HomeMy WebLinkAbout05/13/1968 Business Meeting r • 427 • . • • MAY 13, 1968 The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicke_n and City Attorney Fred Andrews present on roll call. • The Invocation was given by City Manager McMicken. • The minutes of the regular meeting of May 6, 1968, having been duly certified accurate by two Councilmen, and no, one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the hearing on Petition No. 601, filed by Jack E. Nettleship requesting annexation of property situated northwest of the intersection of 48th and Englewood Avenues, it was MOVED by Brown, seconded by Lambert, that Ordinance No. 1032 annexing said property be passed as read. Mr. Howard Elofson, Attorney representing Mr. Nettleship, was present and filed with the Council on this date a restrictive covenant regarding building height and the required dedications for a road, as recommended by the Planning Commission. After due discussion, Mayor Larson called for the roll call vote on the Motion to pass Ordinance No. 1032 annexing said property, and it carried; Brown Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO 1032, AN ORDINANCE annexing property to the City of ; Yakima, and zoning said property:" • •This being the time fixed for the hearing on the.Assessment Roll for L.I.D. No. 963 - • Englewood Heights Addition & Other Sanitary Sewers, and there being no protests in writing or otherwise, it was -MOVED by Robinson, seconded by McNeice, that Ordinance'No. 1033 con- firming said Assessment Roll and every part thereof, be passed as read: carried, Brown, Keith,.Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO. 1033, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 963 as created and established by Ordinance No. 907 of the Ordinances of '.._. the' City of Yakima. • . Petition No. 606 having been filed with the City Clerk on May 8, 1968, by Jacob J. Briski, et al., requesting improvement of property by the construction of curbs, gutters and sur- facing of North 15th Avenue_ from Fruitvale Boulevard to Swan Avenue, and Petition No. 607 having been filed with the City Clerk on May 8, 1968, by Guy Willard, et'al., requesting the improvement of property by the construction of curbs, gutters and sur- facing of Richey Road between 56th and 57th .Avenues, it was MOVED by Robinson, seconded by Keith,.that said Petitions be referred to the City Manager and staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by II voice vote. • Petition No. 608, having been filed with the City Clerk on May 9, 1968, by W. A Damage Claim having been filed with the City Clerk on May 3,, 1968, by Richard L. Nathlic , 2607 Clinton Way, and a Damage Claim having been filed with the City Clerk on May 7, 1968, by Ralph L. Uber, 223 N. 46th Avenue, it was MOVED by McNeice, seconded by Brown, that said Damage Claims be referred to the City Manager and Staff for study and recommendation: carried, Brown,.Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voic =. vote. • It was MOVED by Brown, seconded by Robinson, that Ordinance No. 1034 fixing the time of delinquency and providing for the issuance of bonds for the payment of the unpaid portion • of L.I.D. No. 955, South Third. Avenue Arterial Improvement, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. • ORDINANCE NO.1034, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 955, and providing for the issuance of bonds with coupons attached for payment of the unpaid portion thereof. The Planning Commission reporting on the Rezone Application filed by Henry L. and Alphretta Dawson, requesting rezone of property situated at 103 N. 4th Avenue, it was MOVED by Robinson, seconded by McNeice, that May 27, 1968, be fixed as the date of Hearin. by the City Council on the matter of the rezone of certain property as requested by Henry L. and Alphretta Dawson, and that the City Clerk give. notice of.such hearing as required by law: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. • City Manager McMicken reported that the City Attorney has prepared Resolutions and Memos regarding the payment of four Damage Claims and recommends payment of said Damage Claims; It was MOVED by Keith, seconded by Lambert, that Resolution No. D -1204, authorizing pay - ment of $24.82 to Stewart.Johnson for damages to his water line caused by the City Water Department, be passed as read:. carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. RESOLUTION NO. RESOLUTION NO. Cassidy in settlement of damages caused by a clogged sewer line, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. . RESOLUTION NO. D -1207, A RESOLUTION authorizing and directing the payment of $19.29 to . Martha J.' Cassidy in settlement of a Damage Claim. • City Manager McMicken reported that -the Randall property located at the Northwest corner • of 44th and Mead Avenue between 44th and 48th .Avenues just outside the Yakima City Limits is a very desirable piece of park land, and through .a very favorable negotiation, the Park District proposes to pay $75,000 for this land, three - fourths of which will be paid . through State funds.. He further explained that at this time the Park District does not . have' sufficient funds to make this purchase, and recommends that a loan of $20,000 be made from the Transit Fund to the Metropolitan Park District, to be paid back in five years,. Council membersstated that they feel that this is a good buy, as it was appraised sometime ago at $85,000. , After due discussion, it was MOVED by Keith, seconded.by Lambert, that Resolution No.-D -1208 authorizing a loan of. $20,000 from the Transit Fund t. the Metropolitan Park District be passed as read: carried, Brown, Keith, Kurbitz,.Lamber -dd, . RESOLUTION NO, D -1208, A RESOLUTION authorizing a loan of $20,000 from the Transit Fund of the City of Yakima to the Metropolitan Park District of Yakima, and providing for re II payment. Councilman Keith,. asking to be. excused from the meeting of May 20, 1968, it was MOVED by McNeice, seconded by Robinson that be excused from said meeting: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote.
