McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Keith and Kurbitz absent on roll call. Councilman Kurbitz present after 8:10. P:M. It was MOVED by Robinson, seconded by Lambert that Councilman Keith be excused from this meeting: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by. voice II vote. 4 The Invocation was given by City Manager McMicken. The minutes of the regular meeting February 12, 1968, having been duly certified • accu to rso two Councilmen, and no one present wishing to have said minutes read publicly, Mayortdeclared said minutes approved as recorded. The following bids for the sale of $2,000,000 Water and Sewer Revenue Bonds, Series "A ", were received and opened on this date,.February 19, 1968, at the hour of 1:00 P.M.., in . the presence of City Finance Director Leonard Crose, Assistant City . Manager Martin Fried - line, City Clerk Marie Donelson, City Attorney Fred Andrews and Mr. Robert 0. Yeasting, representing Harper & Son, Financial Advisors for the City of Yakima:. These bids were then checked for errors by the City Finance Director Leonard Crose and Mr. Robert O. Yeasting, of Harper & Son. Mr. Yeasting reported that, one bid did not meet all of the qualifications of the Notice of Sale, but that all the others were correct and that the interest costs :were tabulated and the bid of John Nuveen Co., Chicago, Illinois, is the lowest and best bid with:an effective interest-rate-of 4.6151 %. He further "stated that the bids were very close and•that all bids. Mr. Yeasting recommending • that the bid be awarded to John Nuveen & Co., it by Robinson; seconded•by Brown • that the bid to purchase $2,000,000 of Water and Sewer Revenue Bonds; Series "A ", be awarded to John Nuveen & Co., Chicago,. Keith and Kurbitz absent. • (Councilman Kurbitz present after 8:10 P.M.) • II This.being the time.fixed for.the.continuation of the Hearing -on the Assessment Roll.for L.I..D. No. 949, Fairbrook Addition and S. 21st Avenue Domestic Water, City Manager McMicken reported that the Staff has reviewed the matter and feel that there is - a benefit to the Hicks' property and that under no•circumstances should they be eliminated from pay - ing an. assessment. The feels that because Of the odd shape of the lot •and in • • . comparing with other.large:lots in the immediate area, that the assessment roll should be modified and they recommended that the final assessment to the Hicks' parcel.should'be • $325.00 and that the balance of assessment, $132.98 be directly against the Water -Sewer Fund. Mr. Beaulaurier, Attorney, and Mr. and Mrs. Hicks, being present, stated that they still feel that this is too much and.indicated that the property is not at all benefitted, and suggested that the assessment be•cut to $100.. Council mem- . • bers indicated that.they.agree that this water line not seem to improve the property, but since this .property has never had to pay a water assessment.of.any kind, felt that . some assessment should be paid. After due discussion,.• it was MOVED by .Robinson, seconded by McNeice that..the original assessment figure be - in half, from $457.98 to $228.99 and the balance of $228.99 be'charged directly against the Water -Sewer Fund: carried, Brown, • Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith .absent. It was then MOVED by Brown, seconded by McNeice that Ordinance No. 1003 confirming L.I.D. No. .949, Fairbrook Addition and S. 21st Avenue Domestic Water, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting- aye•on roll call. Keith absent. . ORDINANCE.NO. 1003, confirming the assessment roll covering Local Improvement . 'District No. 949 as created and established by No. 766 of the Ordinances of the City'of Yakima.. • At the regular meeting of February 12, 1968, Councilman,Kurbitz announced his intention to Move to reconsider Ordinance No. 1001 providing for the annexation of property situated we of 56th Avenue between Summitview and W. Chestnut Avenues, as requested by Petition • No. 586, filed by Glascam Builders, Inc., & Others. He reported that he had talked to Mr. . Perry Hayes and he is not going to protest this annexation as he previously had planned to do. Mr. Kurbitz stated that he is withdrawing his intention to Move to reconsider this Ordinance. City Attorney Andrews reported that since Ordinance No. 1001 was read, passed and numbered on February 12, 1968, all.that will be needed now is for it to be published, and the effective date of said annexation will be March 23, 1968. MOVED by Lambert, seconded by Brown that Ordinance No. 1004 amending Sec. 7.24.055 of the • Yakima Municipal Code to provide for a 70 -day collection period for the Irrigation Mainten- • ance assessments, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on.roll call. Keith absent. ORDINANCE NO. 1005, AN ORDINANCE relating to licenses and business reg pertaining . ci to auction sales; classifying auctions and regulating certain classes f auction sales; • and amending Section 5.14.020 of the City of Yakima Municipal Code. Bill Dopps, representing the Yakima Fire Fighters Association, gave Co ncil members copies of an Agreement between the City of Yakima and the Yakima Fire Fighter Association Local 469 International Association of Fire Fighters AFL -CIO, that they hope_ the Council members will consider. He further stated that members of the Yakima Fire Figh ers will be happy to meet with Council members regarding this agreement and hope for ult mate passage of said .agreement. It was then MOVED by Robinson, seconded.by Lambert that th matter-be referred to the City Manager for study and recommendation: carried, Brown, Kurb tz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. Bill Do ps then reported that -this is the 50th Anniversary of the Fire Fighters Union in the Na ion and gave Mayor Larson a -copy of a Proclamation designating February 26 to March 4, 19 8, as Fire Fighters'. Week, asking that this be considered. Mayor Larson read said Proclama ion at this meeting. City Manager McMickenlexplained that it is necessary to immediately pu chase material to repair a John Deere Tractor- Loader -Hoe machine; which material is avai able from one source only and there would be no benefit to the City by calling for bids. I was MOVED by Robin- son, seconded by McNeice that Resolution No. D -1178 authorizing the pu chase of said material without calling for bids, be passed as read: carried, Brown, lurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. • RESOLUTION NO. D-1178, A RESOLUTION authorizing the purchase of material without calling for. bids. In accordance with Resolution No. D -1174 prescribing a form of contrac for City advertis- ing and directing publication'of notice for'proposals, one bid and one bid only was sub -. mitted by the Yakima Daily Republic for the City printing for the period commencing February 19, 1968 and ending on the third Monday in February, 1969. Council members noted that there has been a considerable increase in the rate from the last agreement, namely, $1.30. to $1.92 per column inch. Mr. Richard Clester, Advertising Dire tor of the Yakima Daily Republic, explained that there has not been an increase in rate ince 1962 and that the rate that has been charged has been very low. He further stated t at most cities have had rates much higher than this, for several years. Councilman Robinso asked if the bid • has to be awarded on this day, and City Attorney Andrews explained tha the Yakima Munici- pal Code does state that the bid must be awarded 'on this day at this m eting. He further reported that no other bids were received. Council members indicated that they intend to give this matter further study for future years. After due discussion it was MOVED by . Robinson, seconded by Lambert that the bid submitted by the Yakima Daily Republic be accepted and that the City Manager and is hereby authorized to enter into an agreement . with said Yakima Daily Republic: carried, Brown, Kurbitz, Lambert, Lar McNeice and Robinson voting aye by voice vote. Keith absent. The City Engineer reported the following final estimates for work perf rmed during the month of January, 1968, for payment: . Co. 520 -930 It was MOVED by Robinson, seconded by Brown that the report of the City Engineer dated • February 19, 1968, with respect to the progress 'of the various constru projects of the City of Yakima, be approved and that the final estimates therein s forth be approved and payment of the same authorized: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote..
