HomeMy WebLinkAbout08/05/1968 Business Meeting r 457 AUGUST 5, 1968 The City Council met in regular session, Assistant Mayor Robinson presiding, Councilmen Brown, Keith, Lambert and McNeice, City Manager McMicken and City Attorney Andrews present on roll call. Mayor Larson and Councilman Kurbitz absent on roll call. (Council- man Kurbitz present after. 3:20 p.m.) (Mayor Larson confined to hospital as helwas in automobile accident on July 29, 1968) • The Invocation was given by Councilman Lambert. The minutes of the regular meeting of July 29, 1968 having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Assis!- tant Mayor Robinson. declared said minutes approved as recorded. This being the time fixed for a Hearing on Resolution No. D -1232, a resolution of inten- tion to improve property by the construction of curbs, gutters, sidewalks and of portions of streets on North 56th and Summitview Avenues, in accordance with Peti- tions No. 584 and 585, and there being one protest received in writing, it was MOVED by Lambert, seconded by Keith, that Ordinance No. 1053 creating L.I.D. No. 969, Summit - view Avenue and North 56th Avenue Arterial Improvement, be passed as read. Public Works Director John Mayo explained that six lots in this intended L.I.D. are outside the City Limits and that protests are figured separately on the property inside the City Limits as well as outside the City Limits. He further explained that the protest filed with the City Clerk on July 30, 1968,.by Lyle Washburn, Lot 10, Valley Vale Addition, rep- resents about 15% of the assessed valuation of the property outside the City Limits. After due discussion, Assistant Mayor Robinson called for the roll call vote on the Motion to pass Ordinance No. 1053 creating said district and it carried, Keith, Lambert, McNeice and Robinson voting aye on roll call. Kurbitz and Larson absent. Brown not voting because of a conflict of interests. . ORDINANCE NO. 1053, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concretecurbs, gutters and sidewalks, together with necessary drainage features; establishing a Local Improvement District, providing for the method. of payment thereof, and creating a. special fund. _ HowardHettinger, Attorney, representing Decoto Aircraft, Inc. on two matters on the agenda, being present; City Manager McMicken suggest:e d, these matters be brought before the Council at this time. Petition No. 616, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on this date by Howard Hettinger, Attorney, representing Decoto Aircraft, Inc., requesting annexation of property situated on the north side of West Washington Avenue, it was MOVED by Keith, seconded by McNeice, that thisidate be set as the time for a meeting with Mr. Hettinger, who represents the initiating party who signed the Notice of Intention to Commence Annexation Proceedings dated March 6, 1968: carried, Brown, Keith, Lambert, McNeice and Robinson voting aye by voice vote. Kurbitz and Larson absent. Mr. Hettinger, indicating that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by petition no. 616 (Notice of Inten -. tion to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above Motion was made by Keith, seconded by Brown and carried, Brown, Keith, Lambert, McNeice and Robinson voting aye by voice vote. Kurbitz and Larson absent. Councilman Kurbitz present after 3:20 p.m. An Application for Water and Sewer Service outside the City Limits, having been filed with the City Clerk on August 1, 1968 by Decoto Aircraft, Inc., City Manager McMicken explained that the applicant is in the process of annexing this property, as requested in the above paragraph, but needs this service before the annexation is effective. He further reported that the applicant is building according to city codes and is willing to sign an outside hookup agreement.' After due discussion, it was MOVED by Lambert, seconded by Brown, that this request for outside utility connections be granted: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting by voice vote. Larson absent. Petition No. 615, having been filed with the City Clerk on July 31, 1968, by Jerald & Delores Ryan & Others, requesting improvement of property by the construction; of curbs, gutters and surfacing of Baker Street, Cornell Avenue to a point 316 feet West, it was MOVED by Keith, seconded by Lambert, that said Petition be referred to the City Mana- ger and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote. A Damage Claim having been filed with the City Clerk on July 30, 1968, by Wayne and Andrea Gaffney, 2709 West Chestnut, . in the amount of $1,579.86 for damages caused by flooding of water from a broken water main, it was MOVED by McNeice, seconded'. by Brown, that said Damage Claim be referred to the City Manager: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote. Larson absent. An Ordinance appropriating $3,000.00 to the Street Fund in order to settle pending liti- gation by Arthur C. and Helen R. Bivens vs. City of Yakima and Pacific Power and Light Co., having been read in its entirety at the regular meeting on July 29, 1968, and being read by Title only at this meeting, it was MOVED by Keith, seconded by McNeice, that Ordinance No. 1054 providing for said appropriation, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye on roll call. Larson absent. ORDINANCE NO. 1054, AN ORDINANCE appropriating the amount of $3,000 from unappropriated money in 310- Street Fund to Account 890 - Miscellaneous, in the Maintenance and; Operation Classification in the 1968 appropriation for 310 - Street Fund. ' City Manager McMicken referred to a request received from the Yakima Valley Regional Library in form of a Resolution, for the release of $14,802.16 from the A;. E. Larson Fund, for the purchase of a bookmobile. He reported that this is the entire amount in the fund, but that the bookmobile will cost $14,345.00. City Attorney Fred Andrews stated that the City still does have this money in-its funds, which fund must; be ad- ministered by the City. He further stated that from time to time expenditures have been 458 AUGUST•5; 1968 made from that fund for the benefit of the City of Yakima for library purposes, and earlier in 1961, a similar amount was, by ordinance, authorized to be spent for the same purpose.. Council Members indicated that since there is no specific request for the balance of the $457.00 in this fund, after the purchase of the bookmobile, they feel it should stay in the fund until such request is made. After due discussion, it was MOVED by Keith; seconded. by McNeice, that the City Attorney be instructed to prepare the proper papers to transfer the necessary funds for the purchase of the bookmobile for the Yakima Valley Regional Library: carried, Brown,. Keith, Kurbitz,, Lambert, McNeice and Robinson voting aye by voice vote. Larson absent. A'request having been received from the Metropolitan Park District for annexation of a triangle parcel of land contiguous to the.City, and City Attorney indicating that this property may be annexed by Ordinance by the Council at the. request of the Park Board, it was MOVED by Brown, seconded by McNeice, that an Ordinance be prepared to annex this property: carried, Brown, Keith, Kurbitz, Lambert, McNeice and Robinson voting aye by voice vote.
