HomeMy WebLinkAbout03/10/1969 Business Meeting 539 MARCH 10, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, McNeice and Robinson, City Manager McMicken and City Attorney Andrews _present on.roll call. Councilmen Keith and Lambert absent on roll call. It was MOVED by Robinson, seconded by Brown that Councilmen Keith and Lambert be excused from this meetingycarried, Brown, Kur- bitz, Larson, McNeice and Robinson voting aye by voice vote. and that Councilman Keith be excused from the next meeting on March 17,1969: The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of March 3, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Parents of school children being present, City Manager McMicken requested that the matter regarding parking meters on the north side of "B" Street adjacent to St. Joseph's School, be considered ahead of the irrigation maintenance public hearing. He reported that in accordance with action taken by the Council on February 24, 1969, the matter has been studied by the Staff. Mr. McMicken stated that the Staff recommends that in the spirit of safety and the fact that the money from these eight meters does not mean that much to the City, that the parking should be taken away from the north side of "B" Street, and the meters be removed. After due discussion, it was MOVED by Robinson, seconded by McNeice that the Council concur with the recommendation of the City Manager and Staff, and that the parking be taken away from the north side of "B" Street and the parking meters be re- moved: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert absent. . This being the time fixed for the Hearing on the confirmation of the Irrigation Maintenance Assessment Roll for the year 1969, it was MOVED by Brown, seconded by McNeice that Ordi- nance No. 1110 confirming said assessment roll for the calendar year 1969, as adjusted by the City Council at its hearing on this date, . be passed as;read. Public Utilities Direc- tor Frank Stein was present to answer any questions from those present regarding their irrigation maintenance assessment. He explained that the 1969 assessment rates were established at the time of the preparation of the 1969 Budget on the approach that the proposed expenditures and income should balance out without resorting to the use of accumu- lated reserves. Mr. Stein took each irrigation system in order, stating if there was an increase or decrease from the 1968 rate and explaining the reason for any great change, . and asked for questions from those present regarding each system as it was discussed. After answering questions regarding assessment rates from those present, Mr. Stein explained that among the protests received regarding the annual maintenance assessments, which he is answering by letter, were requests for withdrawal from the maintenance rolls of parcels that are now business property and have no need now, or for a number of years past, for water for irrigation purposes, and requested that these parcels be taken off the rolls. After due discussion, it was MOVED by Robinson, seconded by McNeice that these parcels as referred to by Mr. Stein, be taken off the,rolls as requested: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert absent. Mayor Larson then called for the roll call vote on the Motion to pass Ordinance No. 1110 con- firming the Irrigation Maintenance Assessment Roll for the calendar year 1969 as adjusted by the Council at this hearing and it carried, Brown, Kurbitz, Larson, McNeice and Robin- son voting aye on roll call. Keith and Lambert absent. • ORDINANCE NO. 1110, AN ORDINANCE confirming the irrigation maintenance assessment roll of the City of Yakima for the calendar year 1969, and levying irrigation maintenance assess- ments according to such roll; and declaring an emergency. A Damage Claim, having been filed with the City Clerk on March 4, 1969, by Bertha M. Brown, 3472 S. 2nd Street, Shelton, Washington, in the amount of $50,000 for damages caused when the claimant fell at the Yakima Municipal Airport, it was MOVED by Brown, seconded_ by Robinson that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert absent. Petition No. 630, having been filed with the City Clerk on March 3, 1969, by Mr. Sterling Cliett & Others, requesting improvement of property by the construction of curbs, gutters and surfacing of W. Prasch Avenue, from 16th Avenue to 20th Avenue, it was MOVED by Robinson, seconded by McNeice that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert absent. In accordance with action taken by the Council at last regular meeting of March 3, 1969, and action on an Ordinance relating to the Traffic Code, having been continued to this date, the matter was brought on for discussion. There being no further information needed regarding this matter and the Motion having been made by Lambert, and seconded by Keith at the regular meeting of March 3, 1969, that Ordinance No. 1111 relating to the Traffic Code, be passed as read, Mayor Larson called for the roll call vote on this matter, and it carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. • Keith and Lambert absent. ORDINANCE NO. 1111, AN ORDINANCE relating to traffic control; regulating motor vehicles, traffic, travel and transportation and their incidents upon the streets, sidewalks, road- ways, highways, public highways and other ways open to the public; prescribing powers and duties of officers and others in relation thereto; defining offenses; adopting by refer- ence certain sections of Title 46, Motor Vehicles, of the Revised Code of the State of Washington; providing penalties for violations thereof; amending Sections 9.52.030, 9.56.005, 9.56.010 and 9.60.010, and repealing Chapters 9.04, 9.08, 9.12, 9.16, 9.20, 9.24, 9.28, 9.32, 9.36, 9.40, 9.48, 9.68, 9.72 and 9.76 and Sections 9.34.040 and 9.52.060, all of the City of Yakima Municipal Code. It was MOVED by Robinson, seconded by McNeice that Ordinance No. 1112 repealing _'certain Code sections relating to speed of bicycles and riding bicycles on sidewalks, be passed as read: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Keith • and Lambert absent. City Attorney Andrews explained that this section is being repealed because it is covered precisely by the Traffic Code. ORDINANCE NO. 1112, AN ORDINANCE repealing Section 6.04.275 relating to speed of bicycles, and Section 6.04.035 relating to riding of bicycles on sidewalks, all of the City of Yakima Municipal Code. It was MOVED by Brown, seconded by Robinson, that Ordinance No. .113 regarding the use of vehicles without permission of the owner and amending*the,.Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Larson, McNeice and ,Robinson voting aye on • roll call. City Attorney Andrews explained that would move this from the Traffic Code __ to the Penal Code, where it belongs. ORDINANCE NO. 1113, AN ORDINANCE relating to unpermitted taking or meddling of vehicles, amending and'renumbering Section 9.72._090 of the City of Yakima Municipal Code. Mr. Charles Lyon, Attorney, appearing on behalf of Apple Valley Broadcasting Company, stated that they. have a permit for construction of a third channel of free T.V. in Yakima. He further stated that they would like to request that the Cable T.V. election be postponed • . for 60 days, as the two companies involved in this:election have not•had.F..C..C. hearings as is required before they can operate a cable T.V. Discussion brought out the' fact that the Petitions requesting that these Cable T.V. propositions. be submitted to the voters have been checked as having a valid number of signatures to request the Auditor to hold • . an election, which has been done, and further investigation will have to be made to find out if the election can be postponed. After due discussion, it was MOVED . by Robinson, . seconded by Brown, that the matter be referred to the City Manager and Staff for further study: carried, Brown, Kurbitz,,Larson, McNeice and Robinson voting aye by .voice vote. Keith and Lambert absent. • • A report having been.received from the Planning Commission on further study of its Reso- lution of Intention, recommending a change in the Yakima Municipal Code under Title 12 - • Zoning, it was MOVED by Robinson, seconded by Brown, that March 2.4, 1969, be set as the • time of hearing on said matter by the Council: carried, Brown,.Kurbitz,.Larson, McNeice and Robinson voting aye by voice vote. A report having been received from the Planning Commission recommending continuation of the Hearing on the Proposed 6th Avenue Street Vacation, it was MOVED by McNeice, seconded by Robinson, that said Hearing be continued from March 17, 1969 to the following meeting or March 14, 1969: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by ' voice vote. .Keith and Lambert absent.
