HomeMy WebLinkAbout03/03/1969 Business Meeting ft 537 MARCH 3, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Keith, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Brown and Kurbitz absent on roll call, Councilman Brown having been excused at a previous meeting. It was MOVED by Robinson; seconded by McNeice that Councilman Kurbitz be excused from this meeting: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. The minutes of the regular meeting of February 24, 1969, having been duly certified accur- ate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. A Damage Claim, having been filed with the City Clerk on February 24, 1969, by Jim C. Burton, 1310 Rock Avenue, for damages in the amount of $20.74, caused by water backing up into his basement, it was MOVED by McNeice, seconded by Keith that said damage claim be referred to the City Manager and staff for study and recommendation: carried, Keith, Lam- bert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Kurbitz absent. Petition No. 629, having been filed with the City Clerk on February 24, 1969, by Mr-; Mrs. Edwin Ward & Others, requesting a parking lane and sidewalk on the North side of N. 16th Avenue, from Lincoln Avenue to Fruitvale Boulevard, it was MOVED by Robinson, seconded by Lambert that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Kurbitz absent. Mr. Ward, being present, was informed that after the City Manager and Staff has considered this matter and when it comes back to the Council for a hearing, Mr. Ward will be informed .so that he and any others interested in the requested improvement, may attend and speak to the matter. . The City Clerk having given notice that a Petition as filed by Kenneth Burford, Manager of Yakima Cable TV, Inc., has been certified that a sufficient number of qualified electors have signed said Petition, which requests that a proposed cable TV franchise ordinance be submitted to a vote of the people, discussion 'brought out the fact that this Petition will be acted upon on this date with a Resolution calling for a Special Election. It was MOVED by McNeice, seconded by Keith that Resolution No. D -1317 requesting the Audi - tor to hold a special election to submit to the electors a proposition as to whether a television distribution system franchise shall be granted to West Valley Cablevision, Inc., be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Kurbitz. absent. . RESOLUTION NO. D -1317, A RESOLUTION providing for the submission to the electors of the City of Yakima, Washington, at a special election, of a proposition as to whether or not a television distribution system franchise shall be granted to West Valley Cablevision, Inc.; and requesting the Auditor of Yakima County, Washington, to hold a special election. It was MOVED by Lambert, seconded by McNeice that Resolution No. D -1318 requesting the Auditor to hold a special election to submit to the electors a proposition as to whether a television distribution system franchise shall be granted to Yakima Cable TV, Inc., be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Kurbitz absent. RESOLUTION NO. n -1318, A RESOLUTION providing for the submission to the electors of the City of Yakima, Washington, at a special election, of a proposition as to whether or not a television distribution system franchise shall be granted to Yakima Cable TV, Inc.; and requesting the Auditor of Yakima County, Washington, to hold a special election. An Ordinance appropriating $5,000.00 within the 1969 appropriation for Street Fund, having been read in its entirety at the regular meeting on February 24, 1969, and being read by Title only at this meeting, it was MOVED by Lambert, seconded by Keith, that Ordinance No. 1107 providing for said appropriation be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Kurbitz absent. ORDINANCE NO. 1107, AN ORDINANCE appropriating the amount of $5,000 from unappropriated money in 310 - Street Fund, to Account 320, Rentals, in the 1969 appropriation for 310 - Street Fund. An Ordinance appropriating $11,145 within the 1969 appropriation for City Garage Fund, having been read in its entirety at the regular meeting on February 24, 1969, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by Lambert, that Ordinance No. 1108 providing for said appropriation be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Kurbitz absent. ORDINANCE NO. 1108, AN ORDINANCE appropriating the amount of $11,145 ..from unappropriated money in 340 -City Garage Fund to various accounts within said fund. City Manager McMicken explained that in accordance with action taken by the Council on February 3, 1969, a hearing was to have been held on February 24, 1969, on the adoption by reference of the Fire Prevention Code, 1968 -1969, but an extra week was given for per- sons in the industry to send in information and comments. He stated that a. letter had been received from the Cascade Natural Gas Corp., recommending the adoption of the Fire Prevention Code according to