HomeMy WebLinkAbout12/23/1968 Business Meeting 513 • • DECEMBER 23, 1968 • The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Lambert, McNeice and Robinson, Assistant City Manager Friedline and City Attorney Andrews present on roll call. Councilmen Keith and Kurbitz absent on roll call. Councilman Keith present after 3:05P.M. Councilman Kurbitz present after 3:15P.M. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of December 16, 1968, having been duly certified accu- rate by two Councilmen, and no one present wishing to have said minutes read publicly, MayorLarson declared said minutes approved as recorded. It was MOVED by Brown, seconded by Lambert that Ordinance No. 1091 relating to taxes upon - certain utilities and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Lambert, Larson,:McNeice and Robinson voting aye on roll call. Kurbitz absent. City Attorney Andrews explained that in Subsection "D" of the existing Ordinance regarding steam heat, the only language that has been changed.is that the 2% permanent tax was left out. He further explained it has been by mutual work and agreement with Pacific Power and Light on this matter that this ordinance reads as it does now. ORDINANCE NO. 1091, AN ORDINANCE relating to taxes upon certain utilities; amending Sec- tion 1 of City of Yakima Ordinance No. 10$0 passed November. 25, 1968, and entitled "AN ORDINANCE ,relating to taxes upon certain utilities, fixing tax rates, providing for a sur- charge, saving certain taxes and amending Section 5.50.050 of the City of Yakima Municipal Code "; amending Section 5:.50,050 of the City of Yakima Municipal Code; and declaring an emergency. . It was MOVED by Lambert, .seconded by Brown that Ordinance No. 1092 relating to surety bond and insurance regulations required of plumbing and side sewer .contractors and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith; Kurbit.z,,.Lambert, Larson, McNeice and Robinson voting aye on roll call. City Attorney Andrews explained that for many years plumbing and side sewer contractors have used surety bonds and insur- ance required by other contractors but this has not been specifically set up in the Yakima Municipal Code, and this proposed Ordinance amends the Yakima Municipal Code to provide for these requirements. • ORDINANCE NO. 1092, AN ORDINANCE relating to building regulations; specifying the surety • bond and insurance required of Plumbing Contractors and Side Sewer Contractors; and amending Section 11.44.070 of the City of Yakima Municipal Code. Mr. Bruce Finke, Director of Planning and Community Development introduced two new assis- tant planners, Robert McCoy and Mark Beisse. • A petition was submitted to the Council and filed with the City Clerk on this date, by Fir. . Dick Forrest, Jr., requesting the blocking off of South 27th Avenue between Tieton Drive and Arlington so that children could slide on this street. Council members discussed the matter and the majority seemed in favor of this blockage for sledding. After due : discussion, it was MOVED by Robinson, seconded by McNeice that the Council authorize the blocking off of South 27th'Avenue between Tieton Drive and Arlington for sledding purposes: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote. Larson voting nay by voice vote. . Assistant City Manager Friedline stated that a request has been received from Frigid Fruit for sewer and water utility service outside the city limits at 16th Avenue and Mead. _Mr. Bruce Finke, Director of Planning and Community Development, explained that if service is . approved, the applicant intends to sell the property to a Mr. Douglas Ray and associates, who intend to develop the property. He stated that the proposed development would include a 152 -unit apartment complex, a drive -in restaurant and a mini -mart grocery store. The Planning Communion believe that the proposed change in the land use plan to permit the apartment and limited commercial development is justified in light of the nature of the property and its location on an arterial street, providing that it be processed as a Planned Unit Develtr_pmeit. Mr. Finke stated that the Planning Commission and Staff are recommending to the Council that this outside utility service be allowed. After due dis- cussion, it was MOVED by Robinson, seconded by McNeice that the request of Frigid Fruit for Utility Service Outside the city limits be authorized subject to conditions in dedi- cating certain property before installation of water & sewer services and subject to the usual requirements of the signing of the Outside Hookup Agreement: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Assistant City Manager Friedline stated that a'request has been received from Mr. Ernest A. Antijunti for Outside City domestic water hookup at 706 West Washington. Mr. Bruce Finke, Director of Planning and Community Development, explained that at the present time, it appears impossible to develop an annexation which could. include the applicant's pro- perty. He stated that the Planning,Commission and Staff are recommending to the Council that this outside hookup be allowed. After due discussion, it was MOVED by Robinson, seconded by Lambert that the request of Ernest A. Antijunti for Domestic Water hookup be authorized subject to the regular provisions of the outside utility agreement: carried, • Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Assistant City Manager Friedline stated that a request has been received from Philip J. Leadon for sewer utility connection outside the city limits at 3302 Englewood Avenue. Mr. Bruce Finke, Director of Planning and Community Development explained that there have been • discussions at various times about a possible annexation of the entire block of land loca- ted between North 32nd Avenue and North 35th Avenue, south of Englewood, and that domestic sewer service is readily available to most residents within the area in question. He stated that the Planning Commission and Staff are recommending to the Council that this utility connection outside the city limits be allowed. After due discussion, it was MOVED by Brown, seconded by Robinson that the request of Philip J. Leadon for Utility connection • outside the city limits authorized, subject to the usual requirements of the Outside Utility Agreement: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson Voting aye by voice vote. • • 514 DECEMBER 23, 196$ Assistant City Manager Friedline reported that the term of Mrs. Winfield Boyd on the Library Board of Trustees, will expire December 31, 1968, and that John Bloxom has been proposed as the new member of the Library Board. .After due discussion, it was MOVED by Robinson, seconded by Brown that the appointment of Mr. John Bloxom to the Library Board be approved and whatever steps required be taken to make this appointment official: III carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote; It was suggested that a letter of commendation be written to Mrs. Boyd. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Keith that we do now adjourn at the hour of 4 :00 P.M.: carried, Brown, Keith, Kurbitz, Lambert, Larson., McNeice and Robinson voting aye by voice vote.
