Home My WebLink About01/27/1969 Business Meeting 523 JANUARY 27, 1969 The City Council met in regular session, Mayor Larson presiding. Councilmen Keith, Kurbitz, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Brown and Lambert absent on roll call, having been excused at the previous meeting. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of January 20, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read pub - licly, Mayor Larson declared said minutes approved as recorded. Before proceeding with the regular meeting, Mayor Larson presented a plaque to City Treasurer Gladys Richter, who is retiring January 31, 1969 after 33 years with the City. Damage Claims having been filed with the City Clerk on January 17, 1969 by James, Orville and Virginia Layman, 1906 Willow Street, and Jackie, Jack and Rosa Dykes, 1704 Swan Avenue, in the amount of $25,000.00, each claiming for damages and injuries caused by an automobile - bicycle accident, it was MOVED by. Keith, seconded by Robinson, that said damage claims be referred to the City Manager: carried, Keith, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Brown and Lambert absent. Mr. Mel Lewis, Chairman, Citizens' TASK FORCE on Public Safety, presented their report to the City Council. He read his letter which is on the first page of the report which stated that since October 1, 1968, when the City Council appointed the members of the Citizens' TASK FORCE on Public Safety to review the needs of the Police and Fire De- partments, determine appropriate new sources of revenues and report their conclusions, they have met 17 times, investigated this matter thoroughly, and herewith submit their conclusions and recommendations. Mr. Lewis stated that the committee members have found this assignment interesting and challenging and have come to have new respect for the problems faced by our policemen and firemen and are certainly impressed with the dedication, loyalty and professionalism of our public safety officers. Council members indicated their appreciation of the work and study that has gone into thisre- port and plan to study and review it further and make copies available for anyone who wishes to have one. Mr. Tony Di Tomasso, a local garbage man, was present to offer the possibility of the City contracting his services for garbage removal, stating that he has heard the City is losing money with its garbage service and .that he feels he can make money for the City as well as himself. He further stated that he contracts with the towns of Terrace Heights, Granger, Union Gap and Naches. Council members suggested that Mr. Di Tomasso bring in his proposal and discuss the matter with City Manager McMicken, who will in turn bring it before the Council. City Manager McMicken reported that the City Attorney's office has reviewed the matter of the Damage Claim filed by Lester Capistran for damages in the amount of $49.11 due to as sewer backup, and recommends payment of said claim. RESOLUTION NO D -1299, A RESOLUTION authorizing payment of a Claim for Damages filed against the City of Yakima by Lester Capistran. - • • City Manager McMicken explained that,after discussion•and negotiations with the Direc- tor of Public Works, an agreement has been prepared by Pacific Power & Light Company • • which-would allow the -City to assume ownership of 135 - 21,000 -lumer mercury -vapor street lights on 16th Avenue. He further explained the Public Works Director, John Mayo, has worked this matter out with Pacific Power & Light Company.'..Mt'. in connection::W.ith'•use.. of , Urban :Arterial: Funds_with. 90% ..State: cost and 10% City, this would be a relatively cheap way to acquire some street lighting improvements.- He fur- . there stated that the -poles are owned by the power company and the City will own the arms, fixtures and wiring, and the maintenance .agreement •will be simply for. the power Company to continue to do what they have done in the past - replace the globes, keep the fixtures clean, etc. He stated'it will cost the City approximately $3.90 per month per light, where it would cost $5.50 per month per light if the entire light were owned by Pacific Power & Light Company. Mr. McMicken stated that this plan has been coor- dinated with the County to include the lights in the County on 16th Avenue, with the idea that might annex this portion within the next• ten years or so. After due discussion, it was MOVED by McNeice, seconded by Keith, that Resolution No. D -1300 • authorizing the City to enter into an agreement with Pacific Powe^& Light Company for the purchase of street lights on 16th Avenue, be passed as read: carried, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Brown