The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson, City Manager. McMicken and City Attorney Andrews present on roll call.. ' G The Invocation was given by City Manager McMicken. • • The minutes of•the regular meeting of March 31, 1969, having been duly certified accurate . by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. • • This being the time fixed for the Hearing on Phase II,.Preliminary Study of "B" Street and Lincoln Avenue Bridge Overcrossings, City Manager McMicken explained that we have a report on this project from.the Consulting Engineers, for the review of the City Council, and that the Staff recommends approval of this report. Public Works Director John Mayo • referred to a diagram of the proposed overcrossings and explained'the plans for the con- struction, should the plans be approved by the Council. He stated that the final plans could be done about November of this year and the bid awarded in.January of 1970, with both bridges being done at the same time, about November of 1970.' Mr. Mayo reported that since the first Hearing, there have been negotiations with adjoining property owners and with the Union Pacific Railroad, as it will be•necessary to depress the street, and the one solution that would seem the best is to completely close off the spur lines between • 2nd and 3rd Avenues, which will allow us to keep 2nd Avenue open. •He fur.ther stated that the City staff and the Consultants are recommending that the general plan as outlined in the report be adopted, with the exception of one change as recommended by the Planning . Commission, which is to change two staircases one -half block to the east of the present plans. birector of Planning and Community Development, Bruce Finke, stated that the Planning Commission considered this matter at a special meeting on March 18, 1969, at • which time they recommended that the Council approve the report of the Consultants with the. exception of the pedestrian stairway, as reported by John Mayo. Several•Attorneys, property owners and other interested people-were present to speak to this matter. Mr. Fred Palmer, Attorney, spoke in connection with the spur tracks on the Northern Pacific Railroad and asked if that will be completely eliminated.. Public Works. Director John Mayo stated that'there are two tracks, which will be removed and replaced "by one service • track. E. L. Clark, owner of the site of the Avalon Service Station managed by Myrlin Ackerman, protested the overcrossings, stating that he would favor undercrossings. He further stated that at the present time there is some problem with access to some of the pumps and if the overcrossing goes in,. it will be almost impossible for cars to get out,, once they have driven in to the pumps nearest.the proposed overcrossing. .Mr. Clark asked if anything has been set aside for payment of damages to property such as this. Dr. Herb • Lynch, property owner of the parking lot on the northwest corner of Front and "B" Streets, protested the proposed overcrossings and stated that he would be in favor of undercrossings. Mr. Myrlin Ackerman, operator of the Avalon Service Station, protested the overcrossirig because of the 'access problem at this Station, and indicated he is in favor of an under - • crossing. Mr.•Fred Velikanje, Attorney representing several property owners, discussed several matters and asked questions regarding access to Helliesen Lumber Company property and the L.P. Michelsen Company Warehouse, and how traffic will be handled during.construc- -tion.• He filed two letters. regarding these matters, with City Manager McMicken. Mr.. Frank Lovering, property owner, asked questions regarding traffic patterns on various streets to get on the overcrossings. Mr.•Herb Frank, representing Yakima Fruit and. Cold Storage Company, spoke regarding the proposed underpass on Yakima Avenue, asking if•First Avenue will be closed and where the traffic will be at grade. Public Works Director John Mayo stated that there was never any indication that there was going to be a closure at First Avenue. He further stated that the underpass under Yakima Avenue will.be backup to grade and a full open intersection will exist at First Avenue... Several Attorneys, includ- ing.Mr. Alan McDonald, asked questions regarding the possibility of damages to abutting owners and if any money has been allotted to cover payment 'of damages. City Attorney Fred Andrews spoke regarding the - matter of damages, stating that the Staff .has discussed this matter, but at present our position is and has been that there will be no damages. He further indicated that we are aware that many people feel there will be damages,.and this matter will be further studied. Councilman Lambert indicated that all Council members have done a tremendous amount of study on. this project and will consider all questions ask- ed at this meeting before making any decisions, as they are interested in doing what is . best for all the people. City Manager McMicken discussed the matter of finances for this project, stating that there are public funds being used to the extent of about $1,570,000 from Urban Arterial funds raised from.gasoline taxes, and an estimated $350,000 will be coming from the.railroads, who have a stake in.the improvement. He that there • are some : other