FEBRUARY 24, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call, having been excused at the previous meet - ing on February 17, 1969. • The Invocation was given by City Manager McMicken. . The minutes of the regular meeting of February .17, 1969, having been duly certified accur- ate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on the Rezone Application filed by Philip Blank, requesting_ rezone of property situated at 1010 West Nob Hill Boulevard and 1105 South llth Avenue, it was MOVED by Brown, seconded by Robinson, that Ordinance No. 1104 accepting the recommendation of the Planning Commission and rezoning said property, be passed as, read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. .Mr. Bruce Finke, Director of Planning and Community Development, explained that the south side of Nob Hill Boulevard is almost entirely stripped with commercial uses, and that with this background, the Planning Commission recommended that this proposed rezone be granted. . ORDINANCE NO. 1104, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 1010 West Nob Hill Boulevard and 1105 South llth Avenue, in the City of Yakima, Washington, from B -3, General Business Zone, to B -2, Local Business Zone, and R -2, Two Family Zone, to B -2, Local Business Zone, respectively. This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 966, Valley View Estates Domestic Water District, and there being no protests in writing or otherwise, it was MOVED by Lambert, seconded by Brown that Ordinance No. 1105 confirming said Assess- ment Roll and every part thereof, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. ORDINANCE NO. 1105, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 966 as created and established by Ordinance No. 950 of the Ordinances of the City of Yakima. . A Damage Claim having been filed with the City Clerk on February 19, 1969, by Edward E. Foat, 3604 Fruitvale Boulevard, Yakima, Washington, for the cost of thawing frozen water pipes, in the amount of $16.72, it was MOVED by McNeice, seconded by Robinson that said damage claim be referred to the City Manager and Staff for study and recommendation: carried; Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. Petition No. 627, having been filed by 011ie, Shirley and John Rhine, requesting paving and wideningof south side of Walnut Street between S. 3rd Avenue and alley east of S. 4th Avenue, it was MOVED by Brown, seconded by McNeice that said Petition be referred to the City Manager and Planning Commission for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. .Keith absent. Petition No. 628, having been filed by the Yakima Mall Shopping Center, Inc., & Others, on February 20, 1969, requesting an easement over and along a portion of East "A" Street, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1313 fixing March 24, 1969, as the time of hearing on said matter, be passed as read: carried, Brown,.Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. It was then MOVED by Robinson, seconded by Lambert that the Petition of the Yakima Mall Shopping Center, Inc., & Others, requesting an easement over and along a portion of East "A" Street as set forth in Petition No. 628, be referred to the City Manager and Planning Commission for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. RESOLUTION NO. D -1313, A RESOLUTION fixing the time and place for hearing on petition for an easement over and along a portion of East A Street in the City of Yakima. An Ordinance appropriating $5,000 within the 1969 appropriation for Street Fund, having been read in its entirety at this meeting, was laid on the table for one week or until March 3, 1969. City Manager McMicken explained that this appropriation is necessary to pay for rental of snow removal equipment, which additional appropriation could not have been reasonably foreseen at the time of the adoption of the 1969 Budget. An Ordinance appropriating $11,145 within the 1969 appropriation for City Garage Fund, having been read in its entirety at this meeting, was laid on the table for one week or until March 3, 1969. City Manager McMicken explained that this appropriation is necessary for payment of snow removal equipment rentals, purchase of water meters to be used to measure water used on City streets sweepers and flushers, and for the purchase of two automobiles for the Inspection Division of the Department of Planning and Community Develop- ment, which additional appropriation could not have been reasonably foreseen at the time of the adoption of the 1969 Budget. It was MOVED by Brown, seconded by Lambert that Ordinance No. 1106 fixing the time of delinquency and providing for the issuance of bonds for the payment of the unpaid portion of L.I.D. No. 960, North 58th Avenue & Others Paving District, be passed as read: carried, Brown, Kurbitz, Lambert, .Larson, McNeice and Robinson voting aye on roll call. Keith absent. ORDINANCE NO. 1106, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for - the payment of the cost of the improvement in Local Improvement District No. 960, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Mrs. Ilene M. Bobst and Sister Maureen Hurley, and several parents of the St.. Joseph's Grade School children, were present and filed a petition with the Council and the City Clerk at this meeting on February 24, 1969, requesting that the City Council re- examine the full -time use of parking meters situated on the north side of B Street between 3rd and 4th Streets. Mrs. Bobst stated that because of the hazard to their children, the parking meters should be hooded during school hours, 8:00 A.M. to 4:00 P.M. She further stated that the considerable amount of conjestion with traffic around this area during • 536 • FEBRUARY 24, 1969 . • school dismissal hours, makes these parking meters- a menace. John Mayo, Director of Public Works, stated that he had discussed this matter with Father Brenner of Marquette High School and that they had been in full concurrence concerning this matter.- He re- ported that Father Brenner had stated that since the children only use this area for walk- . •ing,that the parking meters would not cause any confusion. Mrs. Bobst also commented on • the fact that children in the grades of one through'three emptied out of these doors and that they did not stop and think before running out into the street after balls or just to get into parents' cars. After due discussion, it was MOVED by McNeice, seconded by Lam - bert that the petition filed by the parents and interested parties of St. Joseph's Parish, Yakima, be referred to the City Manager and Staff for study and recommendation: carried, Brown,.Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. .Keith • absent. .Mrs. .Bobst and Sister Maureen Hurley were told that when the next.hearing on this • matter comes up on the agenda, that someone from their group will notified so that they may be represented. Mr. Carl Hagborn, Supervisor of Consumer Food Programs,_of the State Department of Public • • Assistance, being present, reported that there is a.need for another outlet for selling food stamps in the City of Yakima. He requested that the City Council consider the feasibility of.selling stamps in the City Treasurer's Office. Councilman Brown indicated that he is in favor of this project. ..After due discussion, it was MOVED by Lambert, seconded by Brown that this matter be referred to the City Manager and Staff for study and • recommendation: carried, Brown,.Kurbitz, Lamb ert,:Larson, McNeice and Robinson voting aye by voice vote. Keith absent. . • City Manager McMicken referred to the matter of drawing up an agreement with Space•Utili- zation Analysis, Inc . , to conduct 'a1 �of"the space needs of City Hall. He then intro- duced Mr. Paul Wangness, Execuive Vice •President of this firm, to give better idea of what the company actually does. Mr. Wangness stated that the firm, Space Utilization Analysis, has been in business for 25 years, the last ten years having been concentrated on City, County and State planning. He reported that questionnaires have been sent around to all Department heads and after filling these out and talking . with their repre- sentatives, the completed information will be taken back to Beverly Hills where a new plan for this building will be drawn up. Mr. Wangness stated that this will be done by trying to project.into the future what the needs of City Hall will be 25 years'from now. .After due discussion, it was MOVED by Lambert, seconded by Robinson that Resolution No. D -1314 _ authorizing the execution of an agreement with S U A, .Incorporated, to conduct a study of • City Hall space needs, be passed as read: carried, Brown, Lambert, Larson,.McNeice and Robinson voting aye•on roll call. .Kurbitz voting nay on roll call. D -1314, A RESOLUTION authorizing the City Manager and City Clerk to execute an agreement with S U A Incorporated for a space requirements study for the City of Yakima. City Manager McMicken referring to the matter of authorization to submit application'for Federal funds.to conduct land use inventory and housing and family study, and stating that further study is needed on this matter, it was MOVED by Robinson, seconded by Brown that this matter be continued for three weeks, or until March 17, 1969: carried, Brown, .Kurbitz, Lambert,. Larson, McNeice and Robinson voting aye by voice vote. -Keith absent. (Mngr. Report #47) • City Manager McMicken referred to the matter of authorizing the •execution of a Project Prospectus for submittal to the Urban_ Arterial Board of the State of Washington. Public Works Director John Mayo explained that the City is requesting funds for the construction of portions of South 24th Avenue between Nob Hill Boulevard and Washington Avenue as a joint project with Yakima County. He further stated that the sewer work will be finished by this fall and the project itself will be done in 1970.
