed Vacation of a portion of South Sixth Avenue, and there being no additional infor- mation available at this time, it was MOVED by McNeice, seconded by Robinson that said Hearing be further continued to May 12, 1969: carried,. Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. This being the time fixed for the Hearing on the Vacation of a portion of N. 4th Street and certain alleys, filed by Yakima Mall Shopping Center, Inc., to extend the effective date, and there being an uncertainty as to the date for extension, Mayor Larson called for discussion on the matter. Mr. Fred Palmer and Mr. James McArdle, attornies repre- senting the Yakima Mall Shopping Center, Inc., were present. Mr. Palmer explained that • • at first they had thought they might have to ask for an extension of the Vacation date for as late as November 1, 1969, .but the effective date should be the same time that all the deeds are to be filed, and they have decided that September 1, 1969, is about as accurate.a date as they can make it now. He further explained that they had hoped that this Mall would be constructed in two phases, but for financing purposes, all the plans have to be ready at the same time. After due, discussion, it was MOVED by Brown, seconded • by Lambert that Ordinance No. 1125 providing for the Vacation of a portion of N. 4th Street and certain alleys, and delaying the effective.date to September 1, 1969, be passed as read: carried, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. • ORDINANCE NO. 1125, AN ORDINANCE providing for . the -vacation of•a portion of.North -4th Street and certain alleys in the:City of.Yakima,.Washington; ,amending.-Section .1 of Ordinance No. 1012 of the City of Yakima passed March 11, 1969, Section-1 of Ordinance- No. 1038 of the 'City of Yakima passed June 24,' 1968, - and Section 1-of Ordinance' No. 1074 of the of Yakima passed October 28, 1969; and declaring an emergency. • • This being the time fixed for the continuation of the Hearing on Petition No. 628, filed by the Yakima Mall Shopping Center, Inc., & Others, requesting an easement over and along ,a portion of East "A" Street, it was MOVED by Lambert, seconded by Brown that Ordinance III No. 1126 granting said easement and authorizing-the execution of an "Easement Grant ", be passed as read. Mr. Jim May was present and displayed a model of the proposed Mall. He explained the placement of the ramps and the sidewalk.on the south side-of - "A" Street which lies immediately adjacent to the ramps. There was some discussion as to the adequacy of the width of the proposed sidewalk. It was brought out that although most commercial sidewalks are at least ten feet in width, with diagonal parking there is an overhang from parked cars and the parking meters in the sidewalks, which still only allows about eight feet for pedestrians. Mayor Larson indicated concern that the side- walk might not be wide enough. Other Councilmen indicated that since there will not be entrances to the various stores from the sidewalk. adjacent to the ramps, they feel it is • better to leave any extra footage for the street rather than the sidewalk. After due. discussion, Mayor Larson called,for the roll call vote on the Motion to pass Ordinance • No. 1126.granting said'easement, and - it - carried,•Brown, Kurbitz, Lambert, Larson,:McNeice and Robinson voting aye roll Keith absent. ORDINANCE NO. 1126, AN ORDINANCE easement to-Yakima Mall Shopping Center, Inc., over and along a portion of East A in the City of Yakima; and and dir- ecting . the City Manager` and Cit to execute an "Easement Grant" for such' purpose. John R. Keith absent. 1.. . . • ORDINANCE NO. 1128, AN ORDINANCE fixing .the time of delinquency of installments of assessments levied for payment of the cost• improvement in Local Improvement District No. 967, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. . • • 561 . APRIL 28, 1969 It was MOVED by Lambert, seconded by McNeice that Ordinance No. 1129 relating to emergency overtime pay and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert,. Larson, McNeice and Robinson voting aye on roll call. Keith absent. City Manager McMicken explained that this amends the present Code to include all employees . and supervisors to receive overtime pay when they are called on to do emergency work out- side their regular duties, that is approved as emergency paid overtime by the City Manager. He further explained that this suggested change has been brought about because several departments have been doing emergency work at various times and not getting paid overtime for it, such as -when the City Airport Manager Eakin worked on the snow plow at the Air- port during the winter many hours overtime, and also when the City Clerk's office is re- quired to check Petitions for valid signatures to put a measure on the ballot and are re- quired to do this in two days, thus necessitating overtime hours. ORDINANCE NO. 1129, AN ORDINANCE relating to overtime pay and compensatory time for per- sonnel of the City of Yakima; and amending Subsection 2.40.100 (2) (d) of the City of Yakima Municipal Code. . Mr. L. M. Richey, 220 S. 62nd Avenue, Chairman, Support Your Local Police Committee, was present and read a letter written by him, which he filed with the Council and the City Clerk at this meeting, regarding a "recent attack on the reputation and integrity of our Auxiliary, Police force, and by extension our regular City Police as well." He indicated in his letter that his group feels that "unsupported charges have been leveled by members of the 'Mayor's Committee on Human Rights', which meet right here in this room at tax- payers' expense," and suggested that this group be asked to quit using the Mayor's name in their committee title, and that they, . or any "Action group ", not be allowed to meet in City Hall. Mayor Larson explained that in the past the Mayor's Committee on Human Rights has been a good group in dealing with, and helping with many problems, and as in many other groups, there may be some members who might not think and act as the majority, but this should not condemn the whole group. He further indicated that the charges made against the Auxiliary Police