funds which will come into the.project. - Mr.,McMicken stated that the next step regarding this' will.be for a Motion :to be: -made by the Council_to. approve this document, with amendments as suggested regarding the pedestrian ways, or to defer it•for some additional information, but that he feels that holding. up the next step will not make • any difference as many of the questions brought out at this Hearing can be better answered as the project proceeds. After due discussion, it was MOVED by Robinson, seconded by Lambert, that the Preliminary Study of the Consulting Engineers on Phase II, of the "B" Street and Lincoln Avenue Bridge Overcrossings, with modified access stairways as'.recom- mended by the Planning.Commission, be approved: carried, Brown, Keith, Kurbitz, Lambert, .Larson, McNeice and Robinson voting aye by voice vote. An Ordinance appropriating $26,853 for the Metropolitan Park District,.having been read in its entirety at the regular meeting on March 31, 1969, and being read by Title only at this meeting, it was MOVED by Brown, seconded.by Keith that Ordinance No. 1120 providing for said appropriation, be passed as read: carried, Brown, Keith,..Ku- rbitz,- Lambert, Larson, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1120, AN ORDINANCE appropriating the amount of $26,853 from unappropriated money in 650 - Metropolitan Park Fund, to Account 7850, Agency Funds, of the Maintenance and • and Operation classification of the 1969 appropriation for 650 - Metropolitan Park Fund. • An Ordinance appropriating $17,750 to the 1969 Water -Sewer Fund, having been read in its entirety at this meeting, was laid on the table for one week, or until April 14, 1969. • It was MOVED by Brown, seconded by McNeice that Ordinance No. 1121 revocable license to Hop Extract Corporation of America, to'maintain a pipe bridge over north Second Avenue, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and ,Robinson voting aye on roll call. City Manager,McMicken referred to the plan of the . structure, showing that. it is an important and necessary connection between the Plant on 553 . • • APRIL 7, 1969 the one side of Second Avenue to the new Plant on the other side. He further explained that in accordance with the recommendation of the City Attorney, that the Ordinance pro- vides that a revocable license be granted to the owner, which would make the owner complet- ly subject to future City judgment in terms of its use and maintenance. After due discussion, it was MOVED by Lambert, seconded by Keith that Resolution No. D -1333 authorizing the City of Yakima to submit application for, 701 "Federal Planning Grant ", be passed as read: carried, Brown,. City Manager McMicken reported that bids were received and considered by a Bid Board on April 4, 1969, on.Washington Avenue Paving, 28th Avenue to Sorenson Road, as follows: . • . Superior Asphalt $ 92,653.50 . Yakima Asphalt • 93,925.00 Public Works Director John Mayo explained that at the time the bids were considered, Yakima Asphalt seemed to have submitted the low bid, but when the bookkeeping calculations II were checked, an error was found in the calculations of Superior Asphalt,,which when corrected, made their bid the lowest.. He further explained that both parties have been notified and recommended that Superior Asphalt, being the low bidder, .be awarded the con- tract. After due discussion, it was MOVED by Robinson, seconded by Keith'that the recommendation of the City Engineer and the Public Works Director, be accepted and that the bid awarded Superior Asphalt in•the amount of $92,653.50, and that the City Manager be and is hereby authorized to enter into a contract with said contractor upon.the filing of the proper bond and insurance: carried, Brown, Keith, Kurbitz, - Lambert,.Larson, McNeice and Robinson voting aye by voice vote. . City Manager McMicken referred to the condemnation proceedings in which the City is seed- ing title to real property as right -of way.for Washington as it is to.be relocated . in the vicinity of the Yakima Municipal Airport,, and indicated that K..,E. and Agnes M. George, who are defendants in said condemnation proceedings,, have offered convey said property, consisting of_two parcels,to the City for the purchase price,of City Attorney Andrews - indicating that this offer is reasonable and recommending that it be accepted, it was MOVED by Robinson, seconded by Brown that Resolution No. D -1334 author - izingthe acquisition of said property, passed as read: carried, Brown, Keith,.Kurbitz, Lambert,.Larson, McNeice and Robinson voting aye on roll call. . City Manager McMicken stating that Public Utilities Director Frank Stein has requested out -of -State travel for himself, Glen Perkins, Water Superintendent, and Peggy Rabung, Water.Engineer, to attend the American Water Works Pacific Northwest Section Convention in Victoria, B. C., Canada, on April 29 to May 2, 1969, at an approximate cost of $125 for Mr. Stein, who will using a private car, and $100 for Mrs. Rabung and $110 for Mr. Perkins, who will riding.in.a City car, and recommending authorization of said travel, it was MOVED by Kurbitz, seconded by' Keith that said travel be allowed with expenses paid: carried, Brown,.Keith, Kurbitz,.Lambert, Larson, McNeice and Robinson voting aye by voice vote. - .. . • .
