HomeMy WebLinkAbout09/09/1968 Business Meeting r 1 • 473 I I SEPTEMBER 9, 1968 The City Council met in regular session, Mayor Larson -presiding, Councilmen Brown, Keith, Kurbitz, Lambert, McNeice and Robinson, City - Manager McMicken and City Attorney present, on roll call. . The Invocation was given by Councilman Brown. The minutes of the regular meeting of September 3, 1968, having been duly certified ac curate by two Councilmen, and no one present wishing to have said minutes read publicly„ Mayor Larson declared said minutes approved as recorded. City Manager McMicken reported that all last winter and spring, a Course,' "Technique of, Municipal Administration," was attended by fifteen students composed of City Department Heads, some County government people,;; the Health Officer, City Engineer of Selah and Administrative Assistant from Ellensburg,. .He further stated that because they did have experts from many different lines, the course was most interesting and informative, and l that those who successfully completed the course and passed a written examination, will, receive certificates presented by.the Mayor today. Mayor Larson' commended those present • for taking the time to attend this course and presented the certificates of completion.' He especially commended Dr. Leland Harris for being the only one to receive. an A grade on his written examination. • A Petition requesting passage. of Ordinance to limit Firemen's duty hours not to exceed 42 hours per week, having been filed with the City Clerk on September 4,. 1968, by Ken Groth, et al, and having been certified•by the City Clerk that a sufficient number of 1 qualified electors have signed said Petition, City Attorney. FredAndrews. explained that, the City Charter provides that ,the City Council either pass the Ordinance as dt has been . proposed, without alteration, or submit it to a popular vote of the people. Councilmani Robinson stated that he feels this matter has a great potential of.costing the City a lot more money, as it specifically provides there would be no reduction of monthly salaries and would cut the hours from 56 to 42, which would mean hiring more :men He • further indicated that he feels that the cost alone is so severe that he would 'not be in favor of its adoption by -the Council-as such._ After further discussion,. it was MOVED by Robinson, seconded by Lambert, that this matter be referred to the City Manager and Staff and that the proper legislation be prepared and submitted to the Council at the next meeting on September 16, 1968, to submit this matter to a vote of the people at the General Election on November 5, 1968: •carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson, voting - aye by vote': In accordance with action taken by the City Council on- August 26, 1968, and a Motion hav ing been passed on that date disapproving the recommendation of the Planning, Commission' to rezone property :-.situated at 16.07 West Nob Hill Boulevard, as requested by T.;J. and Josephine Williams, and referring this matter back to the Planning Commission for its reconsideration, the Planning Commission reported that on re- hearing said matterat thee, regular meeting of September 3, reversed its original decision and denied the re quest for rezone.. Mr. Lloyd Hammerstad, representing the Williams', requested that this matter be referred back to the Planning Commission, as his clients have gatheredisigna -I tures of neighbors wishing this rezone granted and had planned to present this new infor- mation to the Planning,Commission at its rehearing of the matter. He further reported that they did not receive any notification of the Planning Commission meeting; but that after it was over, they received notification that the Planning Commission had reheard the matter, reversed its previous decision. and denied the rezone request, and had sent the information back to the City Council for final action. Council members asked the City Attorney if, legally, this matter can be referred back to the Planning Commission for further "report before final action by the Council. City Attorney Andrews explained' that the recommendation or review by the Planning Commission having been accomplished, all requirements of the law have been satisfied. -He-further . stated that theIregular procedure is that the Council now hold its final hearing, but would not preclude : the setting of this final hearing after_a further hearing by_ the Planning Commission should, the. Council decide to refer the matter back to the Planning Commission. Councilmembers indicated that although they realize all legal conditions have been met, they feel that the applicants should have an opportunity to present any new information to the .Planning Commission, since they were not notified of the Planning Commission meeting