HomeMy WebLinkAbout10/07/1968 Business Meeting r 485 OCTOBER 7, 196$ / The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call, having been excused at last meeting. The Invocation was given by Councilman Kurbitz.. The minutes of the regular meeting of September 30, 1968, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 616, filed by Decoto Aircraft, Inc., requesting annexation of property situated on the north side of W. Washington Avenue, it was MOVED by Brown, seconded by McNeice that said Ordinance No. 1064, annexing said, property, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and ' Robinson voting aye on roll call. Keith absent. . ORDINANCE NO. 1064, AN ORDINANCE annexing property to the City of Yakima, and zoning said property. This being the time fixed for the Hearing on Adoption of 1969 Budget, City Manager McMicken reported that the Preliminary Budget has been filed, the Hearing is now in order and has been published according to law. He further reported that Department Heads are present at this meeting to answer any questions. Mr. McMicken referred to the supplemental information which had been prepared showing some changes in the preliminary figures. He explained that there was an error in the Records Department in the amount of $1,000 which had inadvertently -been left out of the Part -time, Salaries and Wages, and another suggested addition was 52,72$ in Statewide Maintenance and Operation. These two changes would add $3,728 to the Budget. Mr. McMicken suggested. that $2,528 be taken from Statutory and General which would leave an increase in the Budget of 51,200, which will be raised by fines and utility taxes on the steam franchise which the City has extended to Pacific Power and Light Company for approximately seventy (70) users of the steam service which they manage in the Central Business District. Councilman Robinson requested an increase of 53,57$ to the Health Department, explaining that since we have no Health Department in the City of Yakima, our public health duties have been dis- charged by the Yakima County Health District4:,. He further explained that this amount will increase the amount alloted in the Preliminary Budget from $47,000 to 550,57$ which will permit 54,000 to be alloted to Sundown M. Ranch, this amount being the same as last year. Mr. Robinson indicated that since Sundown Ranch is an activity whibh is involved in the treatment of alcoholism, this is a community problem which must be supported by added funds. He further indicated that the only place that these additional requested funds may be obtained would be from the Statutory and General Division of the current expense fund. After due discussion, it was MOVED by Robinson, seconded by McNeice that when the Ordinance approving the 1969 Budget is prepared, that 53,57$ be added which would, make the total allocated to the Health Department, $50,57$: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. It was then MOVED by Robinson, seconded by Lambert that an Ordinance be prepared reflecting the suggested changes and adopting the Budget as the Final 1969 Budget: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. It was suggested that since the Ordinance adopting the Budget has to be read, that this be continued to Wednesday morning at 8:OO A.M. DAMAGE CLAIMS having been filed with the City Clerk on October 1, 1968, by Nettie G. Timpke, 1009 East Spruce and by Helen M. DeVoe, 313 South 7th Street, for damages caused when the automobile in which they were riding struck a pile of unleveled asphalt, it ' was MOVED by McNeice, seconded by Brown that these damages claims be referred to the City Manager and staff for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. In accordance with action taken by the City Council on September 30, 1968, and an Ordinance amending the Yakima Municipal Code to permit dancing on Sunday having been prepared, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 1065 relating to licenses and business regulations and amending the Yakima Municipal Code to permit dancing on Sundays, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. . ORDINANCE NO. 1065, AN ORDINANCE relating to licenses and business regulation; prohi- biting public dances and dancing in cabarets during certain hours and making exceptions to such prohibitions; and amending Subsection 5.2$.140 (1) of the City of Yakima Muni- cipal Code. In accordance with action taken by the City Council on September 23, 1968, and an. Ordinance having been prepared to make the appropriate amendment to the Yakima Municipal Code to change the method of applying sewer service charges outside the City, effective January 1, 1969, it was MOVED by Robinson, seconded by McNeice that Ordinance No. 1066 relating to public services and utilities, specifying rates and charges, and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. ORDINANCE NO. 1066, AN ORDINANCE relating to public services and utilities; specifying sewer service rates and charges to be effective commencing January 1, 1969; amending Sections 7.60.020, .030 and .050, and repealing Section 7.60.0$0, all of the City of Yakima Municipal Code. . It was MOVED by Brown, seconded by Lambert that Ordinance No. 1067 increasing the penalty for the conviction of a misdemeanor and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson,, McNeice and Robinson voting aye -on roll call. Keith absent. City Attorney Andrews explained that for years the jurisdictional limits of the penalty for a violation of the Penal Code, has been a fine of not more than $300 or by imprisonment in the