FEBRUARY 10, 1969
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown,
Keith, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney
Andrews present on roll call.
The Invocation was given by Councilman Kurbitz. "-
The minutes of the regular meeting of February 3, 1969 having been duly certified
accurate by two Councilmen, and no one present wishing to have said minutes read pub-
. licly, Mayor Larson declared said minutes approved as recorded.
In accordance with action taken by the Council on February 3, 1969, and an Ordinance
having been prepared amending the Yakima Municipal Code to provide irrigation rates for
the use of domestic water for Municipal purposes, it was MOVED by Lambert, seconded by
Keith, that Ordinance No. 1100 specifying charges for domestic water used for certain
municipal purposes and adding a new section to the Yakima Municipal Code, be passed as
read: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye on roll

ORDINANCE NO. 1100, AN ORDINANCE relating to public services'and utilities, specifying
charges for domestic water used for certain municipal purposes; and adding Section
7.68.251 as a new section of the City of Yakima Municipal Code.
City Manager McMicken asking that action on the Ordinance granting a building permit
and revocable license to Hop Extract Corporation of America, to erect a pipe bridge
structure over Second Avenue, be deferred for a week to have more time to study on
this matter, it was MOVED by Lambert, seconded by McNeice, that said matter be con-
tinued for one week or until February 17, 1969: carried, Brown, Keith, Kurbitz, Lambert,
McNeice and Robinson voting aye by voice vote. Larson,/

dated January 31, 1969, regarding the investments of the City of Yakima, be accepted and

City Manager McMicken reporting that the annual contract for publishing legal notices for •
the City of Yakima•ezds February 17, 1969, and it is necessary to pass a resolution pre-
scribing the form of contract and directing publication of notice for proposals for the
ensuing year, it was MOVED by Robinson, seconded by Keith, that Resolution No. D -1304
prescribing a form of contract for City advertising and directing publication of notice
for proposals, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, McNeice and

City Manager McMicken reporting that the proposed irrigation maintenance assessment roll
for 1969 has been submitted, it was MOVED by Brown, seconded by Robinson, that Resolu-
tion No. D -1305 setting a date for a hearing on the confirmation of said assessment roll
for March 10, 1969 be passed as read: carried, Brown, Keith, Kurbitz, Lambert, McNeice
and Robinson voting aye on roll call. Lambert,

City Manager McMicken referred to his Report Nos. 46 and 34, Space Needs Study for City
Hall and reported that in accordance with action taken by the Council in October, 1968,
when he was authorized to negotiate with consulting firms for making the appropriate
study, he began the selection of a consultant by seeking advice of both the Association
of Washington Cities and the State Planning and Community Affairs Agency. He further
reported that twenty -two firms were suggested for' consideration, but that most of those
suggested are architectural or engineering firms and the firm being proposed for the
consideration of the Council is one which specializes in the study of space needs and
introduces into their report such variable factors as potential changes in future muni-
cipal functions, consolidation of departments, the effect of computer services, etc.
Mr. McMicken stated that SUA Incorporated, of Los Angeles, California, is the consultant
recommended and referred to their proposal and general brochure explaining their services,
copies of which have been given to the Council members. He further stated that the con-
sultant proposes a total fee of $11,200.00 and if the Council agrees with the recommen-
dation of engaging of SUA Incorporated for the proposed study, a contract will be pre-
pared for execution by action of the City Council. After due discussion, it was MOVED
by Lambert, seconded by Robinson, that SUA Incorporated be engaged for the proposed
space needs study and that a contract agreement be prepared for execution by action of
the City Council: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting
aye by voice vote. Kurbitz not voting, indicating that he is not familiar enough with
the subject.
City Manager McMicken stated that the next two items on the Agenda refer to the City-
owned building next to City Hall. He further stated that the Lessee, Investors Diver-
sified., has agreed to move the first of March, 1969 and that they have also agreed to
sell some of their furnishings to the City, which will remain there for the Department
of Planning and Community Development. After due discussion, it was MOVED by Robinson,
seconded by Lambert, that Resolution No. D -1306 terminating a lease agreement between
the City of Yakima and Irvin W. Lane be passed as read: carried, Keith, Kurbitz, Lambert,
McNeice and Robinson voting aye on roll call. Brown temporarily absent. Larson not
voting.

