Councilman Lambert was excused at a previous meeting. Councilman Kurbitz present after 3:10 P.M. . • The Invocation was given by Councilman Brown. . The minutes of the regular meeting of January 27, 1969, having been duly certified accu- rate by two Councilmen, and no one present wishing'to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Councilman Kurbitz present after 3:10 P.M. • • In accordance with the action taken by the Council at the last regular meeting on January 27, 1969, and an Ordinance having been. prepared revising the schedule of fees for Tahoma Cemetery, it was MOVED by Brown, seconded by McNeice that Ordinance No. 1099 adopting a • 'schedule of fees and charges'for Tahoma Cemetery and amending the Yakima Municipal Code, • be passed as.read. Mr Dave Wilson of Central Washington Monument Company, being present, protested the proposed monument setting rate increase as he feels this will hurt their' amount of sales. Tahoma CemeterySuperintendent Robert. Laird,'stated'that the staff does not feel that this will be the case.` He further stated that the monument companies seem to forget that we have to maintain their monuments from date of delivery on indefinitely, and that Tahoma Cemetery does not sell their own monuments as.do all other cemeteries. Mr. Wilson stated that he also feels that Tahoma Cemetery should.charge for the temporary markers, instead of giving them away free, with. the idea that the monument companies would sell more markers,. as. people would not want to leave graves of their relatives unmarked. Mr. Laird pointed out that in many cases, *especially welfare burials, no further marker is purchased and if temporary markers were not on these graves, should our records be .destroyed, it would be impossible to make up new records from the monuments.and markers, because there would be many unmarked graves. Councilman Robinson expressed concern that we might ,be pricing ourselves out of the'•market Mr. Laird pointed out that with the'propo- sed rate increase, Tahoma Cemetery prices will •be higher than only one cemetery, Calvary. After due discussion, Mayor'Larson called for the roll call vote to pass Ordinance No. 1099 adopting a schedule of fees and charges,for Tahoma Cemetery and amending the Yakima Muni - cipal'Code, as read, and it carried: Brown, Kurbitz, Larson and McNeice voting aye on roll call. Robinson voting nay on. roll call. Keith abstaining from voting. Lambert absent. ORDINANCE NO. 1099, AN ORDINANCE relating to public services and utilities; adopting a • schedule of fees and charges for cemetery lots and endowment care, mausoleum niches, open- ing and closing graves, liners, monument setting and incidental charges for Tahoma Ceme tery;'and amending Subsection 7.04.090 (b) of the City of Yakima Municipal Code. • . City Manager McMicken referred to the matter of the purchasing of a water transmission main easement from Squire - Ingham Company. Public Works Director John Mayo reviewed the circumstances regarding this matter referring to a map showing the 48" transmission line doming in from the Water Treatment Plant, and stating that the Northern Pacific Railway • has advised that it is necessary for.them to have a siding and in using enough of,their right -of -way to put this in, there isn't room enough left for us to put in pipe, and•at the railroad's request, we are moving the pipe over. He further explained that in moving the pipe, it was necessary for the City to negotiate with Squire- Ingham Company for the purchase of an easewne Mr. Mayo stating that the purchase price of $3,000 for the ease- ment is reasonable recommending said purchase, it was MOVED by Robinson, seconded by Keith that Resolution No. D -1302 authorizing the purchase of said public 'Utility easement from Squire- Ingham Company, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent. RESOLUTION NO. D -1302, A RESOLUTION authorizing the purchase of a public utility easement from Squire- Ingham Co. City Manager McMicken referring to Petition No. 626, filed by Philip Blank; requesting Vacation.of a sewer easement in Plat No. 2 of the Ontario Land Company's Lots and • a sketch showing the location of the easement to be vacated so that a future building may be constructed over the abandoned sewer line, and stating that the staff has found no reason for not granting this request, it was MOVED by Brown, seconded by Robinson that Resolution No. D -1303 vacating said easement, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice and R'ob`inson voting aye on roThI call. Lambert absent. RESOLUTION NO. D -1303, A RESOLUTION. vacating an easement in Plat No. 2 of the Ontario Land Company's Garden Lots in the City of Yakima. • In accordance with action taken.by the Council at the last regular meeting on January 27, 1969, and the matter having been continued for one week, City Manager McMicken referred to his Report #43, Municipal Water Rates for Irrigation Purposes -- Revised, which supple- ments his Report #39 on the same subject, clarifying the proposed rate for water served • through fire hydrants. He stated that the proposed rates apply only to the City and Metro- politan Park accounts, both within and without the corporate limits of the City, for irri- gation purposes and for swimming pools and wading pools. Mr. McMicken reported that there • would be a flat rate for delivery of water through fire hydrants for construction purposes, but that charges for the maintenance and operation of the City, and for fire purposes, are _ considered inappropriate, although they will be - ,Tricere0,so as to account for all water used insofar as possible. Public Works Director• John Mayo explained now the water -is • metered to be able to keep an accounting of the volume used. After due discussion, it was • MOVED by Robinson, seconded by Keith that an Ordinance be prepared that will accomplish the proposed changes in water rates: carried, Brown, Keith., Kurbitz, Larson,'McNeice and Robinson voting aye by voice vote. Lambert absent. • • . 528 • FEBRUARY 3, 1969. . City Manager McMicken referred to his Report #42, Comparison•of Ambulance Rates, stating that this matter is for information for Council, as requested at a previous meeting, • when an announcement of.a rate change in ambulance -rates was.made. City Manager McMicken referred to his Report #45, Adoption of Latest Fire Codes -- 1968 -69 Edition, explaining that last year the City staff reviewed all building and safety codes and, as a result, the latest editions of each code were adopted. He further explained that since that time, the National Fire Codes have been revised and the 1968 -69 Edition is now available and the Fire Marshal and Fire Chief recommend its'adoption be reference. . Fire Chief Jules Shockley, being present, explained that there are a considerable number of technical changes, but that generally the latest Edition provides no substantial changes over that now in force. He further explained that since the last Codes were-adopted, some omissions and corrections have been detected which make it appropriate for the Municipal Code to be amended. Mr. McMicken•stated that a proposed ordinance -has been prepared for study, and recommended that the Council set•February 24, 1969, as the time for a hearing on the adoption by reference.of the Fire Prevention Codes, and amending certain sections . of the Yakima Municipal Code. .He indicated that in the meantime, copies of the proposed • ordinance will be mailed'to persons in the industry.who should be apprised of the changes, noting that copies of the Code. are on file in the City Clerk's office, that inquiries may be made to the Fire Marshall, and that the public hearing has been set. After due dis- • cussion, it was MOVED by Keith, seconded by Robinson, that February 24, '1969, be set at the time for a hearing on the adoption by reference of the Fire Prevention Codes and amending certain sections of the Yakima Municipal Code: carried, Brown, Keith, Kurbitz, . Larson, McNeice and Robinson voting aye by voice vote. Lambert absent. • City Manager McMicken stated that he will be absent from the City on Thursday and Friday, February 6 and 7, 1969 as he will be attending meetings in.Olympia with Mayor Larson and members of the Yakima Chamber of Commerce'. There being no further business to'come before the Council, it was MOVED by Kurbitz, se- . conded by Keith that we do now adjourn at the hour of 4:00 P.M.: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote.
