It was MOVED by Robinson, seconded)by Brown that Councilman Kurbitz be excused from this meeting: carried, Brown, Keith, Lambert, • Larson, McNeice and Robinson voting aye by voice vote. The Invocation was given by Councilman Lambert. Ilr The minutes of the regular meeting of August 26, 1968, having been duly certified accurate by two Councilmen, and no one present wishing.to have said minutes read publicly; Mayor• Larson declared said minutes approved as recorded. 1 1 This being the time fixed for a Hearing on Resolution No. D -1241, a resolution.of inten'� tion to improve property by the construction water mains, in accordance with Petitions No. 580 and 582, and there being no protests filed in writing as of this date, it was MOVED by Brown; seconded by Lambert that.Ordinance No. 1062, creating L.I.D. No.i972, North • and South First Street Water,.District; be passed as read. Public Works Direc;torJohn explained that all. costs and all of the expenses of this L.I.D. are figured and the people are being assessed on the basis of a 6 -inch main, and the City is picking up 'the net diff- erence in cost between a 6 -inch main and whatever size main is put in, which ;in some places is a 12 -inch, 24 -inch or 48 -inch. Mr. Alfred H. Pitt, property owner on the south side of West Washington Avenue, being present, asked how property is assessed. He halls two lots g g P � adjoining and was charged a basic charge of $200 per lot, explained John Mayo, because there are two different types of 'buildings or businesses. Mr. .Mayo further explained that if one commercial operation is on several parcels, under one ownership, there is one $200 . basic fee charge. Mr. Pitt stated that he wishes his property deleted from this;proposed district, that at the present time he doesn't wish to hook up with.the water, that he does • not protest .the_improvement, but wants to wait and hook up and pay his charges when he is ready to do so. He also stated that he did not sign a. petition to be included it a dis- trict. Mr. Mayo _stated that they did the best they could in forming a local district, to include all the people indicating an interest in forming an L.I.D. 4e explained that the watermain will be installed all along these streets, which: makes the system available in the street for those not involved in this L.I.D., to hook; on;at a later time and at that time they will be charged for this service. Councilman Robinson stated that we have on occasion deleted some property from a district, when an area is at the end of said district, which could be done without affecting the project, but where it is in the middle of the proposed district, all property should be included. He further, stated that he feels that Mr. Pitt's assessment ought to be re- computed to charge a basic fee of $200 on the two lots, as being under one ownership. -Mr. Eldon Graves land : Mr. John .Krush, property owners in this vicinity, being present, spoke against being included in this district, stating they feel the charges are too high. Mr. George Hirahara,!owner of the Pancake House on South First Street, being present, asked how much of his property is included in this proposed District and was informed that it includes only the parcel of' . land on which the Pancake House is situated, not any of his other property. ; Mr.;Pitts again spoke protesting being included in this district and asking to be deleted. Council- man Robinson explained that Mr. Pitts and any others wishing to do so, have thirty days! in which to file a written protest and if 60% of the assessed valuation of a portion of'. the district, is received in protests, that portion can be taken out of the L.I.D. After further discussion, it was MOVED by Robinson, seconded by Keith that when the City Council meets as a Board of Equalization, that Lots 2 and 3, (parcels 9 & 10), be treated as one . lot, deleting one $200 charge, for the property owner Mr..Pitts: carried, Brown,Keith,' . Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz absent.; Council members indicated that in the future, before drawing up boundaries of an L.I.iD.,'that.all property owners to be affected should be contacted directly. After due discussion, Mayor Larson called for the roll call vote on the Motion to pass Ordinance No. 1062 creating . L.I.D. No. 972, North and South First Street Water District, and it carried,iBrown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz absent.•'Council- man McNeice stated he is voting aye with some reservations, and other Council members indicated that they wish to be sure that in the future property owners are directly con- . tatted. ORDINANCE NO. 1062, AN ORDINANCE providing for the improvement of certain property by con- structing the necessary mains, fire hydrants, valves and other appurtenances forthe pur- pose of supplying water for domestic use and fire protection; establishing a Local Improve- ment District, providing for the method of payment thereof, and creating a special fund This being the time fixed for the Hearing on Petition No. 613, filed by Yakima Fruit & Cold Storage Company, requesting Vacation of the west 10 feet of N. 1st Avenue, and the City Manager McMicken stating that more time is needed to get all the information on this matter, it was MOVED