HomeMy WebLinkAbout04/14/1969 Business Meeting • APRIL 14, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, McNeice and Robinson, Assistant City Manager Friedline and City Attorney Andrews present on roll call. Councilman Lambert and City Manager McMicken absent on roll call, having been excused at previous meetings. The Invocation was given by Councilman Kurbitz. • The minutes of the regular meeting of April 7, 1969, having been duly certified accurate by two Councilmen, and no one (present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on the request for the proposed Vacation of a portion of South Sixth Avenue, and there being no further information available on this matter at this' -time, it was MOVED by Keith, seconded by McNeice that this Hearing be furthe • continued to April 28, 1969:•carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent. • This being the time fixed for the Hearing on Resolution of Intention No. D- 1322, to improve property by constructing water mains on West Washington Avenue and St. John Streets, and there being no protests'in writing or otherwise, it was MOVED by Brown, seconded by Keith that Ordinance No. 1123 creating L.I.D. No. 975, St. Johns Street and Decoto Property Domes tic Water District, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent. . ORDINANCE NO. 1123, AN ORDINANCE providing for the improvement of certain property by con- structing the necessary mains, fire hydrants, valves and other appurtenances for the pur- pose of supplying water for domestic use and fire protection; establishing a Local Improve- ment District, providing for the method of payment thereof, and'creating a special fund. A Damage Claim having been filed with the City Clerk on April 11; 1969, by Ralph Morton, 24 Baldie Way, in amount of $250.00 for damages caused to his rental property at 5710 Richey Road by a sewer backup, it was MOVED by Brown, seconded by McNeice that said Damage Claim be referred to the City Manager and Staff'for study and recommendation:.carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. .Lambert absent. An Ordinance appropriating $17,750 to.the.1969 Water- - Sewer Fund., having been read - in its entirety at,the•previous meeting of April 7, 19,69,, and;beingo read by Title only at this meeting, it was MOVED, by Keith, seconded by Robinson that Ordinance No 1124•providing for - said'appropriation, be passed read: carried, Brown; Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. .Lambert absent. ORDINANCE NO. 1124, AN ORDINANCE appropriating the amount of :$17,750 from-unappropriated • money in the Water- Sewer to account 7 -890, Miscellaneous, of the Maintenance and Operation classification in the 1969 appropriation for 520, Water -Sewer Fund. • Mrs Adrienne Nyerg, being present; stated that she :is' complaining about the'way the animal control:program is run and that she.feels'that the Animal Control be'forced to pick up a dog and take it to the Humane Shelter, so that a person could decide if he II wanted to leave the dog there, or pay the impound fee t . it She also complained about the way warrants were served, indicating that she has had several citations. She asked about the_ ..procedure in_getting up a petition to put,the_ matter of repealing the.leash law the ballot: Councilman Robinson explained that even if it were possible for the Animal Control Officer to pick up all dogs, and a dog was not redeemed by'its owner, that owner.could still be cited for violation of the leash law and /or.for being.unlicensed..•He explainedthe_procedure of getting'a_petition started and suggested that ,she contact her attorney "in preparing such a petition: Council members indicating they would like to this matter further and get reports rega the enforcement of the leash ordinance, it was MOVED_by Robinson, seconded.by,Brown.that we obtain reports in connection with, the enforce- ment of the dog leash ordinance,., and that Mrs. Nyberg'will be informed when this matter is again brought before the Council: carried, Brown, Keith, Kurbitz,.Larson, McNeice and Robin son voting aye by voice vote. Assistant City Manager Friedline explaining that it is necessary for the Airport Improvement Fund - to make a temporary loan in order to pay for the purchase of property for future expan Sion of the Yakima'Municipal Airport and that'the Water -Sewer Fund currently contains unin- vested cash, it-was-MOVED by Keith, seconded by'Robinson that Resolution No. D -1335 author- izing a temporary loan of $30,000 the Water - Sewer• Fund to the Airport'Improvement Fund, be passed as read: carried, Brown,.Keith,.Kurbitz, Larson, McNeice and Robinson voting aye on roll call. .Lambert absent. RESOLUTION NO. D- 1335, = A RESOLUTION:autho,rizing'a temporary loan of $30,,000 from•520- Water- Sewer Fund to 912- Airport Improvement_ Fund and providing for repayment. Assistant City Manager Friedline explaining,that the balance of the property needed for right -of way for the relocation of'Washington Avenue and for future expansion of the Yakima Municipal Airport, has been offered for sale.to.the.City.for a purchase price and recommending authorization to make said purchase, it was MOVED by Brown, seconded by Keith that Resolution No. D -1336 authorizing the purchase of said property, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent. .. . . RESOLUTION NO. D -1336, A RESOLUTION authorizing the purchase by the City of Yakima of real li . property for right-of-way for Washington Avenue and for future expansion of the Yakima Municipal. Airport. . Assistant City Manager Friedline stated that bids were received and considered by a Bid Board on March 21, 1969, on Industrial Roadway to serve New Longview Fibre Company Plant, as follows: Superior Asphalt & Concrete Co. - $20,400.00 • - Yakima Cement & Asphalt Paving Co. - . 