The minutes of the regular meeting of November 12, 1968, having been duly certified accu- rate by two Councilmen, and no one present wishing to have said minutes read publicly,' Mayor Larson declared said minutes approved as recorded. Petition No. 625 having been filed with the City Clerk on November 14, 1968, filed by the Metropolitan Park District of Yakima requesting vacation of Sumac Lane lying between East Maple and the Southwesterly right -of -way line of Interstate Highway $2 for Kiwanis Park, it was MOVED by Lambert, seconded by Brown that the Petition of the Metropolitan Park District for the vacation of Sumac Lane, as set forth in Petition No. 625, be referred to the City Manager and Planning Commission for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Council wishing to expedite matters in connection with Petition No. 625, it was MOVED by Robinson, seconded by Keith that said Resolution No. D -127$ fixing date of Hearing on Petition No. 625 for the 16th day of December, 1968, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1278, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public street. , A Damage Claim having been filed with the City Clerk on November 14,. 1968, by Ruby Doliver, 910 North 4th Avenue, Yakima, Washington, it was MOVED by McNeice, seconded by Lambert that said damage claim be referred to the City Manager and Staff for study and recommenda- tion: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. 1 An appeal from the Planning Commission's decision to deny application for rezone of pro'- perty located at 107 North Naches Avenue having been filed with the City Clerk on Novem- ber.13, 1968, by Harry L. .Whitehead, it was MOVED by Robinson, seconded by Brown that December 2,196$, be set as the time for a hearing on the matter of said rezone and that the City Clerk give notice of such hearing as required by carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. The following bids for the sale of 02,$00,000 Water and Sewer Revenue Bonds, Series "B"1, were received and opened on this date, November 1$, 196$ at the hour of 1:00 P.M., in the presence of City Finance Director Leonard Crose, Assistant City Manager Martin Fr Purchasing Agent Kermit Smith, City Clerk Marie Donelson, and Mr. Robert O. Yeasting, representing Harper & Son, Financial Advisors for the City of Yakima: John Nuveen & Co. 5.10$1 % Eff. Interest Halsey, Stuart & Co. 5.1473 " " M,L,P,F, &S Inc. 5.2002$ " " mith, Barney & Co. 5.2656 " it Blythe & Co., Inc. 5,2976 " IT , These bids were then checked for errors by the City Finance Director Leonard Crose and Mr. Robert 0. Yeasting, of Harper & Son and the interest costs were tabulated and the bid of John Nuveen & Co., Chicago, Illinois, reported as the lowest and best bid with an effec' tive interest rate of 5.10$10. Mr. Leonard Crose, Finance Director., recommending that the bid be awarded to John Nuveen & Co., it was MOVED by Robinson, seconded by Brown that the bid to purchase S2,800,000 of Water and Sewer Revenue Bonds, Series "B ", be awarded to John Nuveen & Co., Chicago, Illinois: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Discussion indicated that these bonds have been rated as "A -1" by Moody's and "A" by Standard & Poor's and that William P. Harper & Son & Co. had recommended that we have the bonds rated by two firms. City Manager McMicken recommended that we install a school crosswalk signal device at 22nd Avenue and Nob Hill Boulevard. It would read "School Crosswalk" and would have yellow flashing lights attached and be installed over the street. He cited two cases of injury at this intersection. Mr. McMicken further reported that the responsibility of traffic supervision and safety does not lie with any one group but with everyone. Funds for this project will have to be obtained from the existing budget and possibly funds within next years budget. There are twenty two other locations throughout the city which are under study for school crossings. There being no further discussion, it was MOVED by Robinson, seconded by McNeice that approval be given to go ahead on the installation of a school crosswalk signal devise at 22nd Avenue and Nob Hill Boulevard: carried, Brown, Keith,_Kur- bitz,•Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported on school children's safety on Fair Avenue: He stated that there are no sidewalks on the North & South side of Fair Avenue and that children while walking home from school are forced into the street by obstructions along the pathway. The basic concern is South 10th Street. Councilman Robinson asked if there would be any need to reduce the speed.. The staff felt that this would not be necessary. John Mayo., Director of Public Works, stated that al three foot retaining wall would be needed along with the construction of this sidewalk. He stated that the area to be used for this sidewalk is wide enough. Councilman Lambert absent after $:45 P.M. City Manager McMicken referred to the Report of the City Engineer of final payments for work performed during the month of October, 1968, and recommending that the work be acc' epted and payment made as follows: - -_ - - CONTRACT AWARDED PROJECT AND CONTRACTOR FUND AMOUNT North hpth Ave. Art. ( - -- . 5a . l / i ' NOVEMBER 1$, 196$ It was MOVED by McNeice, seconded by Robinson that the report of the City Engineer dated November 13, 196$, with respect to the completion of the work on Public Works Contract, North 16th Avenue Arterial Improvement Park Lane to Lincoln Avenue, be approved, the work be accepted and payment of the final estimates as therein set forth is hereby authorized: carried, Brown, Keith, Kurbitz, .Larson ; ; McNeice and Robinson voting aye by voice vote. II Lambert absent. .- . City Manager McMicken indicated that City Attorney Fred Andrews ha `s completed negotiations with Gayland R. Bolm for the purchase of property to be used as right -of -way for the re- location of Washington Avenue. Fred Andrews reported that the property to be purchased was assessed at 51,000 and that the Bolm heirs had asked $1,400 - $1,600 for this piece of property, and through negotiations we are now able to obtain the necessary right -of -way for Washington Avenue from Gayland R. Bolm for the cost price of S1,200. After due dis- cussion, it was MOVED by Brown, seconded by Robinson that Resolution No. D -1279 authori- zing the purchase of property from Gayland R. Bolm for the right -of -way for Washington Avenue be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye on roll call. Lambert absent. RESOLUTION NO. D -1279, A RESOLUTION authorizing the purchase of real property by the City of Yakima as right -of -way for Washington Avenue. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Robinson that we do now adjourn at the hour of 9:05 P.M: carried, Brown, Keith, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote.