It was then MOVED by Keith, seconded by Lambert, that Resolution No. D -1307 authorizing
the purchase of office equipment available for immediate purchase, without calling for
bids, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson
voting aye on roll call. Larson not voting.

City Manager McMicken referred to the matter of the City being a member of, and participat-
ing in, the Yakima County Conference of Governments and that the members desire to re-
organize that organization and a revised agreement needs to be executed. Councilman
Robinson reviewed origin of the Yakima County Conference of Governments, stating that
when i came into existence couple of years ago, a number of representatives from
various governmental bodies were appointed and an agreement executed. He further stated
that recently a study was made of the representation and it became desirable to modify
this agreement so that the City Council would have two members instead of the three now
on this Board and some other variations were needed, so that the agreement was re- written.
After due discussion, it was MOVED by Brown, seconded by Robinson, that Resolution No.
D -1308 authorizing the execution of-a revised Yakima County Conference of Governments
agreement be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice
and Robinson voting aye on roll call.
RESOLUTION NO. D -1308, A RESOLUTION authorizing and directing the Mayor and City Clerk
of the City of Yakima to execute a revised Yakima County Conference of Governments
agreement. .
City Manager McMicken stated that the Director of Public Works has requested some funds
for snow removal, explaining that because of extreme weather conditions, it has been
necessary to hire such equipment, in the amount of $3,370.00. After due discussion,
it was MOVED by Lambert, seconded by Brown, that Resolution No. D -1309 authorizing-the
hiring of snow removal equipment without calling for bids be passed as read: .carried,
Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call.
RESOLUTION NO. D -1309, A RESOLUTION authorizing and ratifying the hiring of emergency
snow removal equipment without calling for bids.
City Manager McMicken reported that nominations havebeen made for members of a Review
Board to administer. the Housing Ordinance, as provided in Ordinance No. 1063 relating
to Fair Housing and recommends that the City Council appoint the following to be on this
Review Board:
(1) One selected by the, Yakima City Council from its membership, Don McNeice.
(Term coincides with term as City Councilman.)
(2) One selected at large by the Yakima City Council, who shall be a resident of
the City of Yakima, Stuart•Seman.' (Term, one year expiring 1/1/70; thereafter
successors' terms shall be for three years.)
(3) One selected by the Yakima City Council, who shall be a member of the Execu-
tive Board of the Mayor's Committee on Human Rights and a resident of the
City of Yakima, James C. Morrison, Chairman, Mayor's. Committee. (Term,
one year, expires - 1/1/70; thereafter, successors' terms shall be for three
years.) .
(4) One selected by the Yakima City Council from practicing clergymen residing
in the City of Yakima, Dr. William Ritchey, Pastor, Wesley United Methodist
Church. (Term, years, expires 1/1/71; thereafter, successor's terms shall
be for two years.) '
(5) One selected by the Yakima City Council from school classroom teachers re-
siding in the City of Yakima, Norman Roberts, Chairman YEA Association of
Classroom Teachers. (Term, two years, expires 1/1/71; thereafter, succes-
sors' terms shall be for two years.)
(6) One selected by the Yakima City Council from the membership of the Central
Washington Rental. Properties Association, who shall be a resident of the
City of Yakima, Gary D. Swenson, President. (Term, three years, expires
1/1/72; thereafter, successors' terms shall be for three years.)
(7) One' selected by the Yakima City Council who shall be a real estate broker,
agent or salesman, who shall be a residen of the Ci ty of Yakima, Mar
Marden. (Term, three years, expires 1/1/ there successors' te
shall be for three years.)
After due discussion, it was'MOVED by Robinson, seconded by Lambert, that the City Council
concur with the City Manager's recommendation and that the above named persons be ap-
pointed to serve as a Review Board to .administer the Fair Housing Ordinance No. 1063:
carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson all voting aye
by voice vote. It was then MOVED by Robinson,, seconded by Lambert, that the terms of
the members of the Review Board be made retro- active to start as of January 1,1969:

by voice vote.
There being no further business to come before the Council, it was MOVED by Kurbitz,
