HomeMy WebLinkAbout09/16/1968 Business Meeting r . 47 7. • SEPTEMBER 16, 1968 . The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, McNeice and Robinson,. City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Keith and Lambert absent on roll call, having been excused at the previous meet- ing . The Invocation was given by City Manager McMicken. • The minutes of the regular meeting of September 9, 1968, having been duly certified accur- ate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 613, filed by Yakima Fruit and Cold Storage Company, requesting Vacation of the west 10 feet of North 1st Avenue, having been continued from previous meetings of September 3 and 16, 1968, and City Manager McMicken , reporting that the applicant has asked for a further two week delay, it was MOVED by Robinson, seconded by Brown that this matter be continued for two weeks or until Septem- • ber 30, 1968: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice, vote. Keith and Lambert absent. The Mayor's Committee on Human Rights, recommending the passage. of an Ordinance relating to Fair Housing, Mr. Johnnie Rance, Chairman of the Housing Subcommittee, presented the proposed ordinance to the Council. He stated that City Attorney Andrews had worked very, closely with them in preparing this proposed ordinance. He further reported that 22 cities in the State of Washington have passed similar ordinances and parts of some of the ordi- nances of some of these cities have been used in the preparation of the proposed ordinance for the City of Yakima. Mr.' Rance reported that copies of the proposed Fair. Housing ordi- nance have been given to Board members of the Mayor's Committee on Human Rights, to Real • . Estate people, to the League of Women Voters, and others for study and recommendation.. Mr. Joe Krieger and others representing some of theReal Estate people, indicated they. had received this proposedr:ordinance on•'this' date and_in the short time they have had to read it are in favor of such an ordinance, but would like to study it further. Mrs. Tak Kondo, President of the League of Women Voters, commended the Mayor's Committee on Human Rights for their work on this matter,, and stated that the League of Women are hoping to have. some time to study the proposed ordinance. Councilmen indicating that because the, -proposed Housing Ordinance has been in their hands only a short time and that two members of the Council are absent from this meeting, they feel more time is needed to study the matter. After due discussion, it was MOVED'by Robinson, seconded by McNeice. that the matter of the proposed ordinance relating to Fair Housing be continued for two weeks or until September 30, 1968: carried, Brown, Kurbitz, Larson,.McNeice and Robinson, voting aye by voice vote. Keith and Lambert absent. • City Manager McMicken reported that the matter of Planning Commission's.Report on the rehearing on rezone application' filed by Wallace R. Klingele, 2906 W. Nob Hill Boulevard, having been continued from the previous meeting of. September 9, 1968, so that the Planning Department could contact Mr. Klingele to see if he additional information to pre- sent regarding his rezone request, the Planning Department reported they contacted Mr. Klingele and •he indicated that he has no additional information to present. ..After due . discussion, it was MOVED by Brown; seconded McNeice.that September 30, 1968 be set as the :time for a hearing by the• Council on the matter of the .rezone of certain real property as requested by Wallace R. Klingele, and that the City Clerk give notice of such hearing as required by law: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by'.voice vote. Keith and Lambert absent. . City Manager McMicken reported that a Resolution adopting.the 1969 Preliminary Budget and setting a date for hearing on,the adoption of the Final 1969 Budget has been prepared for the consideration of the Council. After due discussion, it was MOVED by Brown, seconded by Robinson that Resolution No. D -1253 adopting the 1969 Preliminary Budget for the City of Yakima, setting October 7, 196.8., as . the date for hearing on the adoption of the Final,. 1969 Budget, and directing the City Clerk to give notices of Budget proceedings, be passed as read: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye on roll call., • Keith and Lambert absent. RESOLUTION NO. D -1253, A RESOLUTION adopting the 1969 Preliminary Budget for the City of Yakima,.setting a date for hearing on the adoption of the Final 1969 Budget, and directing the City Clerk to give notices of Budget proceedings. • In accordance with action taken by the•Council on September 9, 1968, on the matter of the Petition requesting passage of an Ordinance to limit Firemen's duty hours to 42 hours per • week, City Manager McMicken reported that the proper legislation has been prepared to sub- mit this matter to a vote of the people at the General Election on November 5,, 1968. City • Attorney Andrews again explained that the. City. Charter provides that when the City Clerk has certified that a sufficient number of qualified electors have signed a Petition, as had been done on the Petition filed by the Firemen, then the Council must do one of two things. They must either pass the Ordinance as it has been proposed, without alteration,, or submit it to a popular vote of the people at a special election to be called by the • Council and held by the County Auditor. Councilman Robinson again indicated that he is !not in favor of passing the proposed Ordinance, as it will cost the City a great deal_ - money and would hope the people will vote it down. After further discussion, it was MOVED by Brown, seconded by McNeice that Resolution No. D -1254 submitting to the electors of the City of Yakima at a Special Election, a proposition as to whether hours of work for fire- men shall be limited to 42 hours a week, be passed as read: carried, Brown, Kurbitz, Larson McNeice and Robinson voting aye on roll .call. Keith and Lambert absent. • • 478 • SEPTEMBER 16, 1968. • RESOLUTION NO. D -1254, A RESOLUTION providing for the submission to the electors of the • . City of Yakima, Washington,.