by Robinson, seconded by Lambert that said Hearing be continued to', September 16, 1968: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson;voting' aye by voice vote. Kurbitz absent. i I/ Petition No 623, having been filed with the City Clerk on August 23, 1968, by Elizabeth and Don McArthur & Others, requesting improvement of property by the paving of the alley between 16th and 15th Avenues - in•Block 1 of Ray's Nob Hill Addition, it was MOVED by Lambert, seconded by McNeice that Petition No. 623, for the, creation of a LocaLJmprove,, ment District, be referred to the City Manager. and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken introduced two new members of the Planning Staff, Mr. Bruce Finke, • Director of Planning and Community Development, and Mr. Homer Matson; Associate Planner, who will also be working for the Department of Planning and Community Development; both • started in their respective positions on September 3, 1968. Mr. McMicken further stated 1 that Ed Loidhamer, Acting Planning Director for the past several months, has "given good leadership in Planning Department matters, which is appreciated.by the Staff. • City Manager McMicken reported that in accordance with Statute, the. Preliminary Budget for 1969 has been duly filed with the Mayor and Councilmen for their consideration. He further stated that the staff is ready to meet with Council members and consider any suggestions . that they may have. • City Manager McMicken reported that Petition No.. 621, filed by Harold Sanford, requesting Vacation of easements, Lots 7 & 8, H View Courts Addition,- having been referred to the Staff at the Council Meeting on August 26, 1968, and the Staff recommending the Vacation • of said easements, it was MOVED by Robinson, seconded. by Brown that Resolution No. D -1249 vacating public utility' easements in High View Courts Addition, be passed as read: carried, • Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz absent. • • RESOLUTION NO. D -1249, A RESOLUTION vacating public utility easements in 'High View Courts Addition to the City of Yakima. • • City Manager McMicken referred to the matter of the. Petition requesting a change in a City . Ordinance to permit dancing on Sunday, as filed by LeRoy Dennington & Others, and in • accordance with action taken by the Council 'on August 19,1968, and the matter having been referred to the Staff, Police Chief Madden has recommended that there be no change made in • the Yakima Municipal Code to allow dancing on Sundays. Mr. McMicken stated that Chief Madden reported that there have not been any problems with drinking on Sundays, but still feels that there "would be'a possibility of problems if dancing were allowed, and that possibly more policemen would have to be on duty. Mr. Dennington, being present, again • • .spoke in favor of changing the Ordinance to allow dancing on Sunday, stating•that he feels there would not be any additional problems in allowing dancing as well as sale of liquor on Sundays. Councilman Robinson stated that the original reason for the'passage of • a City Ordinance prohibiting dancing on Sundays; was because it was felt that more Police help would be required," and since the Police Chief reports there have been no problems ,regarding the sale of liquor on Sundays, that he.would like to see this matter continued .and further investigated. Councilman Lambert stated that she feels that this, is fair type of :amendment and is in favor of amending the Ordinance to allow dancing on - Sundays. After due discussion, it was MOVED by Robinson, seconded by Lambert 'this matter be continued for two weeks or until September 16, 1968, so that further investigation can be made:•carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. ' Councilman Brown stated' that he would like to have a report - 'as . to how many of the establishments that allow drinking on Sundays, would also•have dancing'if it were permitted. • City.Manager McMicken referred to the Outside Utility - Agreement`= Proposed Revision, and Council members indicating that they would like to have this matter continued, it was . MOVED by Robinson, seconded by McNeice that the matter of the proposed Outside Utility Agreement - proposed Revision, be continued one week. or until September 9, 1968: carried, • . ' Brown, Keith,. City Manager McMicken reported that bids were received and considered by'aBid Board.on August 29, 1968, on the Washington Avenue'16" Watermain, S. 3rd Avenue to'S. 1st Street, as follows: . . DeBlasio Construction Co., Inc. $103,254.88. Bill's Septic 109,073.44 • • The City Engineer recommending that DeBlasio Construction Co., Inc., having submitted the <. low bid, be awarded the contract, it was MOVED by . Robinson, seconded by Keith that the recommendation of the City Engineer be accepted and that the bid be awarded to DeBlasio Construction Co., `Inc., in the amount of $103,254.88,• and that the City Manager be and. - is hereby authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Brown, Keith, Lambert, Larson, McNeice and voting aye by voice vote. Kurbitz absent. • City Manager McMicken requesting authorization. for Purchasing Agent Kermit Smith, to attend a Buyers' Conference in Victoria, B. C., .it was MOVED 'by Robinson, seconded by.