and Lambert absent. RESOLUTION NO. D -1300; A RESOLUTION authorizing the City Manager and Clerk to enter an agreement with Pacific Power & Light Company covering the purchase of, and the energy and maintenance service for, certain street lights. City Manager McMicken explained that the contract between the City and Book Publishing Company for the printing and codification of Yakima city ordinances needs to be renewed and Book Publishing has sent a modified agreement which sets the replacement cost at $14.00 per page. He further explained that in the past, a lump sum has been 1/- charged, which has been to the City's benefit, but Book Publishing Company has been suffering the past two years and must now charge $14.00 a page. Mr. McMicken stated he talked with Mr. Tinsley of Book Publishing Company, stating we would accept the • going rate of $14.00 per page providing that rate can be maintained for several years, and the present agreement states that the rate of $14.00 per page will - be maintained for the years of 1969, 1970 and 1971. Council members agreed that Book Publishing -. Company has done a good job of codifying our City Ordinances and keeping - the Yakima Municipal Code up -to -date; and if necessary, the cost of the supplements - supplied to various law firms and others might have to be raised from $10.00 to $15.00 per supple- . ment. Brown and'Lambert absent. RESOLUTION NO. D -1301, A RESOLUTION authorizing the City Manager and City Clerk to II execute a contract with Book Publishing Company. City Manager McMicken referred to his Report #39, Municipal Water Rates for Irrigation Purposes, explaining that for reasons somewhat similar to the irrigation water rate given to households on the City domestic water system, a "bulk" or "irrigation" rate is pro - posed for municipal departments, including the Metropolitan Park District. Mr. McMicken asked that this matter be carried over for one week becase sufficient study has not been made of the costs regarding water through fire hydrants. After due discussion, it was • informally agreed ".to concur with the City Manager's recommendation and continue this matter for one week, or until February 3, 1969. City Manager McMicken referred to his Report #40, Proposed Fee Increases -- Tahoma Cemetery, stating that in reviewing Tahoma Cemetery operation with Cemetery Superintendent, Bob Laird, and Public Works Director, John Mayo, and based on income and expenditures over the past three years, he recommends that the fees for the Cemetery be changed in accord - ance with the proposed revised fee schedule attached to report. He• stated that due to increased costs for labor and material, the Cemetery is no longer self - supporting, revenue from services and sales have not kept pace with costs and compared with other . local cemeteries, many of our charges are below-the fees charged elsewhere. Council members indicated they would be interested in comparing the fees other cemeteries charge for the various services listed on the proposed schedule for Tahoma Cemetery. After due discussion, it was MOVED by Robinson, seconded by Kurbitz,;that an ordinance be prepared. incorporating the proposed revised fees and that data be available regarding. the fees charged by other cemeteries at the time the ordinance is brought before the Council: carried, Keith, Kurbitz, Larson, McNeice and Robinson voting aye by voice .vote. Brown and Lambert absent. • City Manager McMicken referred to his report #41, Proposed Traffic Code, stating that this proposed traffic code makes a complete review of the ordinances already on the books and .proposes a completely new section dealing with the traffic field. He referred to a • • • memo from City Attorney Andrews; who stated that this proposed ordinance is the result of many•hours of work by Assistant City Attorney Gary McGlothlen, with the assistance • of various personnel of the Public Works Department and the Traffic Engineering Divi- s.ion of that department, the Police Department,. the Fire Department and the Finance Department. Mr. Andrews explained that the proposed 56 -page traffic ordinance is intended to replace most. of the existing traffic laws found in the •City's Municipal Code, stating that many of the provisions of the Municipal Code relating to the subject • are obsolete and others are in conflict with state laws and the proposed ordinance which retains some provisions of Yakima's existing traffic code, also adopts and in- corporates by reference many state statutes. City Manager McMicken recommended approval of the proposed ordinance. Council .members indicated they will study the proposed ordinance and act upon it'formally at a later time.