were not made in City Hall, but at a workshop meeting in the Chinook Hotel, and were not made by the Mayor's Committee on Human Rights, but by certain people who are members of this committee. Councilman Robinson commented on his confidence in the City Police work and the valuable work of the Auxiliary Police, stating that he regrets that this integrity has been challenged, and is glad to hear the supporting com- ments of Mr. Richey regarding the Police Force. He•further indicated that the public facilities of City Hall and the Yakima Court House are often available for meetings of many groups, including Political who may be considered in the category of Action groups. Mr. Wes Britt, being present, stated that in working with the Task Force on its recent report on the Police and Fire Department, they found that the Auxiliary Police do very important work, do not participate in arrests, and are spending their own time at it. No formal action was taken on this matter at this meeting. Mrs. Lois Hoff, being present, introduced Karl Heimdahl, an Exchange student from Sweden, who has been attending West Valley High School, and Mayor Larson present him with the Yakima City Flag and also gave him one to present to the Mayor of his home town when he returns to Sweden. Councilman Brown was excused from this_meeting at 4 :00 P.M. City Manager McMicken referred to his Report #54, Safety Measures for Summitview Avenue - 16th Avenue to 31st Avenue and the attached reports from the Director of Public Works and the Traffic Engineer, and recommended that parking be eliminated on the north side of Summitview Avenue between 16th Avenue and 31st•Avenue, that the street be restriped to • utilize the full curb -to -curb width for four traffic lanes, and that the Council set a date for a public hearing on this matter. Mrs. Connie Bloxom, being present, stated that she will speak to this matter at the Hearing. Mr. Wes Britt, property owner in this vicinity, spoke regarding this matter and suggested that the speed limit on Summitview Avenue should be better controlled and that he feels the parking should not be removed. Mr. Robert Dittmar, another property owner, stated that he is against removing the park- ing. Mrs. James Evert, 201 Park Avenue, being present, stated that since there has never been a sidewalk on the north side of Summitview Avenue, that there should be some type of safety on that side of the street. Public Works Director John Mayo reported that Mrs. John Ford had called asking about the process of putting a sidewalk on the north side of Summitview Avenue. After due discussion, it was MOVED by Robinson, seconded by McNeice that May 19, 1969, 8:00 P.M., be fixed as the time for a public hearing on this matter: carried, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Keith absent. City Manager McMicken stated that notices of this Hearing will be sent out to all property owners in this vicinity. City Manager McMicken referred to his Report #55, Petition for Parking on 16th Avenue- - Fruitvale to Lincoln, and the report of the Director of Public Works, both recommending that permanent on- street parking not be permitted on 16th Avenue, between Lincoln Avenue and Fruitvale Boulevard, but that as an alternative, temporary, off -peak hour parking could be accommodated for the next few years or until the traffic on this street warrants complete removal of parking. Mr. Edwin Ward and Mr. Bob Adamson, property owners in this vicinity, were present and spoke in favor of allowing parking on 16th Avenut between Lincoln Avenue and Fruitvale Boulevard. Council members indicated that although at times • the traffic . on this street is not too heavy and parking could be allowed, at certain peak hours all four lanes are needed for the traffic load. After due discussion, it was MOVED by Robinson, seconded by Lambert that the recommendation of the City Manager and Public Works Director to not allow permanent parking on 16th Avenue between Lincoln Avenue and Fruitvale Boulevard, but allow temporary, off -peak parking, be accepted, and that signs be put up stating that there is to be no parking on this street between the hours of 7:00 to 10:00 A.M. and 4 :00 to 7:00 P.M., and that an Ordinance be prepared to amend the I/ Traffic Code accordingly: carried, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Keith absent. Public Works Director Mayo reported that the signs that had been used on Lincoln Avenue and Tieton Drive in previous years in__sim_ilar situations, can be used on this street. City Manager McMicken reported that bids were received and considered by a Bid Board on April 24, 1969. on L.I.D. Nos. 970 & 971, Richey Road & Other Paving Improvements, as follows: Superior Asphalt & Concrete Co. $80,527.50 Yakima Asphalt Paving Co. 83,609.50 (cont.) L • • 562 . APRIL 28, 1969 • Public Works.Director John Mayo, reporting that Bids had•been received on this same pro- • ject on March 1969, and rejected 'because they. were too high, but with the.modifica- tions of some of the specifications, that both these bids were good bids, and recommend- ing that Superior Asphalt & Concrete Company, having submitted the low bid, be awarded the contract, it was MOVED by Robinson, seconded by McNeice that the. recommendation of • .'the City Engineer and Public Works Director, be accepted and that the bid be awarded to Superior Asphalt & Concrete Company in the amount of $80,527.50,• and that the City Manager be and.is hereby authorized to enter into a contract with said contractor upon the. filing _. • of the proper bond and insurance: carried, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken reporting that approval has been given - previously by the Council for.several members of the Police Department to attend the Northwest Fire and Arson Investigation Seminar, Portland, Oregon, May 12 - 16; 1969, and that Fire Chief Shockley . .is requesting authorization for. two firemen, Matt Young and Jack Cooper, to attend this same Seminar,: and recommending that said travel be allowed, it was MOVED by Lambert, seconded by Robinson that said travel be allowed with expenses paid: carried, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.