held!on September 3, 1968, and did not get a• chance to present this material before a report was • made to the Council. After due discussion, it was MOVED by Robinson, seconded by Keith, that the Council invite the Planning Commission to consider the matter of said rezone at • its. next regular meeting of October 1, 1968, before the Council has its final hearing: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson all'votingHaye by voice vote. • In accordance with action taken by the City Council on August 26, 1968, and a Motion having been passed on that date, disapproving the recommendation of the Planning;Commis- • sion to rezone - property situated at 2906 West.Nob Hill.Boulevard, as requested by Wallace. R. Klingele-, and referring this matter back'to the Planning Commission for its reconsider- ation, the Planning Commission reported that on rehearing said matter at theiregular meet- ing of September 3,1968, reversed itsoriginal.decision and denied the request for -,, zone. There being no one present at this meeting to speak to this matter, and Council members indicating that Mr. Klingele may not havebeen notified of the Planning Commission • Meeting of September 3, 1968, and may have misunderstood that he could appearto, give further information, it was MOVED:by Kurbitz, seconded by McNeice, that this matter be continued for one week until September 16, 1968; that Mr. Klingele be contacted and if he indicates that he did not misunderstand,.then the Council take proper action at that, • time: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Lambert voting nay by voice vote. • A letter of resignation from the Planning Commission, having been received from Dr. M.D Weinberg, and there being no action required by the Council, it was' MOVED"byRobinson, . seconded by Brown, that a letter expressing thanks and appreciation for his manyyears of service with the Planning Commission, be sent to Dr. Weinberg: carried, Brown;: - Keith, Kurbitz La'mbert,:Lars'bn, McNeice and Robinson voting aye by voice vote. • 474 . - . City Manager McMicken explained that the City Council has previously authorized the ex- tension of City water and sewer service to Desoto Aircraft, Inc., which property is presently in the process of being annexed to the City. He further explained'that Decoto Aircraft, Inc. has requested the use of the new Utility Connection Agreement,Installment Contract to pay the $4,156.00 in ten equal .installments, the cost broken down being $2,120.00 for the water and $2,036 for the sewer. After due discussion, it Was 'MOVED by Robinson, seconded by McNeice, that Resolution No. D -1251 authorizing installment payments of connection charges by Decoto Aircraft, Inc., be passed as read: carried, • Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson all voting aye on roll call. Mr. McMicken explained that normally, requests to pay utility connections by' this Install- ment Contract will be done administratively for residents within the City Limits, authorization by the City Council is needed on this matter,. since Decoto Aircraft, Inc.,, as yet, is outside the City limits. RESOLUTION NO. D -1251, A RESOLUTION authorizing installment payments of connection . charges .by Decoto Aircraft, Inc. . City Manager McMicken referred to the supplemental information to the Six Year Arterial Street Program stating that it is necessary each year to update said program. Public Works Director, John Mayo, explained that the Revised Code of Washington, provides that each year the six year construction program shall be updated and filed with the Urban Arterial Board, and an updated Six Year Construction Program, which is in accord with the Arterial Street Classification Program, has been prepared. After due discussion, it was MOVED by Robinson, seconded by Brown, that Resolution No. D -1252 adopting a SIXI YEAR CONSTRUCTION PROGRAM for the period of 1969 to 1974 for construction ofLstreets and arterial streets in the City'of Yakima,'be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson all voting aye on roll call. RESOLUTION NO. D -1252, A RESOLUTION adopting a•SIX °YEAR CONSTRUCTION PROGRAM, for the period of 1969 to 1974 for construction of streets and arterial streets in the City of Yakima. ** INADVERTENTLY LEFT OUT - SEE PAGE 476. • City Manager McMicken reported that there had been some used furniture available from . �9 . . 476 SEPTEMBER 9, 1968 ' the Yakima Municipal Airport, but that all has been distributed to:erious City offices and other offices at the Airport, and as a result, there is now no surplus furniture. City Manager McMicken requesting 'that authorization be given for the Fire Chief Jules Shockley and Battalian Chief Nels Lindberg, to travel to Cornelius, Oregon to inspect the Snorkel before it is painted, with expenses of $8.00 and $6.00 paid.
