The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
Kurbitz, Lambert, McNeice and Robinson, City.Manager McMicken and City Attorney Andrews .
present on roll call.
The Invocation was given by Councilman Lambert. .
The minutes of the regular meeting of June 24, 1968, having been duly certified accurate
by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded.
At the regular meeting of June 24, 1968, . Councilman Kurbitz announced his intention to Move 't
to reconsider the matter of awarding of a contract to Yakima Cement & AsphaltiCompany for
S. 16th Avenue Arterial Improvement, Nob Hill Blvd. to Chestnut Ave. At this'meeti -ng, it
was MOVED by Kurbitz, seconded by Keith, that said matter be reconsidered. Councilman
Kurbitz stated that he felt that this was an unfortunate situation, and that this matter
should be reconsidered. Councilman Keith stated that he had seconded Mr. Kurbitz' Motion
for reconsideration because he had obtained other information regarding bid awards, and
suggested that all bids be rejected and new bids called for. He asked the City Attorney
for further information on amount of time necessary in calling for new bids, and whether
an emergency can be declared to speedup the process. City Attorney Andrews explained that
the Council can declare an emergency to exist and award a contract without calling for
bids. Councilman Lambert indicated she feels that the whole problem stems from the . fact
that Superior Asphalt and Concrete Company did not open their mail in time, and does not
feel that it is in the best interests of the City to go to the expense of again calling for
bids. After due discussion, Mayor Larson called for the vote on the Motion to reconsider
the matter of awarding the contract to Yakima Cement &•Asphalt Co. for S. 16th Avenue
Arterial Improvement, Nob Hill Blvd. to Chestnut Avenue, and the Motionlost' for want of a
majority vote. Keith and Kurbitz voting aye by voice vote. Lambert, Larson,;McNeice and
Robinson voting may by voice vote. Councilman Brown not voting because he was not present
at the last meeting when this matter was . more•thoroughly discussed. .
This being the time fixed for the continuation of the Hearing on the Amendment to Title 12,
Zoning, it was MOVED by Robinson, seconded by Lambert, that Ordinance No. 1044 amending
by creating and adding a new chapter, Planned Development Zone, and amending Section
12.08.010 of the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Kurbitz,
Lambert, McNeice, Larson and Robinson voting on roll call. .Acting Planning Director Ed
Loidhamer explained that by creating the new Planned Development Zone, it will encourage•
greater flexibility in design and will accommodate any kind of new planned development,
such as shopping, commercial and residential.
ORDINANCE NO. 1044, AN ORDINANCE relating to zoning; creating a Planned Development Zone;
establishing a procedure for applying for such a zone.; setting forth requirements for such
a zone; creating a new chapter to the City of Yakima Municipal Code numbered and entitled
"Chapter 12.50, Planned Development Zone "; and amending Section 12.08.010 of the City of
Yakima Municipal Code.
An Ordinance appropriating $24,000 from unappropriated funds in Airport Fund to purchase
two `2 -ton trucks for snow removal, having been read in its entirety at the regular meeting
on June 24,1968, and being read by Title only at this meeting, it was MOVED by Keith,
seconded by McNeice, that Ordinance No. 1045 providing for said appropriationbe passed as
read:" carried, Brown, Keith; Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on
roll call. ....

