The Council met in regular session, Mayor Larson presiding, Councilme Brown, Keith, Kurbitz, Lambert, McNeice, and Robinson,, City Manager McMicken, and City Attorney Andrews present on roll call. The Invocation was given by Councilman Keith. The minutes of the regular meeting of March 18, 1968, having been dull certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the hearing on Rezone Application filed by Boyer, Baker, et al., requesting rezone of property situated north of East Chestnut Street between Naches Avenue and S. 8th Street, Acting Planning Director Loidhamer reported that the property in question includes a rather large area of 4.66 acres south of Yakima Avenue between - Naches Avenue and South 8th Street. He stated that the proposed development is a motel to be established on the west side of. S. 7th Street. The area is at •resent developed with single family and various multi- family residences. Mr. Loidhamer further stated that in view of the fact that there are a number of existing single amily homes, and the B -3 zoning requested would make them non - conforming, the staff recom ends that the area proposed for the development of the motel be rezoned to B -3 and the remainder of the property•remain R -3, and as development proceeds in that area additi.nal requests for rezoning will be considered. Mr. Twidwell, who owns a large two story house at the cor- ner of E. Chestnut and S. 7th Street, was present and protested the B -3 zoning, stating that the motel would be built against his line and would ruin his pr.perty entirely. He stated that his property would not be suitable for business development; but as it is; it is good rental property. Councilman Robinson stated that he felt the property had changed in character from residential to business use. After due discussion, it was MOVED by Robinson, seconded,by Keith, that the ordinance be read: carried, Brown, Keith, Kurbitz, Lambert, Larson., McNeice, and Robinson voting aye by voice vote. It as then MOVED by Brown, seconded by McNeice, that Ordinance No. 1014 accepting the recommendation of the Planning Commission and rezoning said property be passed as read. F rther discussion revealed that there was an error in the title and in Section 1, due o the Planning Com- mission's action in reducing.the size of the property to be rezoned, and it was MOVED by Robinson, seconded by McNeice, that Ordinance No. 1014 be amended to read "..situated north of East Chestnut Street and on the east side of South 7th Stre =t,.." instead of "..situated north of E. Chestnut Street between Naches Avenue and S. 8th Street... ": carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robins.n voting aye by voice vote. Mayor Larson then called for the vote on the motion to .ass Ordinance No. 1014 as amended: carried, Brown, Keith, Kurbitz, Lambert, Larson, M Neice, and Robinson voting aye on roll call. Ross Putman, who lives at Chestnut and 8th, inquired regarding the zoning of South 8th Street. Councilman Robinson explained that his area had been eliminated from the rezoning ordinance. . ORDINANCE NO. 1014 accepting the recommendation of the Planning Comm'ssion and rezoning certain property situated north of East Chestnut Street and on the e_st side of South 7th Street, in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -3, Genera: Business Zone. This being the time fixed for the hearing on consideration of the Ordnance permitting limited sale of alcoholic beverages in B -2 Zones, Acting Planning Di ector Loidhamer reported that the Planning Commission considered the amended version of the ordinance re- submitted to them regarding the sale of alcoholic beverages and t e consumption on the premises in those establishments also serving food. He stated t at at their hearing the voting on the amendment ended in a four to four tie. Mr. Loidha er further reported that the members of the Commission opposing the amendment felt that 'here was a problem with the purpose and intent of the B -2 zone, and if this amendment w =nt through perhaps they should re- examine the B -2 zone regulations. Councilman Robinso explained that the proposed amendment would allow establishments that could sell alcoho is beverages by vir- tue of regulations of the liquor board to sell them in the B -2 zone. Garrett Anderson was present and spoke to the amendment, stating that this matter was turned down decisive -y by the Planning Commission by a 7 to 2 vote, and then it was appeale. to the City Council. The Council referred it back to the Planning Commission, and he beli =ves it . should have been a dead issue and that the Council should have backed the Planni g Commission. Councilman Robinson explained that the amendment referred back to th= Planning Commission was not the same as the amendment on which the Planning Commission h.d previously voted; that there were two issues involved. The first was the removal of t e 500 foot limita- tion from the residence section, and the second issue was the matter of liquor in res- taurants. He said the City Council agreed on the first part and ask =d the Planning Com- mission to reconsider the second. He pointed out that restaurants would be selling under the regulations of the liquor board, which are quite severe. After .ue discussion, it was MOVED by Brown, seconded by McNeice, that Ordinance No. 1015 relating to zoning and amending the Yakima Municipal Code be passed as read: carried, Brow ,w , Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. Councilman Kurbitz asked if there were any other changes and was told by City Attorney Andrew'. that the only change was adding item 35 to Section 1, and leaving out Class A and It from item 35 in Section 1; Class A & B referring to taverns. Councilman Robinson s ggested that perhaps Class B -2 zone regulations