the proposed ordinance. Mr. McMicken referred to his report #45 regarding the technical changes and corrections to be made iri_the Yakima Municipal Code and recommended passage of the proposed ordinance to adopt by reference, said Fire Prevention Code, 1968 -1969. After due discussion, it was MOVED by Lambert, seconded by McNeice, that Ordinance No. 1109 relating to fire prevention, and adopting by reference, the Fire Prevention Codes, 1968 -1969 Edition, and amending sections of the Yakima Munici p I/ al Code, be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Kurbitz absent. ORDINANCE NO. 1109, AN ORDINANCE relating to fire prevention; amending Section 10.05.010 of the City of Yakima Municipal Code, adopting by reference the Fire Prevention Code, 1965 Edition, and the "October, 1966, Revision of the Fire Prevention Code, 1965 Edition," both of the American Insurance Association; adopting by reference the National Fire Codes, 1968 -1969 Edition, of the National Fire Protection Association; amending Sections 10.05.020, .050, .070, .080, .090, .120, .140, and adding new Section 10.05.145, all of the City of Yakima Municipal Code. 538 • • MARCH 3, 1969 • Finance Director Leonard Crose introduced the new City Treasurer, Walter Chappel, to the City .Council members. . • • It was MOVED by Lambert, seconded by Keith, that an Ordinance relating to traffic control, adopting by reference certain sections of Title 46, Motor Vehicles•, of the Revised Code of the State of Washington, and amending the Yakima Municipal Code, be passed as read. After due discussion, in which it was brought out that there are other Ordinances to be prepared in connection with this matter, it was MOVED by Robinson, seconded by Keith, that the matter be continued for one week or until March 10, 1969: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Kurbitz absent. ,City Manager McMicken explaining that it is necessary to execute the annual agreement for • the year 1969 with each of the various Towns and Districts for the continued operation of Fire Alarm Headquarters, it was MOVED by Lambert, seconded by Keith, that Resolution No. D -1319 authorizing the execution of agreements for the operation of the Central' Fire • Alarm Headquarters, be passed as read: carried, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown and Kurbitz absent. • • RESOLUTION NO. D -1319, A RESOLUTION authorizing the City Manager and City Clerk to execute • agreements for the operation of the Central Fire Alarm Headquarters. • City Manager McMicken explaining that it is necessary that the City hire the professional services of an independent real estate appraiser in connection with•the acquisition by . the City of right-of-way for Washington Avenue, as it is to be relocated in the vicinity • of the Yakima Municipal Airport, and recommending that Ralph A. Korn, M.A.I., be engaged for that purpose, it was MOVED by Robinson, seconded by Keith, that Resolution No. D -1320 , hiring the appraisal services of Ralph A. Korn, be passed as read:. carried, Keith, • Lambert,. Larson, McNeice and Robinson voting aye on roll call. Brown andSKurbitz absent. RESOLUTION NO, D- 1320,.A RESOLUTION hiring proveaional real estate appraisal services of Ralph A. Korn, M.A.I. City Manager McMicken referred to his report . #48, Financing the Metropolitan Park Dis- trict, which explained in detail the financial problems and needs of the Metropolitan Park District and recommending that the sum of $26,853 be granted (in :addition to the 2- mill of $141,449 already budgeted for 1969), divided into two grants as follows: • • • 1. $5,496 initially from Account 7890, Statutory and General, and 2. $21,357 dependent upon actions.of the Legislature to give State aid to cities. • After due discussion, it was MOVED by Robinson, seconded by Lambert, that the Council concur with the recommendation of the -City Manager, L and that the appropriate legislation be prepared to accomplish the initial grant $5,496 to the Metropolitan Park District:. carried, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown and Kurbitz absent. • 'City Manager McMicken referring to the.City Engineer's report on the completion of L.I.D. No. 968, Carolyn Addition and Others Sanitary Sewer District, it was MOVED by Robinson, seconded by McNeice, that March 3;1, 1969, be fixed as the time of Heating on the assess- ment roll for said District: carried,.Keith, Lambert, Larson, McNeice and Robinson • voting aye by voice vote. Brown and Kurbitz absent. • City Manager McMicken reporting that the Police Chief, Robert Madden, has requested that • three officers, Stan May, Dave Dexter and Dale Mullenhoff, be allowed to attend a two- . week training institute for supervision of Police personnel, at Denver, Colorado, and recommending that the Council authorize said travel, it was MOVED by.Lambert,'seconded • by Robinson, that said travel be allowed with expenses paid: carried, Keith, Lambert, • •Larson, McNeice and Robinson voting aye by voice vote.
