The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kur-
bitz, Lambert, McNeice and Robinson, City Manager McMicken and City At =orney Andrews presen=
on roll call. '
The Invocation was given by Councilman Kurbitz.
The minutes of the regular meeting of March 4, 1968, having been duly ertified accurate
by two Councilmen, and no one present wishing to have said minutes rea publicly, Mayor
Larson declared said minutes approved as recorded. _.
This being the time fixed for the Hearing on Petition Nos. 548, 549 anil 550, filed by the
Yakima Mall- Shopping Center Carp. & Others, requesting Vacation of a portion of 4th Street
and adjacent T alleys, and having been continued from January 8, 1968, it was MOVED by
Brown, seconded by McNeice that Ordinance No. 1012 providing for said acation, be passed
as read. Mr. Fred Palmer, attorney, speaking for a group present representing the Yakima
Mall- Shopping Center Corp. in this matter, explained that all necessar documents are now
on file with the Title Guarantee Company except the matter of the Teag e estate, which is
the only technical loose end that remains and will soon be settled. A ter due discussion,
Mayor Larson called for the roll call vote on the Motion to pass Ordin nce No. 1012 and
it carried, Brown, Keith, Kurbitz, Lambert, Larson, -McNeice and Robins n voting aye on
roll call.
ORDINANCE NO. 1012, AN ORDINANCE providing for the vacation of a porti n of North 4th
Street and certain alleys in the City of Yakima, Washington.
This being the time fixed for the Hearing on the Assessment Roll for L No. 961, North
56th Avenue & Other Sewers, and there being no protests in writing or otherwise, it was
MOVED by Robinson, seconded by Keith that Ordinance No. 1013 confirminG said Assessment
Roll and every part thereof, be passed as read: carried, Brown, Keith, Kurbitz, Lambert,
Larson, McNeice and Robinson voting aye on roll call.
ORDINANCE NO. 1013, AN ORDINANCE confirming the assessment roll coveriig Local Improvement
District No. 961 as created and established by Ordinance No. 856 of th- Ordinances of the
City of Yakima.
Petition No. 598, Notice of Intention to Commence •Annexation Proceedings, having been
filed with the City Clerk on March 6, 1968, by Matt and Adeline Hatzenbihler, requesting
annexation of property situated 200 ft. northwest of the intersection f N. 16th and
Lincoln Avenues, it was MOVED by Robinson, seconded by Lambert that Ma ch 18, 1968, be set
as the time for a meeting with the initiating parties, Matt and Adeline Hatzenbihler, who

signed the Notice of Intention to Commence Annexation Proceedings: car ied, Brown, Keith,
Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vot-.
Damage Claims having been filed with the City Clerk on March 5, 1968, .y Richard Thomas
Buckley, 1211 S. 15th Avenue, in the amount of $27.96 for damages caus -d by water coming
through basement floor drain, and on March 7, 1968, by James H. Doerr, 411 S. 12th Avenue,
for Mrs. Doerr, in the amount of $20,000 for damages caused by a fall on icy streets, it
was MOVED by Keith, seconded by McNeice that said damage claims be ref-rred to the City
Manager:. carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and ' obinson voting aye
by voice vote. .
Mrs. Glenn Hardman, being present, asked various questions about asses ment costs and other
matters regarding annexation proceedings in the vicinity of W. Washing on Avenue, which •
will commence at a later date, in which the Hardman property is involy d. (Decoto property
Public Works Director John Mayo, explained the various L.I.D. assessme t processes and cost
and stated he will be glad to meet with Mrs. Hardman after this meetin to give her further
information. Councilman Robinson explained ann exation procedures and 'nformed Mrs. Hardman
that they will be notified of any hearings on the matter of annexation of their property..
The Planning Commission reporting on the Rezone Application filed by B yer, Baker et al,
requesting rezone of property situated north of E. Chestnut Street bet;een Naches Avenue
and S. 8th Street, and on the matter of the Proposed Ordinance permitt ng limited sale of
alcoholic beverages in B -2 Zones, it was MOVED by Robinson, seconded b McNeice that
March 25, 1968, be fixed as the time for hearings on said matters and hat the City Clerk
give notice of said hearings as required by law: carried, Brown, Keithl Kurbitz, Lambert,
Larson,- McNeice and Robinson voting aye by voice vote. -

It was MOVED by Robinson, seconded by Brown that the. Report of the City Treasurer dated
February 29, 1968, regarding the investments of the City of Yakima, be accepted and
approved: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye
by voice vote. •
The Civil Service Committee reported three names, Charles C. Countryman, Norman R. Nashem,
Jr., and William L. Weigand, Jr., in nomination to fill an expired tern on. the City

Employees' Civil Service Commission, presently held by Norman. R..Nasheni, Jr. Council mem-
bers concurred that any one of the three named would be acceptable to �erve on this
committee. After due discussion, it was MOVED by Robinson, seconded by Lambert that Norman
R. Nashem, Jr., be reappointed for an additional six -year term: carried, Brown, Keith,
Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vot .
A resolution authorizing and directing the execution of a Grant Agreem nt with the United
States of America Department of Housing and Urban Development was intr duced by City
Manager Craig McMicken for discussion. After due discussion and consi eration, it was
MOVED by Brown, seconded by Keith, that Resolution No. D -1184 authoriz the execution of
said agreement be passed as read: carried, Brown, Keith, Lambert, Lars n, McNeice,and
Robinson voting aye on roll call. Kurbitz temporarily absent.
RESOLUTION NO. D -1184, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a Grant Agreement with the Unit d States of America,
Department of Housing and Urban Development.
City Manager McMicken reported that Bruce De Pew, Aircraft Sales and Service, desires to
lease space available in the City Central Building at the Yakima Municpal Airport. He
stated that this is space formerly leased by Puget Aviation. After due discussion, it was
MOVED by Robinson, seconded by Brown that Resolution No. D-1185 author the execution
of a Lease Agreement and a Lease Agreement Addendum, and to accept a G aranty and Indemnity
Agreement, providing for the lease of space at the Yakima Municipal Ai port, be passed as
read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Rob nson voting aye on
roll call.
RESOLUTION NO. D -1185, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a Lease Agreement and a Lease A reement Addendum,
and to accept a Guaranty and Indemnity Agreement, providing for the le se of space at the
Yakima Municipal Airport.
City Manager McMicken reported that negotiations have been completed b Mr. Watson of
Coates Field Services for the purchase by the City of four parcels of roperty needed as
right of way for the realignment and construction of Washington Avenue in the vicinity of
the Yakima Municipal Airport. Mr. Watson procured Offers to Sell from the following:.

John V. & Florence A. Bolm, Glenn M. & Doris M. Hardman, Charles B. an •Winnie M. Amsden,
and Earl and Ellen Tyler. Mr. McMicken stated that the prices to be p id for this property
are slightly higher than the City's appraisal of two years ago, but th re has been some
land value change in that time and the Staff feels that these are fair and just settlements.
After due discussion, it was MOVED by Brown, seconded by Keith that Re olution No D -1186
authorizing the purchase of property for Washington Avenue right of wa , be passed as read:•
carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson oting aye on roll
call.
RESOLUTION NO. D- 1186 A RESOLUTION authorizing the purchase of real property for Washing-
ton Avenue right of way.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Keith that we do now adjourn at the hour of 4:05 P.M.: carried, Brown, Keith,
