HomeMy WebLinkAbout11/12/1968 Business Meeting 498 NOVEMBER 196$ The City Council met in regular session, Assistant Mayor Robinson presiding, Councilmen Brown, Keith,.Kurbitz, Lambert and McNeic?.. and City Manager McMicken, present on roll call. Mayor Larson, absent on roll call because he is in the hospital. It was MOVED by Keith, seconded by Lambert that Mayor Larson be excused from this meeting: carried, Brown, Keith, Kurbit.z, Lambert, McNeice and Robinson voting aye by voice vote. City Attorney Andrews absent and in court. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of November 5, 1968, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Assistant Mayor Robinson declared said minutes approved as recorded. Councilman McNeice introduced Mr. Guy Barnes, representative from the Jaycee's and Chair - man on Community Development. • Mr. Barnes stated that the Jaycee's are interested in comm- unity affairs and the workings of the City Council, and plan to have a member of the Jay- cee's attend future meetings. . City Manager McMicken referring to the memo from Fred Andrews regarding the Attorney General and his office representing the City of Yakima as legal counsel for condemnation proceedings for access of right -of -way, it was MOVED by Lambert, seconded. by Brown that Resolution No. D -1274, appointing the State Attorney General as special counsel for the City of Yakima in condemnation proceedings, be passed ab . read: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye on roll call. Larson absent. RESOLUTION NO. D -1274, A Resolution appointing the Attorney General of the State of Wash- ington, and certain Assistant Attorneys General, as special counsel for the City of - Yakima in the case of the State of Washington, petitioner, vs. Kershaw Fruit & Cold Storag • Co., a Washington corporation, et al., cause No. 517$9 in the Superior Court of the State of Washington for Yakima County. City Manager McMicken reported that the Damage Claim filed by Jameto & Carol Doerr, 411: South 12th Avenue, in the amount of S20,000 for damages caused when they both slipped on ice and fell, has been investigated by the City Attorney's Office and the amount of the claim has been reduced to S318.69, and the City Attorney's office recommends payment. After due discussion, it was then MOVED by Brown, seconded by Keith that Resolution No. D -1275 authorizing payment of 8318.69 to James and Carol Doerr in full satisfaction of said Damage Claim, be passed as read: carried, Brown Keith, Kurbitz, Lambert, McNeice and Robinson voting aye on roll call. Larson absent. RESOLUTION NO. D -1275, A Resolution authorizing payment of a claim for damages filed against the City of Yakima by James and Carol Doerr. - City Manager McMicken reported that he had received a letter from the Statewide City Em ployees Retirement System, concerning Eldon A. Mantey and Glen W. Pleasant, who have been City Employees for . many years. He indicated that at one time they were members of the Statewide City Employees Retirement System, then were appointed alarm operators for the Fire Department and were under the Firemen's. Relief. and Pension Plan. He further indicates that they were later appointed signal maintenance men and no longer under the Firemen's Relief and Pension Plan. Mr.McMicken stated that these men now desire to be reinstated as members of the Statewide City Employees Retirement System and the City has tried to work this out with the State Retirement Board. He further stated that if the men are reinstate& it would mean that the City and the men would have to deposit all past dues so as to bring payments up to date, and that the City's payment would come by way of credits. - After due discussion, it was MOVED by Brown, seconded by Lambert that Resolution NO. D -1276, author- izing Eldon A. Mantey and Glen W. Pleasant to receive justified credits in Statewide City Employees Retirement System, be passed as read: carried, Brown, Keith, Lambert, McNeice and Robinson voting aye on roll calla Larson absent. Kurbitz temporarily absent. RESOLUTION 'NO. D -1276, A Resolution authorizing retroactive membership for Elden A. Mantey and Glen W. Pleasant in the Statewide City Employees Retirement System. . City Manager McMicken reporting that a request has been received for extension of 'Outside sewer service to the residence at 5316 Tieton Drive owned by Holy Family Parish and that the staff recommends that this be allowed, it was MOVED by McNeice, seconded by Lambert Ar that said Outside sewer service be approved, subject to the execution of the usual stan- dard outside hookup agreement, carried: Brown, Keith, Kurbitz, Lambert, McNeice and Robin- son voting aye by voice vote. Larson absent. City Manager McMicken stated that in connection with the construction of improvements to the water treatment plant and transmission system, it is necessary to engage professional engineering services for the design and construction of a portion of said transmission lines, and recommended that Cornell, Howland, Hayes Merryfield, Inc., be engaged to per- form said services. After due discussion, it was MOVED by Lambert, seconded byMcNeice that said Resolution No. D -1277 authorizing the execution of an agreement with said firth for professional engineering services, be passed as read: carried, Brown, Keith, Kurbitz,', Lambert, McNeice and Robinson voting aye on roll call. Larson absent. RESOLUTION NO. D -1277, .A Resolution authorizing the execution of an agreement with Cornell, Howland, Hayes & Merryfield, Inc., for professional engineering services. 500 NOVEMBER 12, 196$ . City Manager McMicken referred to the matter of the purchase of an easement for installa- tionof a domestic water transmission main indicating that further information is needed before any action can be taken: He suggested that the matter be striken from the agenda at this time. No further action was taken on the matter.' City Manager McMicken requesting authorization for Frank Stein, Frances Jaeger, Al Burliso Peggy Rabung and Glen Perkins to travel to Provo, Utah, to observe a pipe line installatio; project and stating that their transportation will be furnished by the Pacific State Cast Iron Company, it was MOVED by Lambert, seconded by Brown that said travel be allowed with expenses paid: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote. Larson absent. . Councilman Lambert requested that another alternate be designated to substitute for her on the Y.V.C.C.A. Board. She explained that she is already a member representing the Health Board and it is impossible for her to represent both the City Council and the Healt) Board at the same time, and suggested that Councilman McNeice be substituted. After due discussion, it was MOVED by Brown, seconded by Keith that Councilman McNeice be appointed to substitute for Councilman Lambert as an alternate on the Y.V.C.C.A. Board: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote. Larson absent. Councilman Lambert reported that there has been some indication that the State of Wash- ington Planning Community Affairs Agency is planning a Regional Multiservice Center in thi, area and feels that the City Council should urge that the Center be located in Yakima. Sh! further suggested that a letter should be written to the Planning Community Affairs Agency and the Governor requesting that this Center be established in Yakima.. After due discuss- ion, it was MOVED by Lambert, seconded by McNeice that a letter be written advising the Agency and the Governor that the City Council recommends that when a Multiservice Center is developed that it be located in Yakima: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote. Larson absent.
