HomeMy WebLinkAbout02/12/1968 Business Meeting • • 388 • FEBRUARY 12, 1968 The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith, Kurbitz, Lambert, McNeice, 'and Robinson, City Manager McMicken, and City Attorney Andrews present on roll call. . • The Invocation was given by Councilman Lambert. • The minutes of the regular of February 5, 1968, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. . • This being the time set for the continuation of the Hearing on•Petition Nos. 548, 549, and 550, filed by the Yakima Mall - Shopping Center Corp. & Others, requesting Vacation of • a portion of 4th Street and adjacent T alleys, it was MOVED by Robinson, seconded by' Brown, that the Council continue said Hearing until February 26, 1968: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. • This being the time fixed'for'the Hearing on Petition No. 576, filed by Chester S. and Lillian M. Meyer & Others, requesting annexation of property situated on both. sides of S. 44th Avenue from Nob Hill Blvd., south of Storm Avenue extended, Acting Planning Direc- tor Loidhamer reported that the staff recommended that the property be annexed and zoned R --1, for Single. Family Residence, and that the Planning Commission has recommended this • action. It was MOVED by Brown, seconded by Lambert, that Ordinance No. 1000, providing for said annexation be passed as read: carried, Brown, Keith,. Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll.call. . • ORDINANCE NO. 1000, AN ORDINANCE annexing property to the City of Yakima, and zoning said property, .. . This being the time fixed for the Hearing on Petition No. 586, filed by Glascam Builders, Inc., & Others, requesting annexation of property situated west of 56th Avenue between Summitview and West Chestnut Avenues, Acting Planning Director Loidhamer reported that the Annexation Review Board and Planning Commission recommend this annexation. He stated that the staff recommendation,.approved by the Planning Commission,.was'that the property' lying south of. the Perry Hayes property be zoned R -1, Single Family Zone; the service station at 56th and Summitview be zoned B. -2, Local Business Zone; and the remainder of the 5 acre parcel zoned R•3, Multiple Family Zone. Lee Campbell, President of Glascam Builders, was present and stated that he will accept the R-w1 zoning for the time being, but would. • strongly recommend that the City Council consider zoning the Hayes property as business ' zone, since he believes a business zone would act as a buffer between the proposed apart- ment area and.the arterial traffic noise. Mr. Walton, property owner in this vicinity, requested that the annexation be held in abeyance until he can have a further study of the law enabling this kind of action'to take'place. Mrs. Jennie Keller, 10 S. 55th Avenue, indicated opposition to the 'annexation, stating that her property would be an island sur rounded by the city. Councilman Kurbitz stated that Mr. Hayes was not able to be at this • meeting, and MOVED that this hearing be postponed until next week. Motion failed for lack of a second. On further questioning,. Mr. Loidhamer stated .that since there is in excess of 20 acres zoned for commercial use in that area now, the staff did not recommend further commercial zoning. He further stated that the Hayes property might be developed by the construction. of an apartment, since it is on an arterial and adjacent to shopping faci- lities, if an application for a change in zoning were approved by the Planning Commission at a later date. He also stated that further study is being made of planning regulations for a different development of the property. Councilman Robinson stated that he would like to see a different development of the Hayes property but will support the Planning Commission recommendation. After due discussion, it was MOVED by Lambert, seconded by McNeice, that Ordinance No. 1001 providing for said annexation be passed as read: carried Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll Brown not voting. (Councilman Brown abstained from voting because of conflict of interest.) Councilman Kurbitz,voted with the prevailing side and announced his intention to move for the reconsideration of this matter at the next meeting. ORDINANCE NO. 1001, AN ORDINANCE annexing property to the City of Yakima, and zoning said property. • • This being the time fixed for the hearing on Resolution No. D-1168, a resolution of Inten- tion to improve property by the construction of a sewer in accordance with Petition Nos. . 554, 556, 564, and. 577, Mr. Mayo described the location of the areas involved in the improvement; and there being no protests in writing or otherwise, it was MOVED by Robinson • seconded by McNeice, that Ordinance No. 1002; providing for said improvement and creating. L.I.D. No. 968, Carolyn Addition & Others Sanitary Sewer, be passed as read: carried, Brown, Keith, Kurbitz,'Lambert, Larson, McNeice, and Robinson voting aye on roll call. ORDINANCE NO. 1002, AN ORDINANCE providing for the improvement. of certain property by con - . structing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District providing for the method of payment thereof, and creating a special fund. • This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 949, Fairbrook Addition and S. 21st Avenue.Domestic Water, Mr..Beaulaurier, Attorney, appeared on behalf of Mr. and Mrs. Milo Hicks, 2020 MacLaren. He had filed .a letter prior to the • • . meeting protesting the assessment of $457 for a water line that provides no benefit to the Hicks that they do not already have through other and adequate sources, and requesting exclusion of this property. He stated that the property of Mr. and Mrs. Hicks now is con- nected to the City Water System by way of a line in an easement through private property. This line has served adequately. John Mayo, Public Works Director, explained that the • Hicks property has never been assessed for water service, that this is a bootleg connec -- tion, and when it was discovered that this connection had been made an individual meter and individual service were installed. He stated the City would move the meter for the new connection without cost to the Hicks property, but they would have to pay for the cost of connection. He recommended that there be a reduction in the assessment to compare with • other single family dwellings. •Mr. Beaulaurier stated that this property should be assessed at the rate of no more than 25% as compared with other lots. After further dis -• cussion, it was MOVED by Robinson, seconded by McNeice, that the hearing be continued for one week until February 19, 1968, and that the City Attorney and - Director of Public Works investigate the matter further: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice. and Robinson voting aye by voice vote., . 