HomeMy WebLinkAbout10/28/1968 Business Meeting • • 494 • OCTOBER 28, 1968 The City Council met in regular session, Assistant Mayor Robinson presiding, Councilmen Brown, Keith; Lambert,•City Manager McMicken and City Attorney Andrews, present on roll call. Councilman McNeice requesting to•be excused from this meeting, it was MOVED by Lambert, seconded by Keith that he be excused from this meeting: carried, Brown, Keith, Lambert and Robinson voting aye by voice vote. Councilman Kurbitz present after 3:10 P.M. Mayor Larson'present and presiding after 3:20 P.M. . The Invocation was given by Councilman Brown. • . The minutes of the regular meeting of October 21, 1968, having been duly'certified accurate by two Council- men, and no one present wishing to have said minutes read publicly, Assistant Mayor Robinson declared said minutes approved as recorded. This being thetime fixed for the Hearing on Rezone Application filed by Mr. & Mrs. T.J. Williams, requesting rezone of property situated at 1607 W. Nob Hill Boulevard, and Assistant Mayor Robinson stating that this matter has been requested to be put over for one week, it was MOVED by Brown, seconded by Keith that the • Hearing on said Rezone' Application be continued for one week or until November 4,.1968: carried, Brown, Keith, Lambert and Robinson voting aye by voice vote. Kurbitz, Larson and McNeice absent. This being the time fixed for the Hearing on amending Ordinance No.' 1012 passed on March 11, 1968, and • Ordinance No. 1038 passed on June 24, 1968, providing for the Vacation of a portion of North 4th Street and certain alleys, as requested by Yakima Mall - Shopping Center Corporation, it was•MOVED by Brown, seconded by Lambert that Ordinance No. 1074 amending Ordinance No. 1012 and Ordinance No. 1038, providing for said Vacation and postponing. the effective date until May 1, 1969, be passed as read: carried, Brown, Keith, Lam - bert•and Robinson voting aye on roll call. ORDINANCE NO. 1074, AN ORDINANCE providing for the vacation of a portion of North 4th Street and certain. alleys in the City of- Yakima, Washington; amending Section 1 of Ordinance No. 1012 of the City of Yakima passed March 11, 1968, and Section 1 of Ordinance.No. 1038 of. the City of .Yakima passed June 24, 1968; and declaring an emergency. • • ' Councilman Kurbitz.present after 3:10 P.M. • A Damage Claim having been filed with the'City Clerk on October 21, 1968, by Mrs. Keith R. Matson; 2, Box 786, Selah, Washington, it was MOVED by Keith, seconded by Brown that said damage claim be referred to the City Manager and Staff for study and'recommendation: carried, Brown, Keith, 'Kurbitz, Lambert and Robin -. son voting aye by voice vote. Larson•and McNeice absent. . In accordance with action taken by the City Council on October 21, 1968, it was MOVED by Keith, seconded by Lambert that Ordinance No. 1075 relating to traffic regulations, regarding parking, speed limits and install- ing of parking meters on certain streets, be passed as read: carried, Brown, Keith, Kurbitz, Lambert and Robinson voting aye on roll call. Larson and McNeice absent. Public Works Director John Mayo explained • that this Ordinance amends the Yakima Municipal Code by removing parking on 16th Avenue from Nob Hill Boulevard to Fruitvale Boulevard and from Mead Avenue to Washington Avenue, and increases the speed limit to allow for a continuous 30 mile speed zone from Fruitvale Boulevard to Mead Avenue., and the installation of ' Ill' parking meters along the north side of East "B" Street from North 3rd Street to North 4th Street. He further explained that regarding the removing of parking between Mead Avenue and Nob Hill Boulevard, he had dis- cussed this matter with County Commissioner Angus McDonald and he is in full concurrence with the City. He stated that on the matter of installation of parking meters along the south side of•the Marquette campus, that this has been cleared with Parochial school officials. .After due discussion, it was MOVED by Keith, seconded by Lambert that Ordinance No. 1075 relating to traffic regulations and amending the Yakima Munici- pal Code, be passed as .read: carried, Brown, Keith,,Kurbitz, Lambert and Robinson voting aye on roll call. Larson and McNeice absent.. • ORDINANCE NO'. 