The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert, McNeice and Robinson, Assistant City Manager Friedline and City Attorney Andrews, present on roll call. . . . . The Invocation was given by Councilman Lambert. The minutes of the regular meeting of October 14, 1968, having been duly certified accurate. by two Councilmen, and no one present wishing to have said minutes'-read publicly, Mayor Larson declared said_minutes approved as recorded. . ` . Before continuing with the regular Agenda, and Mayor Larson explaining that an Ordinance has been prepared by the City's Bond Attorneys, authorizing the.issuance and sale of $2,800,000.00 water -sewer revenue.bonds, to pay for water and sewer system improvements, it was MOVED by Brown, seconded by McNeice that Ordinance No. 1071 authorizing the issu- ance of $2;800.000 water - sewer revenue bonds.,. be passed as read: carried, Brown, Keith, -Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. . . • • ORDINANCE NO. 1071, AN ORDINANCE of the City of Yakima, Washington, authorizing the issu- ance of $2,800,000 principal amount'of water and sewer revenue bonds, of the City to pay part of the cost of carrying out a plan for the acquisition, construction: and installation of certain additions and improvements to and extensions of the combined water and sewerage system of the City specified and adopted in its Ordinance No. 986 passed.and'approved. January 2, 1968; providing that said bonds will be issued on a parity with certain out- standing water and sewer revenue bonds of the City; fixing the date, form, terms, maturi ties and covenants of said bonds to be issued; providing and adopting certain and protective features safeguarding the payment of•the principal of and interest on said bonds; authorizing the sale thereof; and declaring an emergency. . This being the time fixed for the Hearing on Rezone Application filed by Mr..and Mrs. T.J. Williams, - requesting rezone of: property situated at .16.07 W:. Nob. Hi11:Boulevard, and Mayor . Larson stating that this matte'r has. been requested. to, be: put' over -for one week; 'it was. Executrix for the Estate of Paul LaBissoniere,, requesting rezone of property situated at • 201 N. 32nd Avenue, i.t• was MOVED by, Keith, seconded by Brown that Ordinance No. 1072 accepting the recommendation Of the Planning Commission and rezoning said property, be passed as read. Planning Director,Bruce.Finke, explained that although the Planning Com- • mission recommended rezoning of this property,. th.e Staff. had .recommended denial, believing that the application, if granted, would amount to the granting of a spot zoning. He fur- . ther explained that the Planning-Staff feels: that in view of the General Plan and existing zoning pattern in the area which'provide.s ample!opportunities..for duplex development,' that this application - should, be denied. Mr's :: Rit .Rogers, Executrix. for the Estate of .Paul LaBissoniere, being present, spoke in favor/ he rezone being granted, stating that there are several other duplexes in the vicinity. Councilman Kurbitz stated that occasionally. the Council deviates from the rule of. not spot zoning. Councilman Lambert stated that she doesn't like to go against the recommendation of the Staff in rezone matters, but since the Planning Commission didn't seem to be specifically concerned about this being a spot_ • zone and recommended zoning. said property,' she.will accept its recommendation. Mayor Larson stated that he concurs with the statements made by Councilman Lambert. After due . discussion, Mayor Larson called for the roll call vote on the Motion to pass Ordinance No. 1072 accepting the recommendation of the Planning Commission and zoning said property and • it carried, Brown, Keith, Kurbitz, Lamber.t., McNeice and Robinson voting aye on roll . call.. . ORDINANCE No. 1072,_ AN ORDINANCE accepting the recommendation of the Planning Commission • and rezoning certain property situated at 201 North 32nd Avenue, in the City of Yakima, • Washington, from R -1, Single Family Zone, to R -2, Two Family Zone. It was MOVED by Robinson, seconded by McNeice that Ordinance No...1073 authorizing and directing the foreclosure -of delinquent irrigation maintenance assessments, be passed as • read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on .roll call. City Attorney Andrews explained that this is the first time that the City . Council has been called upon, under the new revised City Ordinance which completely re- vamped the procedure of levying the assessments, to pass an