HomeMy WebLinkAbout12/02/1968 Business Meeting 505 DECEMBER 2, 1968 The City Council met in regular session, Mayor Larson presiding, Councilmen Keith, Lambert, and McNeice, City Manager McMicken and City Attorney Andrews present on roll call Council man Kurbitz absent on roll call and present after 3:05 P.M. Councilmen Brown and Robinson absent on roll call, having been excused at a previous meeting. • . The Invocation was given by City Manager McMicken. . The minutes of the regular meeting of November 25, 1968, having been duly certified accur- ate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Councilman Kurbitz present after 3:05 P.M. This being the time fixed for the Hearing on the appeal from the Planning Commission's decision on Rezone Application, filed by Harry L. Whitehead, requesting rezone of property located at 107 N. Naches Avenue, it was MOVED by Lambert, seconded by McNeice that a Resolution affirming the Planning Commission's decision to deny said rezone, be passed as read. Principal Planner Loidhamer explained that the applicant proposes to remove this single family residence and construct an insurance office with parking on the front and rear of the lot. He further explained that the Planning Staff and Planning Commission recommend denial of this request for rezone because they feel it would be a spot zone and would not conform with the intent of the C.B.D. Plan for future development of this area. Mr. Whitehead being present to speak for the rezone request, referred to his Memo to the City Council, and explained in detail the following points listed in the Memo: "1. That the planning commission disregarded the expressed desire of the overwhelming majority of the people in the neighborhood. 2. That the general plan for the City of Yakima does not contemplate the violent type of transition in zoning which the planning commission here advocates. 3. That our plan complements the city's CBD program. 4. That there are businesses to the East of our property. (Bl - B2 - B3) 5. That the church which is on the South end of our block carries a zoning of Bl. 6. That the buildings situated to my North at 111 N. Naches Avenue and to my South at 105 N. Naches Avenue, have also applied for Bl status and only one building situated on the extreme North of this block remains R3. 7. There are abundant precedents available to justify the approval of our application." Mr. Whitehead further requested that this matter be referred back to the Plannirj Commis- sion for further study. Mr. Zimmerman, operator of an apartment at 115 N. Naches Avenue, stated he is against this rezone. Miss Alvena Schlotfeldt, 111 N. Naches Avenue, spoke in favor of the rezone stating that she and William Greenwood, 105 N. Naches Avenue, have filed rezone applications and feel this property should all be rezoned. Council members indicating that in view of the information that these two additional rezone requests are being considered at the Planning Commission meeting on December 3, 1968, that the decision of the City Council should be delayed. After due discussion, it was MOVFT) by Keith, seconded by Kurbitz that this matter be tabled for one week, or until December 9, 1968: carried, Keith, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Brown and Robinson absent. A Damage Claim, having been filed with the City Clerk on November 25, 1968, by Raymond J. Ibach, 409 S. 13th Avenue, for damages in the amount of $15.78, caused to his automobile when it was struck by a manhole cover, it was MOVED by McNeice, seconded by Kurbitz that said Damage Claim be referred to the City Manager and Staff for study and recommendation: carried, Keith, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Brown and Robinson absent. An Ordinance appropriating $2,500 for the Transit Department, having been read in its entirety at this meeting, was laid on the table for one week or until December 9, 1968. City Manager McMicken referred to his report #36 which explains the need for additional funds for wages for the Transit Department. An appeal from the Planning Commission's decision to deny rezone application, having been . filed with the City Clerk on November 26, 1968, by Humble Oil and Refining Company, 504 N. First Street, it was MOVED by Lambert, seconded by McNeice that December 16, 1968, be fixed as the time for a Hearing by the City Council on said matter: carried, Keith, Kurbitz Lambert, Larson and McNeice voting aye by voice vote. Brown and Robinson absent. City Manager McMicken requested that he be authorized to travel to Bellevue, Washington, to attend a City Manager's meeting on December 5 and 6, 1968. He also requested authoriza- tion be given for two Garage personnel to attend an Automatic Transmission School= - ,=sponsor- ed by International Harvester Company, Los Angeles, Calif., December 9 - 12, 1968, at an approximate cost for travel of $150 each. After due discussion, it was MOVFn by Lambert, seconded by McNeice that said travel be allowed with expenses paid: carried, Keith, Kur- bitz, Lambert, Larson and McNeice voting aye by voice vote. Brown and Robinson absent. 506 DECEMBER 2, 1968 There being no further business to come-before the Council, it was MOVED by Kurbitz,• seconded by Keith that we do now adjourn at the hour of 4:15 P.M.: carried, Keith, Kur- bitz, Lambert, Larson and McNeice voting aye by, voice vote.
