HomeMy WebLinkAbout04/01/1968 Business Meeting 408 • • • APRIL 1, 1968 The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews • present on-- roll•call. • The Invocation was given by Councilman Lambert. The minutes of the regular meeting of March 25, 196 having been duly certified accurate . by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor • Larson declared said minutes.approved as recorded. • • This being the time fixed for the Hearing on the recommendation by the Traffic Advisory Board to remove the parking Tieton Drive - to 40th Avenues, and from Lincoln Avenue - 24th to 40th Avenues, it was MOVED by Brown, seconded by Lambert that Ordinance No..1017 relating to traffic regulations regulating parking and amending the Yakima Municipal Code, providing for the removal of the parking from the East side of S. 7th Avenue from Spruce Street to Tieton Drive and from Tieton Drive and W. Lincoln Avenue as specified above, be passed as read. Mr...Dave Gill, 3212.Lincoln Avenue and Rita Rogers, 3302 W. Lincoln Avenue,'were present protesting the removing of the parking on Lincoln • Avenue because they have short driveways and need to have one lane of parking in front of their houses to handle their own cars, as well as visitors' cars. Mrs. Adamson, 2301 Tieton Drive; was present to protest the removal of the parking on Tieton Drive as she has a short- driveway and it is very difficult when she - has meetings and. guests to have room for them to park. City Manager McMicken stated that several letters favoring the removal of the parking have been received. He also that the Police Department reported several accidents caused by cars being parked on these streets, and that the Traffic Advisory Board has recommended:the removal of parking on these streets because it is a traffic hazard and there does not seem to be a need for parking as very few cars have been observed parking there. Councilman Kurbitz stated that he does not feel there is a large enough flow of traffic on Lincoln Avenue to warrant the removal of the parking, and that anyone with normal control of their automobile .should be able to avoid a .parked._caT. He further stated that he.feels:it will cause inconvenience to these people who..do use the parking facilities_and until such time as there is'more traffic, it should be left as it is. Councilman Brown stated that he is in favor of following the recommendation'of the • Traffic Advisory Board and the Police Department as they have studied this situation thoroughly and believe it is necessary to remove the parking on, these streets. After due discussion, Mayor Larson called for the roll call vote on Motion to pass Ordinance • No. 1017 providing for the removal of parking on certain_.streets;:.and it carried.: Brown, Keith -, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz voting nay on roll call. In voting.aye on this matter,.Councilman Keith stated that this is a • difficult decision, but that he can't help but feel that we must follow the recommendation I of the Traffic . Advisory. Board and the Police Department. •;;Councilman Robinson -, in voting aye,' stated that he regrets that this parking situation _hasn't worked. as well as_ had . been anticipated and is in sympathy with the property owners protesting the removing of the parking, but agrees with.Mr..Keith about the.problem.of traffic safety and that we should support-the recommendation of. the tTraffic Advisory Board.. Mr. Chris • Kramer, 1211 Broadway and Mr. Charles Reams, 1109 S. llth Avenue, were present and object- • ing to having to_.pay on this assessment because it is an Arterial Improvement.. Two • letters,were.also.received regarding: this Assessment. -It. was explained ; by:Council - members that gas tax money i•s . paying for the streets and the. charges being. assessed the property owners is:.f.or_ the_ curbs and gutters they are' actually paying about one -third of the cost of the .improvement. . . ORDINANCE NO. 1018, AN ORDINANCE confirming the assessment roll covering Local Improvement District .No. 955 as .created and. established by Ordinance No. 80.8 of the-Ordinances of the City of: Yakim. a: . • • A Damage Claim, having been filed with the City Clerk on March•27,-.1968, by Albert H. • Wagner, 2307 Tieton Drive, in the amount of $165.00 for damages caused to his.basement • recreation room due .to an opened water.. hydrant, it was MOVED by-Robinson, seconded by- - Brown that-said Damage Claim be referred to the city. McNeice and Robinson voting aye by.voice vote. __ It was MOVED by Lambert., seconded by Brown that Ordinance No. 1019 specifying the due dates for water services and increasing the reconnection charges after suspension of water Services, be passed ;as read: carried, Brown, Keith, Kurbitz, Lambert Larson, McNeice and Robinson voting aye on roll call., City Manager, McMicken referred to his Report #15 regarding.reconnection -charges after:suspension of water service', outlining.. the problems involved in the amount of time.required to reconnect water shut off for non - payment of bills and recommending that the Code be amended to increase the reconnection charge from $1..00 to $5.00 in order to encourage water customers to. pay delinquent water-bills, or . make other'arrangements for payment. Mr. Clem .Enright, Real.Estate Agent,_ being present, stated that he objects to this raise because the owner of rental units will have to pay • r 409 . APRIL 1, 1968 this reconnection charge . as well as the unpaid water bill of a tenant who leaves without paying said-bill. Council members discussed the possibility of rental owners supplying the Water Department with lists of their tenants so that the landlord can be notified also when there is a past due water bill. Mr. McMicken stated that this matter will be investi- gated further. ORDINANCE NO. 1019, AN ORDINANCE relating to public services and utilities; specifying the time within which water service charges are due and payable; providing for the