HomeMy WebLinkAbout01/20/1969 Business Meeting 521 JANUARY 20, 1969 The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Kurbitz absent on roll call and present after 8:10 P.M. The Invocation was given by City Manager McMicken. The minutes of the regular meeting of January 13, 1969, having been duly certified accurate by two Councilmen, and no one present wishing to have .said minutes read publicly, Mayor Larson declared said minutes approved as recorded.` Petition No. 626, having been filed with the City Clerk on January 10, 1969; by Philip Blank, requesting the Vacation of a utility easement at 1010 W. Nob Hill Boulevard, and City Manager McMicken stating that this matter should be referred to the City Engineer for advice on easement matters and the City Attorney for the method of vacating said ease- ment, it was MOVED by Robinson,. seconded by Brown that said Petition be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Lar- son, McNeice and Robinson voting aye by voice vote. Kurbitz absent. A Damage Claim having been filed with the City Clerk on January 16, 1969, by Lester Capis- tran, for sewer backup damages at 308 S. Naches Avenue, in the amount of $49.11, it was MOVED by Lambert, seconded by McNeice that said damage claim be referred to the City Mana- ger: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz absent. . Councilman Kurbitz present after 8:10 P.M. .. City Attorney Andrews explained that an Ordinance relating to the penalty for shop lifting has been prepared to bring the existing Ordinance in line with State Statute, and that the Police Department recommends the passage of this Ordinance. Mr. Andrews stated that the maximum fine is increased from $300 to $500, and /or maximum time in jail is increased,from 90 days to a maximum of 6 months, or both, and the Ordinance also establishes a minimum of $50 penalty on the first offense, or imprisionment in the City Jail for not less than five days, and establishes minimum penalty upon each subsequent conviction. Councilman Brown indicated that he feels this is an'excellent Ordinance and should help combat the shop lifting problem, by fixing a stiffer minimum, as well as maximum penalty. After due dis- cussion, it was MOVED by Brown, seconded by Lambert that Ordinance No. 1098 relating to the penalty for shop lifting and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. . ORDINANCE NO. 1098, AN ORDINANCE relating to public health, safety and welfare; amending Section 6.68.020 of the City of Yakima Municipal Code, Penalty for Shoplifting Violation. City. Manager McMicken referring to the City Engineer's Report on the completion of L.I.D. No. 965, Englewood Heights and Others Paving District, it was MOVED by Robinson, seconded by Brown that February 17, 1969, be fixed as the time of Hearing on the assessment roll for said District: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. city Manager McMicken stated that Public Works Director John Mayo has come up with a pro- gram for professionalizing the traffic engineering function and the traffic safety program of the City. Mr. McMicken referred to his Report #38 regarding Traffic Safety Program -- Federal Grant, which explained that with our continued efforts toward improved traffic safety, a new traffic engineering division is being created in the Department of Public Works. Mr. McMicken stated that while the City has had a traffic engineer in the past, the reorganization now under way emphasizes the activity be equating the traffic engineer, professionally, with the city engineer, expanding the traffic engineering staff, and grouping some related activities together which previously were in three different depart- ments. He explained that in attacking the subject of traffic safety, a comprehensive pro- gram designed to establish appropriate procedures and methods for handling and acting upon traffic safety problems is recommended by the Director of Public Works, pointing out that such a program is contemplated for state and local governments in the Highway Safety Act of 1966, which includes federal financial assistance. Mr. McMicken explained the Highway Safety Act of 1966 and the requirements that the City must follow in order to develop a program which will enable them to submit an application for a highway safety project grant, including the employment of an outside traffic engineer consultant to act as project coordinator responsible for planning and organizing the traffic safety program. He recom- mended that the Council authorize the submission of an application for a highway safety project grant in the amount of $31,278. After due discussion, it was MOVED by Robinson, seconded by Lambert that Resolution No. D -1298 authorizing the application for a Highway Safety Project Grant from the United States Government, be passed as read: carried, Brown, "- Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1298, A RESOLUTION authorizing and directing the City Manager and. Director I/ of Public Works to apply for a Highway Safety Project Grant from the United States Govern- ment. City Manager McMicken indicated that he feels it is important that we upgrade and improve the skills and techniques of the members of our Police Department and in this respect recommends that the Council authorize a member of the Police Department, Sgt. Richard Nesary, to attend a Polygraphic Training Course as recommended by Chief Madden and Sgt. John Jenkins. Mr. McMicken referred to a memo from Sgt. Jenkins, who is presently one of J22 • JANUARY 20, ,1969 - -• the very few men in the State trained in this polygraph work and who will be retiring in a couple of years, and is recommending that Sgt. Nesary be given this training. Sgt.. Jenkins explained ,in his memo that he had attended such'a course.in Chicago, Illinois, • several years ago, and that there are two courses to be held in this training this year, one in Los Angeles, California,• and one in New York City. He further explained that he does not have much information about the one in Los Angeles, but that the one in New York has one of the best instructors and the qualified number of hours, .and.recommends that Sgt. Nesary.be allowed to attend the one in New York, which is a six week course, from February 22, 1969, to April 5, 1969, at an approximate. cost of $1800.00. Sgt.•Jenkins stated in his memo that he is recommending that Sgt. Nesary attend a different school than he attended, in order that the two • of them can consolidate their separate information into one training course for the Police Department Staff. After due discussion,' it was MOVED by Lambert, seconded by Keith that this travel be allowed with expenses paid: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. . • . City Manager McMicken stating that Fire Chief Shockley requested that Battalion Chief Dick Landis be authorized to travel to Portland, Oregon, to attend a three -day short. course in Fire. Fighter Management, at an approximate cost of $95..00 and recommending that this travel be allowed, it was MOVED by Lambert, seconded by Brown, that said travel be allowed with expenses paid: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson • voting aye by voice vote. Councilmen Brown and Lambert asking to be excused from the next Council meeting, it was MOVED by Robinson, seconded by McNeice that they be excused from the meeting on January 27, . 1969:. carried, Keith, Kurbitz, Larson, McNeice and Robinson votine aye by voice vote. .
