The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call, having been excused at the previous meeting. The Invocation was given by Councilman Brown. . The minutes of the regular meeting of March 10, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed forthe Hearing on the proposed Vacation of a portion of South Sixth Avenue adjacent to Davis High School, and it having been requested by the Planning Commission that said Hearing be continued to March 24, 1969, it was MOVED by McNeice, seconded by Robinson, that said Hearing be continued for one week or until March 24, 1969: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. This being the time fixed for the.Hearing on the Assessment Roll for L.I.D. No. 967, Valley View Estates and Others Paving District, and there being no protests in writing or otherwise, it was MOVED by Brown, seconded by Robinson, that Ordinance 1114 con- firming said assessment roll and every part thereof be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. ORDINANCE NO. 1114, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 967 as created and established by Ordinance No. 959 of the Ordinances of the City of Yakima. • A Damage Claim having been filed with the City Clerk on March 11, 1969, by John G. Phillips, 324 Wyman Drive, in the amount of $100.00 for damages caused to his lawn by a City Garbage truck, it was MOVED by McNeice, seconded by Robinson', that said Damage Claim be referred to the City Manager and Staff for study and. recommendation: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. Mr. Charles Lyon, Attorney, appearing on behalf of Apple Valley Broadcasting Company re- garding his requestcf the previous week on March 10, 1969 that the Cable T.V. election to be held on April 29, 1969 be postponed for sixty days, stated that in studying the mat- ter further and talking to the City Attorney and others, he can see no reason why the Cable T.V. Election cannot be postponed as requested. He further indicated that he feels the Council should postpone the election to allow more time for the FCC to act on matters regarding hearings, because if the FCC does not give the cable companies permits then the holding of the election will be useless and expensive. Mr. Lyon again requested that the Council postpone the Cable TV Election for sixty days, stating that he believes post- poning it will not invalidate the election. City Attorney Andrews indicated that he agrees with Mr. Lyon, in that if the election•is postponed it wouldn't necessarily be invalidated, but if it should be postponed he is not certain what would happen. He indi- cated that the Courts have a tendency to protect the people and their right to call for an election, should the matter come to Court. Mr. Andrews further stated that up to now he has talked only about the City Charter provisions and the requirements which have brought about an election on the Cable T.V. matter. He indicated that he has seen noth- ing to interfere with the coming election and feels that until and . unless the situation under FCC has proceeded to the hearings and if, after the hearings,the Cable TV companies should not get permits, then it would be a useless act to hold the election, but until that happens we have to speculate as to what the outcomeof the hearings might be. Mr. Andrews stated that up to this point there has been nothing that has happened that makes him believe that the election :should be postponed. Council members indicated that they feel the people have expressed their interest by signing petitions and want a chancetn vote on matter of Cable TV, and can see no reason for postponing the election. There being no motion by the Council to postpone the Cable TV Election, no further action was necessary on this matter. . City Manager McMicken reported on the matter of Bids for L.I.D. No. 970,• Alley Paving, Loma Vista &Highland Addition, and L.I.D. No. 971, Richey Road & Others Paving District, . stating that bids were received and considered by a Bid Board on March 6, 1969 on L.I.D. Nos. 970 and 971, Richey Road and Other Paving. Improvements Project, as follows: Superior Asphalt & Concrete Co. $89,614.00 Yakima Cement & Asphalt Paving Co. 95,096.00 • Public Works Director, John Mayo, reported that the low bidder was over 16% above the engineer's estimate and if the bid was awarded based on this bid, the final assessments for all the properties involved in the local improvement district would be considerably above their preliminary estimates. He further stated that in analyzing the bids, the items in which the greatest discrepancy of costs occur are the ones which have to do with excavation and backfill,.both in the street section and in trenches for pipe placement. Mr. Mayo indicated that the contractors may have misunderstood the specifications called for on these items, but in any case feet that the bid is so high for that particular item of work that it seems unreasonable and recommends that both bids be rejected and that the City Engineer be instructed to re- advertise the project under a new specifica- tion, which modifies the excavation and embankment items to a format more in keeping what our local contractors have been used to performing forthe City. After due discussion, it was MOVED by Robinson, seconded by McNeice, that the recommendation of Public Works Director John Mayo be accepted and that both bids on this project be rejected, and that the City Engineer be instructed to re-advertise for bids carried, Brown, Kurbits, Lam- bert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. City Manager McMicken referred to the matter of awarding the bid on the 48 -inch water transmission .pipeline, stating that seven .bids .were. received and considered by- a Board in the City Hall, 3:00 P.M., Thursday, March 13, 1969, as follows: Riverside Construction, Inc., & Lord Bros. Contractors, Inc. - Milwaukee, Ore $ 1,247.069.04 Salem Sand Gravel Co., Salem, Ore. 1,304,349.41 544 • MARCH ,17, 1969 • Frank Coluccio Const. Co., Inc., Seattle, Wash. $1,413.879.78 E. M.. Miller, Beaverton, Oregon 1,611,606.32 Studnek Construction Co., Inc., Anchorage, Alaska 1,746.158.43 Public Works Director, John Mayo, stated that these were all good bids and that the low bid by Riverside. Construction, Inc., &Lord Bros. Contractors,, Inc., :a joint venture,• of Milwaukee, Oregon, is within the budgeted amount