HomeMy WebLinkAbout04/22/1968 Business Meeting i - 419 APRIL 22, 1968 The Council met in regular session, Mayor Larson presiding, Councilmen Keith, Kurbitz, Lambert, McNeice, and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Brown absent on roll call, having been excused at a previous meeting. . The Invocation was given by Councilman Keith. The minutes of the regular meeting of April 15, 1968, having been dul certified accurate . by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . Mayor Larson called upon Utilities Director Frank Stein to. introduce Floyd Benton, Perry Casey, and Ronald Ewald, members of the Utilities Department. Mayor Larson presented them with Certificates of Competency issued by the Pacific Northwest i'ollution Control Association. This being the time set for the hearing on the application of F. David Long and Frank H. Long requesting Rezone of property situated at 1106 S. 15th Ave., it as MOVED by Robinson, seconded by McNeice, that Ordinance No. 1022 accepting the recommendation of the Planning Commission and rezoning said property be passed as read. City Manager McMicken reported that the property is at present zoned R -3, and the proposal is to rezone it to B -2; stat- ing further that the staff recommendation was for a B - -1 zone, but t at the Planning Commission, on a unanimous vote, recommended it be rezoned to B-2. Br. Omar Scheidt, President of Yakima Valley College, being present, stated that there had been some con -. fusion regarding this proposed rezone and he had not realized it was to be decided by the Planning Commission on April 2nd, since he was waiting for infor ation from Mr. Weeks, representing Mr. Long, regarding the possible sale of the property t• District No. 16. He further stated that the logical expansion of the college would be to the south of Nob Hill Blvd.; that the college would prefer the present zoning of R -3 o a business zone, because of traffic and parking problems that he felt would result fr•m a business zone; pointing out that business development will increase the value of pr.perty in the area, and if the cost of property increased too much the college may have o make the decision to move the campus to another location. He urged that the matter be referred back to the Planning Commission for reconsideration, since the Planning Commissi.n did not know of the college's interest at the time of the hearing. Mr. Weeks, representing Mr. Long, stated he was much opposed to postponing the decision any longer; that his client had been waiting since February; that almost all the property owners in the v'cinity favored the re- zoning; and that his client was not interested in selling his proper y. He showed a drawing of the proposed building and stated that he felt it would be unfair to postpone the matter further. Mr. Sanislo, 1120 S. 15th Ave., was present and spoke in favor of the proposed rezoning, stating he felt the city should protect the area for business use. Councilman Keith stated he felt the Council had an obligation to the college to cooperate in expansion needs, but could not justify the postponing of the rezo e on the possibility of a purchase or condemnation of the property in the future. Counci man Kurbitz concurred, and stated that he felt the Council had an obligation not to hinder r. Long in his plans II for developing the property. Councilman Robinson stated he was not 'n favor of returning the matter to the Planning Commission or dissenting from their decision but would like to delay consideration of the matter for a week. After further discussion, it was MOVED by Robinson, seconded by Lambert, that the application of F. David Long and Frank H. Long for . said rezone be continued one week: Motion failed because of a tie vete, Lambert Larson, and Robinson voting aye; Keith, Kurbitz, and McNeice voting nay by vice vote. Brown absent. Mayor Larson then called for the roll call vote on the moti.n to pass Ordinance No. 1022 accepting the recommendation of the Planning Commission and rezoning certain property, and it carried: Keith, Kurbitz, Larson, and McNeice votin. aye on roll call; Lambert and Robinson voting nay on roll call. Brown absent. ORDINANCE NO. 1022, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 1106 South 15th Avenue, in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -2, Local Business Z.ne. This being the time set for the hearing on the application filed by arold R. Sanford requesting rezone of property situated