suspension of water service for nonpayment of. water service charges; imposing a reconnection charge; and amending Section 7.68.025 of the City of,Yakima Municipal Code. An Application for Utility Connection outside Yakima City Limits, havi g been filed with the City Clerk on March 29, 1968, by Jack E. Nettleship, City Manager cMicken explained that this request is for hookup for a newly planned 40 -unit condominiu type housing at 48th and Englewood:. -He further explained that the normal procedure should be annexation and suggested that a Notice of Intention to Commence Annexation Proceedings, be filed. Mr. Clem Enright, representing Mr. Nettleship, explained that they thoight it would take six to eight months to go the annexation route and are interested in g -tting the quickest service, but that they are willing to annex as soon as possible. He p esented plans of the proposed housing units. Councilman Robinson suggested that this matter be considered next week after it has been presented to the Planning Commission, and also suggested that work be done with the owner on a Petition to annex. Councilman Lamber explained that the Council has a policy regarding outside hookups, especially when it sees that the property can be easily annexed. After due discussion, it was MOVED by Robinson seconded by McNeice_ that this matter be continued for one week and referred to the Plannin• Commission for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Lar.on, McNeice and Robinson voting aye by voice vote. Nob Hill Blvd., City Manager McMicken explained that they are planning a building at ti is address for Kenworth Trucks sale's and service, and will sign a committment try annex. After due dis- cussion, it was MOVED by Keith, seconded by McNeice that this matter b- continued for one week and referred to the Planning Commission for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson_voting aye by voce vote. An Application for Utility Connection outside Yakima City Limits, havi g been filed with the City Clerk on March 29, 1968, by Marvin McCarger, 1321 S. 24th Ave ue, requesting this service to serve a. residential building, and City Manager McMicken recommending that the Staff study this matter further, it was MOVED by Lambert, seconded by McNeice that said matter be referred to the City Manager and Staff for study and recomme dation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting ay- by voice vote. It was MOVED'by Keith, seconded by McNeice that Resolution No. D -1193 : uthorizing the purchase of materials and hiring of labor without calling for bids, fo emergency repairs on the main power line to the Sewage Treatment Plant, be passed as rea•: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. City Manager McMicken explained that when the main electrical power line malfunctioned, it was necessary that material be purchased and labor hired . to install a temporary main electri- cal power line to serve the Sewage Treatment Plant, and an emergency e.isted so there was not time to call for bids and he recommends that authorization be give for the purchase of said materials and labor without calling for bids, in the total amo nt of $2,093.82. RESOLUTION NO. D -1193, A RESOLUTION authorizing and ratifying the pure ase of materials and the hiring of labor without calling for bids. Progress Report #4 having been received from CH2M regarding work perfo med on the Naches Water Treatment Plant, by Teeples and Thatcher, Contractor, and recomm nding payment of $117,701.93 to said Contractor, it was MOVED by Robinson, seconded by Town that said report dated March 27, 1968, with respect to the progress on said proj ct, be approved and that the progress estimate therein set forth be approved and payment i the amount of $117,701.93 be authorized: carried, Brown, Keith, Kurbitz, Lambert, Larson,. McNeice and Robinson voting aye by voice vote. City Manager McMicken referred to a letter received by Public Works Di ector John Mayo, from ABAM Engineers, Inc., Tacoma, Washington, regarding the Proposed rade Crossing Separation Structures. He reported that they state that the approxima e construction and . engineering cost of executing the two schemes is: Two overcrossings, $1,750,000; Two undercrossings, $2,500,000. They further stated that if the City of Yakima wishes to obtain a more accurate estimate of the cost of undercrossings vs. over rossings, it-will be necessary for them to prepare a detailed study which would cost approximately $6,000. Mayor Larson stated that he thinks the businesses in the vicinity of these proposed cross- ings, such as Safeway, Lovering.Tir Bissell & Cox, May Nursery, Helliesen Lumber h / to ed nderpasses Supply Co., and others, g, and invite their comments about nder asses and . I/ overpasses. He further indicated that this matter is going to require further study for figures and that preliminary drawings of the approaches for overpasses should be obtained so that it will be easier to identify a little more accurately how the people are ' to get in and out of Lovering and Safeway. Councilman Lambert stated that she thinks we really need to have this type of study, but doesn't think it is necessary at this point' to have this Hearing. She feels that it would be wise to send these businesses a letter saying that we are preparing background study material to present to them or that we are accumulating this information and as soon as we have it, they will be informed. She • • 410 • APRIL 1, 1968 • questioned whether we want to spend $6,000 for this study. Councilman Kurbitz indicated that he feels shorter undercrossings than are planned can be built and. there should be some study on this.' Councilman Keith stated that he believes we should spend the. funds to get the jobs completely studied to present to the people. City Manager McMicken suggested that we not spend. $6,000 for a study at this time, but do a little more home work with our engineers before deciding to spend this money.