should be re- studied. Councilman McNeice asked Mr. Loidhamer if there were any objections from the audience at the Planning Commission's hearing, and was told there were none. Councilman Keith stated that the Planning Commission's major objection to the proposed amendment at the first hearing was the portion permitting taverns covered by Class A and B, and this portion of the amendment as eliminated when the ordinance was re- submitted. He stated he believes it is importa t to keep up with economic factors, changing times, and changing patterns in living. Iouncilman McNeice stated he doesn't believe that morals are at issue here, and doesn't see any need for increased police action as a result of this change. ORDINANCE NO. 1015, AN ORDINANCE relating to zoning; specifying use regulations permitted in a B -2, Local Business Zone; and amending Section 12.32.010 of the City of Yakima Municipal Code. Petition No. 600 having been filed with the City Clerk on March 18, 968, by Arthur M. Willoughby & Others requesting improvement of property by the constr ction of curbs, gutters and surfacing of streets on North 10th Avenue from Fruitvale to Willow, it was MOVED by Keith, seconded by McNeice, that said Petition No. 600 for he creation of a Local Improvement District be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, Mc eice, and Robinson voting aye by voice vote. • • 406 • MARCH .25, 1968 • It was MOVED by Robinson, seconded by Lambert, that Ordinance No. 1016 fixing.the time of delinquency and providing for the issuance of bonds for the payment:of the unpaid por- tion of L.I.D. ORDINANCE NO. 1016, AN ORDINANCE fixing the time of delinquency of installments of • assessments, levied for the payment of the cost of the improvement in Local Improvement District No. 949 and providing for the issuance of bonds with coupons attached for the • • payment of the unpaid portion .thereof. . • Mayor Larson introduced Craig Brown, American Field Service student from Dunedin, New Zealand, who is attending West Valley High School, to the members of the City Council and • • others. Mr. Brown presented a New Zealand insignia to Mayor Larson, a silver fern, which is the national plant of New Zealand. Mayor Larson Brown with a City 6f . yakima flag, and thanked him for coming to the meeting. Charles King, who lives at 1608 McKinley,'inquired regarding the Notice of Intention to Commence Annexation Proceedings filed by Matt and Adeline Hatzenbihler requesting annexa- . tion of property situated 200 feet northwest of the.intersection of N. 16th Ave. and Lincoln Avenue, stating that he was interested in the sewer and water facilities in this • area and wanted to know how it would affect him. He stated there is an old sewer right- of:- on his property. Public Works Director John Mayo explained that this was merely a notice of intention filed last week and that the petition is now being.circulated and has not yet been filed. He further explained that when it is filed a hearing will be set, at which time this matter.can be discussed. • Acting Planning Director Loidhamer having submitted a report regarding Location and Access of Proposed State Highway Project - =Route 12, Mr. Loidhamer'stated that the report was :..y�...: reviewed by the Planning Commission at a special meeting on March 19 and the Commission concluded that it was very vital that the proposed extension of 40th Avenue north from Englewood.have some access to the proposed 410 by =pass. He stated that it was their feel- . ing that it should be integrated .into the interchange design. Public Works Director Mayo explained the proposed extension of 40th and its connection with the by -pass. City Mana- ger McMicken stated that this interchange is included in the.general plan and that if the Council agrees with the Planning Commission's recommendation a- letter could be sent to the Highway Department regarding their position. Public Works Director Mayo stated that the Engineers had supplied a design to the Highway Department but haven't heard since the maps were supplied., Councilman Robinson suggested that the Chamber of Commerce Roads and Highways Committee be asked to assist in. the matter. After due discussion, it.was MOVED by Robinson, seconded by Lambert, that the City submit a recommendation to the State High - way Department urging it to make changes in the proposed'plan so that there can be egress and ingress at 40th Avenue: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. • City Manager McMicken requested authorization to execute Lease Agreement with the United States Weather Bureau for space in Airport Office Building, stating that this agreement was in line with negotiations previously made. He explained the provision of the agree - ment for payment of rental, stating that some footage is excluded for which there is no charge.. It was MOVED by Lambert, seconded by Brown, that Resolution No. D -1188 authoriz- ing and directing the City Manager and City Clerk to execute said lease agreement be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. RESOLUTION NO. D -1188, A RESOLUTION authorizing and directing the City Manager and City • Clerk of the City of Yakima to execute a lease agreement with the United States Government for space in the Airport Office Building... . City Manager McMicken presented his report No. 15 regarding reconnection charges after suspension of water service,. outlining the problems involved in the amount of time required to reconnect water shut off for non payment of bills. He suggested that the reconnection charge be increased from $1.00 to $5.00. After due discussion it was MOVED by Keith, seconded by McNeice, that the City Attorney prepare an ordinance amending the code to increase the charge for