southwest of the intersection of Englewood Ave. and N. 35th Ave., City Manager McMicken reported that the proposed r =zone includes five lots in the High View Courts Subdivision north of the Yakima Tennis Slub, and the request is to rezone from R -2 (Two Family Zone) to R -3 (Multiple Family Zone). He stated that the area north and east of the property is outside the city and, the efore, not zoned; and that the Planning Commission and Planning Director . recommended a.proval of the rezone, provided a restrictive covenant be made and recorded to limit buildi g height to no more than allowed in an R -2 zone. Mr. Sanford, the petitioner, was prese t and stated that the restrictive covenant was not yet ready but would be filed. Mr. `kidmore, who owns property in the area, was present and stated that he was not opposed to the rezone if the restrictive covenant was on file before the passage of the rezone or.inance. After due discussion, it was MOVED by. McNeice, seconded by Lambert, that the r :quest of Harold R. Sanford for the said rezone be postponed one week, or until April 29, 1968:. carried, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Brown absent. . This being the time for the hearing on the adoption of the revised B and Fire Codes, City Manager McMicken reported that some months ago the staff began studies lead- ing to amendments to the City Code for building and fire protection •urposes. He stated that a report was made to him, followed by discussion and a study se -sion with code enforcement officers, which was followed by a meeting with industry epresentatives and others affected at City Hall six weeks ago, which was well attended, with about 35 or 45 people in attendance. He stated that subsequently revisions were ma.e, and another meet - ing was held with the home builders association and those particular y interested in the question of plastic pipe; and finally the matter was before the Coun•il, with a report, which he felt would provide up to date codes, and in terms of being .cceptable.to_the greatest number of people in the community. After due discussion, is was MOVED'=by Lambert,_ seconded by McNeice, that Ordinance No. 1023, adopting the building •ode and amending the Yakima Municipal Code, be passed as read: carried, Keith, Kurbitz, ambert, Larson, McNeice, and Robinson voting aye on roll call. Uniform Building Code, 1967 Editio , Copyright 1967, by the International Conference of Building Officials, regulating the e ection, construction, enlargement, alteration, repair, moving, removal, conversion, demoli ion, occupancy, 420 APRIL 22, 1968 equipment, use, height, area and maintenance of buildings or structures in the City of Yakima; providing for the issuance of permits and collection of fees therefor; providing penalties for the violation thereof.; amending Sections 11.04.010 and .040, and repealing Sections 11.04.020, .050 and .070,all of the City of Yakima Municipal Code. It was MOVED by Robinson, seconded by Keith, that Ordinance No. 1024 adopting the Uniform Mechanical Code, and amending the Yakima Municipal Code, be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO. 1024, AN ORDINANCE relating to building regulations; adopting by reference Volume II of the Uniform Building Code entitled "Uniform Mechanical Code ", 1967 Edition, of the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, together with appendices thereto entitled "Appendix B, Steam and Hot -Water Boilers -- Steam and Hot -Water Piping-- (Hydronics) ", and "Appendix C, Fuel. Gas Piping ", and making amendments thereto; amending Chapter 11.32 of the City of Yakima Municipal Code by changing the title thereof from "Heating and Comfort Cooling Code to "Mechanical Code", amending Sections 11.32.010, .020, .030, .040, .060, .070, .130 and . 160 of the City of Yakima Municipal Code; repealing Sections 11.32.050 and .180 of the City of Yakima Municipal Code; and repealing Chapter 11.24, "Gas. Appliances ", Chapter 11.28, "Gas Piping Systems ", Chapter 11.36, "Liquefied Petroleum Gases" and Chapter 11.40, "Air Tanks ", of the City of Yakima Municipal Code. It was MOVED by Keith, seconded by Lambert, that Ordinance No. 1025 adopting the Uniform. Plumbing Code and amending the Yakima Municipal Code, be passed as read. After due dis- cussion, it was MOVED by Robinson, seconded by McNeice, that Ordinance No. 1025 be amended by changing "Department" to "Division" wherever it refers to the Inspection Divi- sion and deleting everything