389 FEBRUARY 12, 1968. Petition No. 592, Notice of Intention to Commence Annexation Proceedi gs, filed by Decoto Aircraft, Inc., requesting annexation of property situated on he north side of West Washington Avenue, approximately 500 feet west of its intersecti n with S. 24th Avenue, being continued from February 5, 1968, and City Manager McMic en requesting that the matter be continued for another week, it was MOVED by McNeice, . seconded by Brown, II that said matter be continued until February 19, 1968: carried, Browi, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Petition No. 593, having been filed with the City Clerk on February 7, 1968, by the Methodist Church of Yakima, requesting improvement of property by the construction of a sewer at the northwest corner of 48th and Chestnut Avenues - Outside, he City Limits, it was MOVED by Robinson, seconded by McNeice, that said Petition be eferred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. A Damage Claim having been filed with the City Clerk on February 2, 1 68, by William H. Pepper, New Naches Highway, Yakima, in the amount of $5,000.00, ford mage to his property . caused by construction work being done in connection with the City Wa er Purification Plant, it was MOVED by Brown, seconded by McNeice, that said Damage C aim be referred to the City Manager for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. . TACT (Truth About Civil Turmoil) Committee having requested permissio to make a presen- tation pertaining to the Mayor's Committee on Human Rights, Lorne Hou_e, representing the committee read a prepared statement. He charged that the Mayor's Com ittee on Human Rights has become a front for black power advocates, and requested th =t the'Mayor publicly disavow the committee, and require that the name be changed and the u -e of the City Hall as a meeting place be denied. Mayor Larson, Councilmen Keith, Lamber , and Brown all made statements supporting the committee, stating that it has been im.ortant in providing a dialogue between groups and keeping communication open so that prob ems of minority groups may be known to the City and to the community; that the commit.ee has done a good job; and that they were in favor of keeping the name as it is and per itting the use of City Hall for their meetings. Councilman Lambert suggested that the iossibility of a Human Rights Commission be explored. J. C. Morrison, Chairman of the Mayor's Committee on Human Rights, also spoke in favor of the committee and expressed o position to the methods used by TACT. Mr. Les Newlun also made a statement, saying h had attended the first meeting of the Mayor's Committee when it was being organized. ayor Larson then called for the next order of business. A report having having been received from the Planning Commission, as requested in a formal Motion passed by the City Council January 22, 1968, on the App al from the Planning Commission's decision on Petition No. 572, filed by Lester & Syble Be ver, et al., requesting rezone of property situated at Glen Drive south of Summitv'ew and Nagles Nob Hill Half Acre Tracts, it was MOVED by Robinson, seconded by Lambert, that February 26, 1968, be set as the time for a hearing by the City Council on the mat er of the rezone of certain real property, as petitioned by Lester & Syble Beaver, et al., by Petition No. II 572, and that the City Clerk give notice of such hearing as required y. law: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting :ye by voice vote. A report having been received from the Planning Commission on Petitio No. 588, filed. by A. J. Lenz, requesting rezone of property situated at 606 S. 36th Ave ue, south of Tieton Drive, it was MOVED by Lambert, seconded by Brown, that February 26, 968, be set as the time for a hearing by the City Council on the matter of the rezone of certain real property as petitioned by A. J. Lenz by Petition No. 588, and that th- City Clerk give notice of such hearing as required by law: carried,'Brown, Keith, Ku bitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. A recommendation having been received from the Planning Commission fo lowing a public hearing on February 6, 1968, covering a proposed Amendment to Title 1' of the City Zoning Ordinance relating to restrictions on the sale and consumption of alc.holic beverages in certain zones, it was MOVED by Brown, seconded by McNeice, that February 26, 1968, be fixed as the date of hearing on said proposed amendment and that the ity Attorney be. ' instructed to prepare proposed legislation which would amend the City Code, pertaining to use regulations in B -2 zones, so as to allow the sale of alcoholic beverages in B-2 zones in those establishments which sell primarily food, rather than liquor; and, as recommended by the Planning Commission, which would delete the 500 fo.t restriction on the sale of beer in B -3 zones: carried, Brown, Keith, Kurbitz, Lambe t, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported that Public Works Director Mayo has req ested the Northern Pacific Railway for permission to do exploratory work and test drillin• in -the railroad right of way and that the railroad had requested an agreement providin• a hold - harmless - clause. He requested ••(thotity for entering into an agreement so that the Northern Pacific will be notified of the work we do in their right of way.