•at'a election, of a proposition ' as - to whether hours of work* for Yakima firemen and certain other Fire Department employees shall be limited to .forty -two hours a week, computed annually, commencing 1,'1971,.without causing a salary reduction and without reduction in overtime or call pay; and,requesting the Auditor of Yakima County, Washington,.to hold a special election. City. Manager McMicken reporting that it is necessary to make a temporary loan of $60;000 . from the Water -Sewer Fund to the Airport Improvement Fund in order to'make contractor pay- ments when required in September, because Federal Aviation Agency participation funds will . not become available by that time, it was MOVED by Robinson, seconded by McNeice that Resolution No: D -1255 authorizing said temporary loan of $60,000 from the Water -Sewer Fund to the Airport Improvement Fund, be passed as'read: carried, Brown, Kurbitz, Larson, • • McNeice and Robinson voting aye on roll call. D- 1255, A RESOLUTION authorizing a temporary loan of $60,000 from 520, • Water -Sewer Fund, to 912, Airport Improvement Fund, and providing.for City Manager McMicken reported that in accordance with action taken by the Council on August 19,.1968, when they appointed some additional City Library Board members, this • • • group has met and authorized the transfer of the remainder of the A. E. Larson Fund to the • Yakima Valley Library for the a bookmobile and other capital improve- ments. After due discussion, it was MOVED by Brown, seconded by McNeice that Resolution. No. D -1256 authorizing the expenditure of $14,345 from the A. E. Larson Library Fund, be passed as read: . carried, Brown, Kurbitz,• Larson, • McNeice and Robinson voting aye on roll call. Keith and Lambert absent. • RESOLUTION NO. D- 1256, A RESOLUTION authorizing the expenditure of $14,345.00 from the A. E. Larson Library Fund of. the City of Yakima. City Manager McMicken reported that the Damage Claim filed by Wayne Gaffney, 2709 West - Chestnut Avenue, in the amount of,$1,579.:86Lfor' damages caused by water escaping from a broken irrigation line and flooding the basement of his home, had been investigated by the Staff, and the City Attorney's office has consulted with Mr. Gaffney and made a counter -offer of full settlement in the amount of $650, and he has agreed to accept this amount. It was then MOVED by McNeice, seconded by Brown that Resolution No. D -1257 authorizing the payment of said claim for damages in the amount of $650 to Mr. Wayne Gaffney, be passed as read: carried, Brown, Kurbitz, Larson, McNeice and.Robinson voting .aye on roll call. RESOLUTION NO D -1257, A 'RESOLUTION authorizing the payment.'of a claim for damages filed against the City of Yakima by Wayne Gaffney. . • City Manager McMicken referred to the matter of the request by Mr..Leroy Dennington to • • amend the Yakima Municipal Code to permit dancing on Sundays, which had been continued from September 3,_1968, so that further investigation could be made. Police Chief Madden reported that he had been asked about the number of places that now liquor on Sundays that would have dancing, should it be allowed, and stated this is rather. difficult to report, as some of the places do not have facilities for dancing, and some other places might open on Sundays that are now closed, if dancing is allowed. He stated that there have not been any particular policing problems in connection with the sale of liquor on .Sundays, and does not feel that there will be any, if dancing is allowed in the places • • that serve liquor on Sundays. He stated he questions the advisability of allowing public dancing on Sundays. Council members asked Chief Madden if he knew of other. Cities where •• dancing is allowed on Sundays, both public dances and in cabarets. 'Chief Madden stated that he will write to Police Chiefs-in other First Class cities' and ask for informa- • tion on this matter. Mr. Dennington was present and indicated that he will get opinions • from additional places of_ business, private clubs, hotels, etc., regarding the matter of dancing on Sunday. After due discussion, it was MOVED by Robinson, seconded by McNeice that the matter of amending the Yakima Municipal Code to permit dancing on Sundays, be continued for two weeks until. September 30, 1968, to allow further study and investigation: carried,•Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert absent: ' • • City Manager McMicken reported that a request had been made by United Builders for outside domestic water and sewer service for Sun Park Subdivision. He stated that the applicant has agreed to sign the standard outside utility agreement form, including special condi tions. Mr. McMicken stated that we. are trying to make development outside the City con form with the same standards inside the City and for that purpose we require that. certain buildings be brought up to the Building Code. He reported that in this particular case, the land is vacant; however, any future construction which will occur on this subdivision, will be required to have a permit taken out and a complete inspection made just as if it were inside the City, and in addition there were requirements made regarding the develop- ment of the land. He further reported that one of the standard conditions in the agree- ment. is that the property will annex when it becomes contiguous and this agreement is filed . with the County Auditor and is binding to all future property owners. Mr. McMicken stated that. inspection of the property indicated that Nob Hill water pipes are on three sides and it was suggested that the applicant request service from the Nob Hill Water Company, which has now been worked out with them. Mr. McMicken further stated that a recommendation has been received from the Planning Commission to zone this property all R -1, Single Family residences. After due. discussion, it was MOVED by Robinson, seconded by Brown that the outside sewer service for Sun Park Subdivision be authorized: carried, Brown, Kurbitz, • Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert absent. • 479 • • SEPTEMBER 16, 1968 City Manager McMicken requesting authorization for Airport Manager Jim Eakin to travel to • Sun Valley, Idaho, to attend a meeting where he will participate. in the 'program explaining' the results of the suggestion box used at the Yakima Municipal Airport, it was MOVED by • Kurbitz, seconded by McNeice that said travel be allowed with expenses paid: carried,. Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert • absent. Councilman Robinson stated that it has been brought to his attention that there is a • traffic hazard to children on Fair Avenue, because there are no sidewalks on either side of the road. He indicated that he feels some kind of study should be made of this situa- tion and that possibly some sort of hard surfaced material could be put on one side of the street where the children can walk instead of having to walk on the road.- City Manager' McMicken indicated that this matter will be investigated.• • Councilman Brown, asking to be excused from the next meeting on September 23, 1968, as he • will be out of town, it was MOVED by McNeice, seconded by Kurbitz that he•be.excused: carried, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote.