in Section 8, page 5, following the word "year" in the first sentence of the paragraph under the fee schedule: carried, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Brown absent. Mayor Larson then called for the roll call vote on the motion to pass Ordinance No. 1025 adopting the Uniform Plumbing Code, as amended, and it carried: Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO. 1025, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Plumbing Code, 1967 Edition, by the International Association of Plumbing and Mechanical Officials; providing for licensing individuals and firms engaged in the busines•. of, or laboring at the trade of, plumbing; providing penalties for the violation of the provisions of this Chapter; amending Sections 11.44.010, .030, .040, .050, .060, .070, . 080 and .090; repealing Section 11.44.020, and adding Sections 11.44.100, .110 and .120 as new sections, all of the City of Yakima Municipal Code. . It was MOVED by Robinson, seconded by Keith, that Ordinance No. 1026 adopting the Uniform II Dangerous Buildings Code and amending the Yakima Municipal Code be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO. 1026, AN ORDINANCE relating to dangerous buildings; adopting by reference the Uniform Building Code, Volume IV, "Dangerous Buildings ", 1967 Edition, by the Inter- national Conference of Building Officials, and making amendments thereto; defining terms; providing for the repair or demolition of dangerous buildings; establishing procedures for recovering the cost of such repair or demolition; and creating Chapter 11.46, "Dangerous Buildings" as a new Chapter to the City of Yakima Municipal Code. . Kurbitz temporarily absent. Brown absent. . ORDINANCE NO. 1027, AN ORDINANCE relating to fire prevention; adopting by reference the Fire Prevention Code, 1965 Edition, and the. "October., 1966 Revision of the Fire Prevention Code, 1965 Edition ", both of the American Insurance Association; adopting by reference the National Fire Codes, 1967. -68 Edition, of the National Fire Protection Association; making amendments and additions to such Codes; prescribing fees and requiring permits and certi- ficates; prescribing regulations governing conditions hazardous to life and property from fire or explosions; prohibiting false fire alarms; declaring violations to be misdemeanors and prescribing penalties for such violations; amending Sections. 10.05.010, .020, .030, . 040, .050, .060, .070, .080, .090, .100, .110 and .120, and adding new Sections 10.05.130 .140 and .150, all of the City of Yakima Municipal Code. It was MOVED by Robinson, seconded by Lambert, that Ordinance No. 1028, adopting the Fire- . works Code and amending the Yakima Municipal Code, be passed as read: carried, Keith, Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO. 1028, AN ORDINANCE relating to fireworks; regulating the sale and use there- of; and amending Section 10.15.020 and 10.15.050 of the City of Yakima Municipal Code. City Manager McMicken stating that it was intended to present the question of a number of outside utility connections to the next study session of the Council for a discussion of outside connections and annexations, and requesting that the applications of Williams Equipment Co. and Dec.oto Aircraft, Inc., for outside utility connections be postponed, it was MOVED by McNeice, seconded by Robinson, that the applications of Williams Equipment Co and I3ecoto Aircraft, Inc., for such outside connections be continued for one week,. or until April 29, 1968: carried, Keith, Lambert, Larson, McNeice, and Robinson voting aye. by yoicL vote. City Manager McMicken requesting authorization for Glen Perkins and Peggy Rabung to attend the American Waterworks Association, Pacific Northwest Section, convention in Salem, Oregon, and for Public Utilities Director Frank Stein, John Danker and Paul Page to travel to Eugene, Oregon, to look at a hydraulic sewer cleaner in action; it was MOVED by Keith, seconded by Robinson, that said trips be allowed with expenses paid: carried, Keith, Kurbitz, Lambert, •Larson, McNeice, and Robinson voting aye by voice vote. Brown absent. 421 APRIL 22, 1968 City Manager McMicken discussing the need for the City Council to appoint three representa- tives to the Board of Tax Equalization, it was MOVED by Lambert, seconded by Robinson, that Councilmen Keith, Brown, and Kurbitz be appointed to said board: carried, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Brown absent.