ORDINANCE NO. AN ORDINANCE appropriating .the amount of.$24,000 from unappropriated
money in 390 - Airport Fund to Account 940, Machinery and Equipment, in the Capital Outlay -
Classification in the appropriation for 390- Airport Fund.
Donald R. Dietz, D.D.S., President of the Yakima Valley Dental'Society, beingipresent,
read a-letter from the Yakima Valley Dental Society as follows:
"Due to the renewal of interest in our community since last fall concerning the
fluoride issue, the Yakima Valley Dental Society feels that the City Council should
consider passing an Ordinance which. wi.11. bring to a. vote this fall, by the citizens '
of Yakima, whether or not the City shall have fluoride added in appropriate amounts
to its water supply for the purpose of the reduction of the rate of dental decay
of its children."
It was then MOVED by Keith, seconded by McNeice, that the City Attorney be directed to
prepare a proposed ordinance providing for the addition of fluoride to the City Water
Supply, and that such proposed ordinance be in the proper form to provide for'its sub
mission to the electorate of the City of Yakima at a special election to be held in con-
junction with the State General Election on November 15, 1968, for the ratification, or
rejection by the electorate of that ordinance, and that the proposed ordinance be submitted
to the. City .Council at its regular meeting. on. July 29.,.19.68 that at that time during
that meeting a public hearing be held on the proposed ordinance, before it is!voted on by
the Council. Mr. 0. F. Gilbert, representing the Yakima Pure Water Association, stated
that said Motion is in accordance with their thinking; that they would like the natter
placed before the people. Mr. Larry Robinson, also a member of this organization, asked
questions about the cost of installation of equipment and materials to add fluoride to the
water, and stated that their organization has alternate programs and costs to!report, which
they will do at the hearing on July 29,1968. After due discussion, Mayor Larson . called for
the vote on the Motion to have an ordinance prepared as stated and that a public hearing
be held on said matter on July 29, 1968, and it carried, Brown, Keith, Kurbitz, Lambert, �\
Larson, McNeice and Robinson voting aye by voice vote.

Mr. Stephen Huza, being present, asked if the Council has made any Resolutions as to a
change of name for our Yakima Municipal Airport, and stated that he is opposed to any
change of name, as he feels it is a well known airport by its present name. Mr. Huza also
asked if any permit has been asked for from the Council to construct a jogging track on
Naches Avenue and stated that he is opposed to . this being done. Mayor Larson informed him
that neither of these matters has been brought before the Council.
City Manager McMicken referring to the Memo from the City Attorney's office regarding a
Damage Claim, filed by Kenneth J. Kuehn, for damages caused by a. sewer backup, and recom-
mending payment in settlement of said damage claim, it was MOVED by Robinson, seconded by
Lambert that Resolution No: D -1223 authorizing the payment of said damage claim in the
amount of $371.02 be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson,
McNeice and Robinson voting on roll call.
RESOLUTION NO. D -1223, A RESOLUTION authorizing and directing the payment of $371.02 to
Kenneth J. Kuehn in settlement of a Damage Claim.
City Manager McMicken reported on the damage claim filed. by William. C. Nance, who had a
watch damaged in the line of duty as a member of the Police Department, and recommended
that payment be made. It was then MOVED by Brown, seconded by McNeice that Resolution
No. D -1224 lauthorizing payment of $15.68 to William C. Nance, be passed as read:' carried,
Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call.
RESOLUTION NO. D -1224, A RESOLUTION authorizing payment a Claim for Damages filed
against the City of Yakima by William C. Nance. • .-
City Manager McMicken reported on a request from Utilities Director Frank Stein to trans -
fer $11,500 from Water Sewer Maintenance and Operation to Salaries and Wages Classifica-
tion, to be used primarily for part -time, temporary help in connection with °the 16th' '•
Avenue water.main. After due discussion, it was MOVED'by Robinson, seconded by Brown,
that Resolution No. D -1225 transferring $11,500 within the 1968 Budget for Water- Sewer
Department, be passed as read: carried, Brown, Keith, Kurbitz Lambert, Larson, McNeice •
and Robinson voting aye on-roll call.
RESOLUTION NO. D- 1225, A RESOLUTION transferring the +amount.of $11,500 within the 1968
appropriation for 520 - Water -Sewer Department.
Upon the recommendation of Public Works Director, John Mayo, City Manager McMicken
requested authorization to file a Permit with the State Highway Commission- to permit
crossings of State Route. 12 (Naches Highway) with water transmission main. After due
discussion, it was MOVED by Robinson, seconded by Brown that Resolution - D -1226 :•
authorizing the execution 'of a Permit with the State of Washington, Department of Highways,
be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson'.

RESOLUTION NO. D -1226, A RESOLUTION authorizing and directing the City Manager and the
City Clerk of. the City of• Yakima• to• execute Permit No. U5 -483 with the State of Washing-

ton, Department of Highways.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Keith that we do now adjourn at the hour of 4:05 P.M.: carried, Brown, Keith,
Kurbitz, Lambert, Larson, McNeice and Robinson voting by voice vote.