City Jail for not more than 90 days, or by both. He further explained that recent legislature increased the amount of penalty, but the Yakima Municipal Code was never amended to correspond with the legislative change and this Ordinance increases the jurisdictional limits of the penalty for a violation of the Penal 486 OCTOBER 7, 196$ . • Code to 3500, or by imprisonment for not more than six months, or both. • ORDINANCE NO. 1067, amending Section 6.04.595 of the City of Yakima Municipal Code; increasing the penalty for a violation of Chapter 6.04 of said Yakima Municipal Code. . A report having been received from the Planning Commission on-Rezone Application filed by Rita Rogers, Executrix; Estate of Paul J. LaBissioniere, requesting rezone of property situated at 201 North 32nd Avenue, it was MOVED by McNeice, seconded by Brown that October 21, 1968, be set as the time for a hearing by the City Council on the matter of the of certain real property as requested by said applicant, and that the City Clerk give notice of such hearing as required by law: carried, Brown, Kurbitz, Lambert, Larson;;., McNeice.and Robinson voting aye by voice vote. Keith.absent. A report having been received from the City Engineer on the completion of L.I.D. No. 962, Englewood Heights and Chalet Mall Domestic Water District, it was MOVED by Lambert, seconded by Robinson that November 4, 1968, be fixed as the time of hearing on the assess- ment roll for this district, and that the City Clerk give due notice of publication and to each property•owner as provided by law: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. The thirty day legal limit for protests to be filed, having expired October 5, 1968, on . L.I.D. No. 972, North and South First Street Water District the City Engineer submitted a report giving the percentage of protests received on various portions of the L.I.D. Mr. Charles "Ken" Behrens Manager of Bekins,.was present stating that the cost was more than they expected and since they do have their own water,, requested that parcel seven be excluded from L.I.D. No. 972, Public Works Director, John Mayo, stated.that this was the only protest on this portion of the L.I.D. and the percentage of protest is 1$% which_ is not enough to require this parcel to be deleted, but that Bekins could be deleted without affecting the L.I.D. Council members indicating they.felt that deleting the•Bekins pro - perty the L.I.D..will not be affected in any way, it was MOVED by'Robinson, seconded by Lambert that parcel seven be deleted from L.I.D. No. 972, North and South First - Street Water District; carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. On the South First Street and Washington Avenue portion of L.I.D. 972,John Mayo explained that the protests on parcels 21 -27 and 11 & 13,. amounted .to 37% and a written protest was'filed on this date with the City Clerk by Alfred Pitts, requesting that his property be also deleted, which would bring the percentage of protests to a oxUnately 41%. Mr. J.W. McCardle and Mr. Douglas Wilson, representing several property owners, who had filed a written protest, explained that they had been in favor of being included in this L.I.D. until the estimated assessment costs were received, and now • feel that the costs are way too high compared to the benefits they will receive. Alfred Pitts,who had filed a written protest,was also present and asked to be deleted from this district. Council members indicated that although.they would prefer that no one be deleted from an L.I.D., that since deleting all of this property that has been protested does not affect the L.I..D. costs to the other property owners included in. the L.I.D., they would recommend deleting said property. . After due discussion, it was MOVED by Robinson, seconded by Brown that all the area represented by the property owners, pro - testing in writing being included in L.I.D. No. 972, North and South First Street Water District, be deleted from this district: carried, Brown, Kurrbitz,Lanibert, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken referred to the matter of the Vacation of 4th Street between Yakima Avenue and "A" Street and indicated that the effective date of said vacation should be postponed until May 1, 1969. He explained that Ordinance No. 1012, passed March 11,• 1968, as amended by Ordinance No 1038, passed June 24, 1968, providing for said vacation needs to be amended accordingly, and that notice should be given and a public hearing should'be held to accomplish such amendment. It was MOVED by Brown, seconded by Robinson that Resolution Na. D -1262 fixing October 28, 1968, as the time for a hearing by the City Council on the amendment of.Ordinance No. 1012 as amended by Ordinance No. 1038, vacating a portion of North 4th Street and certain alleys, to provide that such vacation shall be effective on May 1, 1969, be passed as read: carried, Brown, Kurbitz, Lambert, Larson,, McNeice and Robinson voting aye on roll call. City Manager McMicken explaining that the United Good Neighbors Fund, in connection with its annual campaign to solicit charitable contributions, has requested permission to temporarily erect . a billboard on the public sidewalk on East Yakima Avenue adjacent to the old Masonic Temple, and recommending that a revocable Permit for the erection of said U.G.N, sign be issued, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1263 authorizing the temporary erection of a billboard on the public sidewalk by United Good Neighbors Fund, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on.roll call.