20,957.50 Mr. Friedline explained that these bids were 40% higher than the Engineer's estimate and that Public Works Director John Mayo has negotiated with contractors and Superior Asphalt & Concrete Company has agreed to do the work for $15,145.00, the unit prices being specified in a letter, dated April 10, 1969,.to the City of Yakima. He recommended that the Council reject the original bids and authorize the hiring of work and purchase of materials from Superior Asphalt & Concrete Company, without calling for further bids. After due discussion, it was MOVED by Robinson, seconded by McNeice that the recommendation of Public Works Dir- ector be accepted and that the bids received and considered on March 21, 1969,.be rejected: AA 557 APRIL 14, 1969 carried, Brown Keith, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. It was then .MOVED by Robinson, seconded by Keith that Resolution No. D -1337 authorizing the City of Yakima to enter into a negotiable contract for the construction of the roadway to serve the New Longview Fibre Company Plant without calling.for further bids, be passed as read, and that the City Manager be and is hereby authorized to enter into a contract with Superior Asphalt & Concrete Company in the amount of $15,145.00, upon the filing of the proper bond and insurance: carried,' Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent.. • RESOLUTION NO. D -1337, A RESOLUTION authorizing the City of Yakima to hire work and labor and purchase materials for the construction of an "Industrial Roadway to Serve New Longview Fibre Company Plant" without calling for further bids. • Assistant City Manager Friedline explained that, in connection with the construction of im- provements to the water treatment plant and transmission system and the agreement with Cornell, Howland, Hayes & Merryfield for engineering services regarding a pipe line design report, it is now necessary that the original agreement be amended to•include provisions for the final design of the line. After due discussion, it was MOVED by McNeice, seconded by Keith that Resolution D -1338 authorizing the execution of an addendum to agreement for engineering services by Cornell, Howland, Hayes & Merryfield, on water trans- mission main project,.be passed as read: carried, Brown, Keith, Kurbitz,.Larson, McNeice and Robinson voting aye on roll call. Lambert absent. • RESOLUTION NO. -D-1338, A RESOLUTION authorizing the'City'Manager and City Clerk of the City of Yakima to execute an addendum to an agreement between the City of Yakima and Cornell, Howland, Hayes & Merryfield for engineering services for water system improvements. It was MOVED by Brown, seconded Robinson that a Resolution authorizing the execution of a contract with American District Telegraph Company to furnish Burglar Alarm service, be passed as read. Assistant City Manager Friedline reported that the construction'of the . water treatment plant has reached such . a. stage of completion that it must be protected . • from theft and vandalism and that Public Utilities Director Frank Stein recommends that . authorization be given to execute a contract with American District Telegraph Company of Washington, to furnish Burglar alarm service. He further reported that this is the only company that provides this type of service. Council members indicating that they would . like to study this matter further, it was MOVED by Robinson, seconded by Keith that this matter be continued for one week for further study: carried, Keith, Kurbitz,'Larson, McNeice and Robinson voting aye by voice vote. Lambert absent. Assistant City Manager Friedline explaining that the Mayor and City Manager had signed a letter of agreement to assume obligation for local operation of flood control works with the Corps of Engineers, and since that time notification has been received that the letter is not sufficient, but that a Resolution authorizing said action is needed, it was MOVED by Keith, seconded by Robinson. that Resolution No. D -1339 authorizing the execution of.a Letter of Agreement with the Corps of.Engineers for.the construction of'a flood control. I� project,.be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent. RESOLUTION NO. D -1339, A RESOLUTION authorizing the Mayor.and City Manager to execute a Letter,of Agreement with the United States of.America for the construction of a flood con- trol project. • Assistant City Manager Friedline reported that the term of Don Conners on the Board of Adjustment,.expired on Ma rch 15,,1969, and that he has served two six -year terms and is willing to serve another six -year term, and recommends that he .be re- appointed. After due discussion, it was MOVED by Robinson, seconded by Keith that the Council affirm the re- appointment of Don Conners 'to the Board of Adjustment.for a six -year term•to.expire on March 15, 1975: carried,. Brown, Keith,.Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Lambert absent. • Assistant City Manager Friedline requesting that authorization be given by the Council for City Manager McMicken to travel to -San Jose, California, .to attend I.B.M. Training School, from April 13,- 17,.1969, with expenses.paid,it was MOVED by Keith, seconded by McNeice that said travel be allowed with expenses paid: carried, Brown, Keith, Kurbitz,.Larson, McNeice and Robinson voting aye by -voice vote. Lambert absent. Councilman Kurbitz asking to be excused from the next meeting on April 21, 1969, it was MOVED by Robinson, seconded by Keith that Councilman Kurbitz be excused from said meeting:. carried, Brown, Keith, Larson, McNeice and Robinson voting aye by voice vote. Lambert absent. There being no further business to come before the Council, it.was MOVED by Kurbitz, seconded by Keith that we do now adjourn at the hour of 4:30 P.M.: carried,.