for this project, and recommended • . that their proposal be accepted and the contract be awarded to them. Mr. Don Gray, of Gray & Osborne, Consulting Engineers on this project, being present, reported that the low bidder is a highly qualified contractor for this type of work. He further explained • that approval of 'the bid award must be obtained from the Department of Housing and Urban Development and recommended that the proposal-of Riverside Construction, Inc., & Lord Bros. Contractors, Inc., a joint venture, be accepted and the contract awarded to them, subject to the approval of the Department of Housing and.Urban Development. Mr. Gray further reported that the contractor's material supplier, American Pipe & Construction Company, estimates delivery of pipe will start approximately seven weeks after the order is placed, thus installation could start within two months, and that completion time has • been set ins the contract as 210 calendar days after notice to proceed is issued. After • . due discussion, it was MOVED by Robinson, seconded by McNeice, that the recommendations of Public Works Director, John Mayo, and Consulting Engineers, Gray & Osborne, be accepted, and that the bid be awarded to Riverside Construction, Inc. &-Lord Bros. Contractors, Inc. a point venture, in the amount of $1,247,069.04, and that the City Manager or Mayor (whichever is required) be authorized to enter into a contract with said contractor upon' the filing of the proper bond and insurance, and subject to the approval of the Depart- ment of Housing and Urban Development: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice.vote. Keith absent. City Manager McMicken referred to a Resolution from the Board of County Commissioners., extending the terms of Mrs. William L. Gannon, Ned Giffen, and.Mrs. William R. Baker, members of the Board of Trustees of the Yakima Regional Library, from five to seven years to bring their terms into line with RCW 27.12.190, which provides that members of the Board of Trustees of Regional Library Districts comprised of seven shall • serve seven year terms. City Manager McMicken referred to a Resolution from the Board of County Commissioners appointing Mr. Walt Lewis as a member of the Board of Trustees of the Yakima Valley Re- gional Library District for a • term of seven years, beginning January 1, 1969 and expiring December 31, 1975, and recommends that the City Council ratify this. After due discussion it was MOVED by Lambert, seconded by Robinson, that the appointment of Mr. Walt Lewis as a :member of the Board of Trustees of the Yakima Valley Regional Library District, be ap- proved by the City Council: carried,. Brown, Kurbitz, Lambert, Larson, McNeice and Robin- son voting aye by voice vote. Keith absent. . City Manager McMicken referred to the proposal by ABAM Engineers, Inc. , for engineering services on the Yakima Avenue proposed Undercrossing, which stated that if ABAM were to do the engineering services on the proposed Undercrossing along with their engineering services on the Lincoln Ave. & "B" Street Overcrossings, the City would be saved $6,000 in engineering fees, as compared with having the engineering services done separately on these two projects. After due discussion, it was MOVED by Brown, seconded by McNeice., • that a contract be drawn up with ABAM Engineers for the engineering services on the Yakima Avenue proposed Undercrossing: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. • • City Manager McMicken referred to the matter of the request by the Consumer Food Program - Supervisor for the•City to sell food stamps. . He stated that approximately 10,000 are using the program and about 26,000.could be using it, but there is a need for.more sales outlets. Mr.- McMicken indicated that there would be quite a bit of work involved by the City Treasurer's Department.if.the City were to do this. He further stated that the ' County Treasurer has recently arranged to sell food stamps and because of the close prox- :imity of the County building just across the street, . feels it would not be necessary for the City to take on additional transact in the City Treasurer's office at this time. After due discussion, it was MOVED by Robinson, seconded by Lambert, that the City not make arrangements for the food stamp program at this time: carried, Brown, Kurbitz, Lam- bert, Larson, McNeice and Robinson voting aye by voice vote. Council • members indicaisl that the Council is not in any way turning the program down, but in fact,' some of the members are helping to set up various'locations for the sale' of food stamps. City Manager McMicken referred to the request for outside water and sewer service for the •Ted L. Davis ° property at 1604 South 12th Avenue, where a large apartment complex is being built. .He stated that it is not practical at this time to,annex this property, but that • the applicant is willing to sign an outside hookup agreement and annex`to the City in the future. After due discussion, it was MOVED by Robinson, seeded by. Brown, that the re- quest-for outside water and sewer service be allowed, subject to the signing of the outside hookup agreement: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. . City Manager McMicken referred to the Memo from the City Attorney's office. recommending payment of a Damage Claim to Jim C. Burton, '1310 Rock Avenue, in the amount of $20.74 for .damages resulting from a blockage in the City sewer line. It was MOVED by Lambert, seconded by Robinson, that Resolution No. D -1321 authorizing payment of said Claim for Damages, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robin- son voting aye on roll call. Burton. • • 545 MARCH 17, 1969 City Manager McMicken reported that Chris Baldoz, a student, has requested permission for students to hold a parade Saturday A.M., March 22, 1969, for the purpose of calling spe- cial attention to the School Election which is being held on March 25, 1969. Mr. McMicken stated that the Police Department had referred to the Ordinance which limits parades on Saturday up to 11:00 A.M. and indicated that this one •will ba.n at-10:00 A.M. After due discussion, it was MOVED by Robinson, seconded by Lambert, that a parade permit be given for the student parade to be held this Saturday, March 22, 1969 at 10:00 A.M.: carried, • Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent.