reconnecting: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. • City Manager McMicken referred to the matter of authorization to withhold from State Fuel Tax allotment an amount for purchase of aerial photographs, explaining that the City lacks information on topography which aerial photographs can supply for use by the Planning Commission and Engineering Department. This information is also needed for land use and • airport Planning. After due discussion, it was MOVED by Robinson, seconded by McNeice, ' that Resolution No. D -1189 requesting the Director of Highways to perform certain work be passed as read:' carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. . • RESOLUTION NO. D -1189, TRANSFER RESOLUTION AND REQUEST FOR THE DIRECTOR OF HIGHWAYS TO PERFORM CERTAIN WORK. • City Manager McMicken requested authorization to engage architectural services to .collaborate with City Engineers on redesign of entrances, landscaping and parking lities in the vicinity of the Airport Terminal Building, explaining the conditions as they now exist and illustrating on a map the areas to be landscaped. He stated that he believes an architect is needed to design these facilities to relate landscaping and buildings to • the spaces ;'that we have handsome buildings and need to set them off with taste and refine- ment.. He explained the needs for access,parking, and the street development, stating that • studies need to be•made of the circulation of traffic and new parking layout, fencing, landscaped areas, pedestrian ways, signs, lighting, and coordination of lighting with Washington Avenue Lighting. He has discussed this with Ron Cameron, architect, and believes that he would do a good job; that he has designed parking layouts at other loca • tions and has done imaginative work; 'and he estimated the cost at $815. It was MOVED by Lambert, seconded by Keith, that Resolution No. D- 1190,. authorizing the City Manager to • engage R. S. Cameron, A.I.A., to perform architectural services for the Yakima Municipal,. Airport, be passed as read. Councilman Robinson asked why Ron Cameron had been selected instead of Villesvik and. Smith. Mr. McMicken answered that he had talked to Cameron::., . • because he liiked Mr..Cameron's sense of design on parking layouts. Councilman Robinson • • said he would have gone to Villesvik &.Smith, since they have done the biggest part of the .work at the Airport. Councilman Brown stated he would like to try Cameron, because i 4O7 / MARCH 25, 1968 he has a great deal of imagination and might come up with something q ite different. Councilman Lambert felt the same way, stating that it is well to give others an opportunity. She asked if this is going to include the selection of any trees, shr bs, etc., stating that when the present landscaping along WashingtonAve. was done the F= deration of Garden Clubs hired an expert on the soil conditions around the airport; and . master plan, paid for by the garden clubs, for plantings at the airport was made. She -uggested Mr. Cameron might . like to tie in with that plan. After further discussio , Mayor Larson called for the vote on the motion to pass Resolution No. D -1190, and 't carried, Brown, Keith, Kurbitz, Lambert, Larson, and McNeice voting aye on roll call. Robinson voting nay on roll call. Kurbitz and Larson, in voting aye, stated they would h.ve preferred to have had some conversation with Villesvik & Smith before deciding on Cameron. RESOLUTION NO. D -1190, A RESOLUTION authorizing the City Manager to e gage R. S. Cameron, A.I.A., to perform architectural services for the Yakima Municipal Airport. City Manager McMicken submitted a request for authorization to purchase property from Perry Trust for Washington Avenue right -of -way, stating he believes t e price to be very reasonable, in view of the present use of the property. After due discussion, it was MOVED by Robinson, seconded by Brown, that Resolution No. D -1191 authorizing such purchase be approved as read: carried, Brown, Keith, Kurbitz, Lambert, Larson McNeice, and Robinson voting aye on roll call. RESOLUTION NO. D -1191, A RESOLUTION authorizing the purchase of real property for Washing- ton Avenue right -of -way. City Manager McMicken reported that at a meeting of the Chamber of Co erce, the City, and West Coast Airlines it was suggested that it would be to the City s interest if the community intervened in behalf of West Coast regarding its case befor: the Civil Aero- nautics Board to grant them the privilege of nonstop service between rortland and San Francisco, and Seattle and San Francisco. The Aviation Committee and the Chamber Board requested the City to give support in this case for nonstop service b °tween Portland and San Francisco. After due discussion, it was MOVED by Robinson, seconded by Keith, that Resolution No. D -1192 supporting the application of West Coast Airlin °s for such nonstop service, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. RESOLUTION NO. D -1192, A RESOLUTION supporting an application by West Coast Airlines for authority for nonstop service from Portland to San Francisco. Councilman Robinson called attention t� the condition of shrubs in planters on the side- walks in the downtown area, stating that some of them are in bad shap- and should be removed, together with the pots. City Manager McMicken stated he would check on the matter. City Manager McMicken referred to a letter from Mr. H. H. Helliesen r- garding the pro- posed grade separations on Lincoln Avenue and B Street, stating that •ublic hearings will be held when the plans are far enough advanced. There being no further business to come before the Council, it was MO ED by Kurbitz, seconded by Keith, that we do now adjourn at the hour of 5:03 P.M.: arried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by oice vote.