Ordinance authorizing this action., He'stated that this will be handled in the same manner as.delinquent construction _. - L.I.D. assessments. Mr. Andrews referred to a list of 147 parcels owing $4,843.37, which covers delinquent irrigation maintenance assessments for the years 1966; 1967 and 1968. He explained that there must now be another notice, and then there will be publication in the newspaper. He further explained that in the event people.don't pay and delinquency is declared by the Court, then the property is foreclosed upon and sold, but that the proper- ty owner does have a year in which to redeem his.property. . ORDINANCE NO. 1073, AN ORDINANCE .authorizing and directing the City Attorney of the City of Yakima to institute proceedings for foreclosure of delinquent irrigation maintenance • assessments. A request having been received from Robert L. Kaas, to assume the lease of J. A. Sellers, of property at the Yakima.Municipal Airport, and Mayor Larson requesting continuation of • this matter for one week, pursuant to a request from legal council, it was MOVED by Robin- son, seconded by Keith that said matter be_ continued for one week or until October 28, 1968: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. . 493 • • OCTOBER 21, 1968 Assistant City Manager Friedline reporting that it was necessary for the City to purchase a 12 inch tapping sleeve and valve for immediate installation for fire protection service to Decoto Aircraft, Inc., under - conditions which constituted an emergency so as to. justify the purchase of such material without calling for bids, it was MOVED by Robinson, seconded by Keith that Resolution No.'D -1267 authorizing the purchase of water supplies, without calling for bids, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Lar- son.,. McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1267, A RESOLUTION authorizing and ratifying the purchase of a 12 inch tapping sleeve and valve without calling for bids. • Assistant:City Manager Friedline referring to the proposition to approve Referendum 18, . Outdoor Recreation Bond Issue, that' will appear on the ballot at the General Election to be held November 5, 1968, and.urging the support of the City Council, it was MOVED by Brown, seconded by Lambert that Resolution No. D -1268 supporting .the passage of. Referendum 18, Outdoor Recreation Bond Issue, be passed as read: carried, Brown, Keith, Kurbitz,'Lam- • bert, Larson, McNeice and Robinson voting aye on roll call. RESOLUTION.. NO. D- 1268,'A RESOLUTION supporting the passage of Referendum 18, Outdoor Rec- reation Bond Issue, at the General Election to be held November 5, 1968. - I Assistant 'city Manager Friedline referred to the. Traffic Control Plan for 16th Avenue, as submitted by Public Works Director John Mayo. Mr. Mayo explained that there are. two main points that need..to •be considered regarding traffic control on the 16th Avenue Arterial'- - one being the parking situation and th'e other the matter of speed' limit, and the Yakima. Traffic Code will to be amended by Ordinance to cover these matters. He 'fur.ther stated that it is the recommendation the Public Works Director, Traffic Engineer, Chief of Police and Police Traffic Officer, jointly to: (1) By ordinance, remove all parking on.•l6th Avenue. from Fruitvale Boulevard to Washington Avenue (existing parking between Nob Hill Boulevard and Mead Avenue could be.allowed.to remain until. resurfacing of the street is scheduled so that the restriping would follow and thus eliminate the need for an.expen- -sive and removal of the existing striping pattern), and (2) by ordinance,. establish a 30 mile limit on 16th Avenue between Nob Hill Boulevard and Lincoln Avenue. Mr. Mayo indicated that if this action is favored by the - City . Council,' concurrence of the 'County Commissioners should be requested. Discussion by City Council members brought out the fact that it might not be desirable to remove all parking .on 16th Avenue at this_ time, by Ordinance, but only between Nob'Hill Boulevard and Lincoln Avenue, and later as traffic warrants, remove.it from other portions of 16th Avenue. After due discussion,. it. was suggested that legislation be prepared both ways to be considered by the City Council. • • There was some discussion traffic control and parking on various other streets, but no formal action was taken in these matters.. .There &being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Keith that we .do now adjourn-'at the hour 'of 9:15 P.M.: carried, Brown, Keith,• Kurbitz, Lambert,.