1075, AN ORDINANCE relating to traffic regulations; regulating and restricting the stopping, standing and parking of motor vehicles; establishing speed limits on certain city streets; and amending Sections 9.28.060 (b) (3), 9.36.070 and 9.36.120 (b'). of the City of Yakima Municipal Code. • The City Engineer having reported the completion of L.I.D. No. 964, Dillon Addition i Others Domestic Water. District, it was MOVED by Lambert, seconded by Brown that the time for the Hearing on the assessment role for this District be fixed for November 25, 1968, and that the.City Clerk give due notice by publication and • • to each property owner as required by law: carried, Brown, Keith, Kurbitz, Lambert and Robinson voting aye by voice vote. Larson'and McNeice absent. . • City Manager McMicken referred to.the request of Robert L. Kaas, to assume the lease of J. A. Sellers of property at Yakima Municipal Airport- and stated that Mr..Kaas has withdrawn his request. No formal action was needed on this matter. . City Manager McMicken stated that a request has been received from Matt Hatzenbehler for Outside City domes- tic sewer service at 414 North 16th Avenue. Planning Director Bruce Finke explained that at the present time there are sewer_ lines located in North 16th Avenue and that at the time of installation arrangements were made to provide utility service to property owners without having to tear up the streets again. He further'. indicated that he feels this .would be the proper time to change the zoning in the Comprehensive Plan to R -3, Multiple Family Zone. Mr.'Finke stated that the Planning Commission and Staff are recommending to the Council that this outside hookup be allowed. Council members indicated that they are in favor of granting this request if the applicant signs the outside utility agreement. City Manager McMicken reported that the Outside Utility Agreement has been signed and that there is an attachment to the agreement which states that the applicant further agrees that the two residences recently moved unto this.property will be improved • according to regulations of the Yakima Municipal Building Code. After due discussion, it was MOVED by Brown, • seconded by Keith that the request of Matt Hatzenbehler for Outside City domestic sewer service be authorizes subject to the execution of the outside hookup agreement and.the other.conditions referred to therein: carried, Brown, Keith, Kurbitz, Lambert and Robinson voting aye by voice vote. Larson and McNeice absent. • • III Mayor Larson present and presiding after 3:20 P.M. City Manager McMicken requesting authorization for Detective Frank Claughton to attend the Northwest Check : • Investigators Seminar in Portland, Oregon, it was MOVED by Keith, seconded by Kurbitz that said travel be • allowed with expenses paid: carried, Brown, Keith, Kurbitz, Lambert, Larson and Robinson voting aye by voice vote. • City Manager McMicken referred to the matter of the request by Va -Alta, Inc., to construct a building within a utility easement. City Attorney Andrews explained that the Yakima City Council on February 5, 1968, passed Ordinance No. 997, vacating an alley and reserving a public utility easement through the vacated alley with a provision that no buildings may be constructed without prior approval of the City. He further explained that Va -Alta, Inc., now desires to construct a building within this easement. D -1269, A RESOLUTION consenting to the construction of a building by Va -Alta, Inc., within a public utility easement. - City Manager McMicken referred to the matter of the execution of an agreement with Wikstrom Motors, Inc., for the operation of an automobile rental business at the Yakima Municipal Airport, stating that although there are two automobile rental agencies at the Airport at the present time, there is room for this third operation. He further .stated that the agreement is the as executed with the other two automobiles rental agencies, with the termination date of the agreement being July, 1970. After due discussion, it was MOVED by Robinson, .seconded by Lambert that Resolution No. D -1270 authorizing the execution of an agreement with Wikstrom Motors, Inc., for the operation of an automobile rental business at the Yakima, Municipal Airport, be passed read: carried, Brown, Keith,. Kurbitz, Lambert, Larson and Robinson voting aye on roll'call. McNeice absent. • RESOLUTION NO. D- 1270, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an automobile rental business agreement with, and approving of a license to,', Wikstrom Motors, Inc., for the operation of an automobile rental business at the Yakima Mufti p 1 Airport. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Keith that we do now adjourn at hour of 3:30 P.M.: carried, Brown, Keith, Kurbitz., Lambert, Larson and Robinson voting aye by voice vote.
