HomeMy WebLinkAbout02/05/1968 Business Meeting 386 - FEBRUARY 5, 1968 The Council met in regular session, Mayor Larson presiding, Councilmen Keith, Kurbitz, Lam- bert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Brown absent on roll call. It was MOVED by Robinson, seconded by Lam- bert that Councilman Brown be excused from this meeting: carried, Keith, Kurbitz, Lambert, Larsn o, McNeice and Robinson voting aye by voice vote. Councilman Brown present after 3 :45 P.M. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of January 29, 1968, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. The Hearing on Petition No. 578, filed by Va -Alta, Inc., requesting Vacation of the entire alley in Block 190, Huson's Addition, having been continued from January 29, 1968, to arrange for the sale of a certain trapizoidal strip of property to Va -Alta, Inc., before final action is taken on the matter of said Vacation, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1171 authorizing the sale of City -owned property to Va- Alta, Inc., be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown absent. City Manager McMicken reported that a letter from Leonard Cockrill; Attorney representing Va -Alta, Inc., had been received offering 5700.00 for this property, and this seems to be a reasonable price in comparison with other property they have purchased. At the meeting on January 29, 1968, it was MOVED by Lambert, seconded by Brown that Ordinance No. 997 providing for the .Vacation of the Alley in Block 190, Huson's Addition, be passed as read. Mayor Larson called for the roll call vote to pass said Ordinance and it carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown absent. RESOLUTION NO. D -1171, A'RESOLUTION authorizing the sale of real property owned by the City of Yakima to Va -Alta, Inc., a corporation. . ORDINANCE NO. 997, AN ORDINANCE providing for the vacation of a public alley in the City of Yakima, Washington. Petition No. 592, Notice of Intention to Commence Annexation Proceedings, having been filed with the City Clerk on January 31, 1968, by John Decoto, President, Decoto Aircraft, Inc., requesting annexation of property situated on the north side of West Washington Avenue, approximately 500 ft. west of its intersection with S. 24th Avenue, it was MOVED by Lambert, seconded by Robinson that the matter of said Petition be continued for one week: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown absent. A Damage Claim having been filed with the City Clerk on January 30, 1968, by Ashton Preisz, Route g, Yakima, in the amount of S103.14 for damage to his automobile by City snow equip- ment, it was MOVED by Lambert, seconded by McNeice that said Damage Claim be referred to the City Manager for study and recommendation: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown absent. - .MOVED by McNeice, seconded by Robinson that Ordinance No. 998 creating the Department of Planning and Community Development, be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown absent. City Manager McMicken explained that this Ordinance amends the Yakima Municipal Code to reassign duties and responsibilities of the Planning and Inspection Departments, as authorized by Council action on January 22, 1968. ORDINANCE NO. 998, AN ORDINANCE relating to City administration; creating a Department of Planning and Community Development, to consist of a Planning Division and an Inspection Division; designating department and division officers and prescribing their duties; amend- ing Section 1.1$.090, adding Sections 1.18.091 and 1.18.092 as new sections, and repealing Section 1.18.160, all of the City of. Yakima. Municipal Code. MOVED by Robinson, seconded by Lambert that Ordinance No. 999 relating to City personnel and amending Classification Plan and salary ranges of the Yakima Municipal Code, be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown absent. City Manager McMicken explained that this Ordinance amends the Yakima Municipal Code to provide for the changing of the Title of Planning Director to Director of Planning and Community Development, and changes in the salary ranges; in accordance with his report #12. ORDINANCE NO. 999, AN ORDINANCE relating to City personnel; designating job classifications and salary ranges for certain City positions; and amending Subsection 2.20.100 (a) of the City of Yakima Municipal Code. City Manager McMicken referred to Petition No. 590, filed by. Mrs. B. E. Pinget & Others, relating to sledding on 58th Avenue, which had been referred to the City Manager and staff for study and recommendation on January 22, 1968. He stated that the Department Heads, including Emil Kissel of the Park Department, Fire Chief Jules Shockley, Police Chief Doug Campbell, Public Works Director John Mayo, and City Attorney Fred Andrews, have been contacted and this matter discussed and studied thoroughly. He further stated that all persons contacted report the same opinion, that the streets should not be used for sledding, giving the reasons that previously barricades and even the streets themselves have been damaged, that access to abutting properties by emergency equipment is needed and there is a greater possibility of the City being sued because of sledding accidents. Council mem- bers discussed this situation and suggested that this matter might be brought to the attention of the Sports and Recreational Committee of the Chamber of Commerce. City Attorney Andrews stated that the Yakima Municipal Code does not provide any information regarding sledding. After due discussion, City Manager McMicken stated that he will write a letter to be signed by the Mayor, to the people who filed the Petition.;_ stating the decision of the Council, and that the Chamber of Commerce will be contacted as suggested. City Manager McMicken requesting authorization for Personnel Director Martin Friedline to Accompany Sewage Treatment personnel, who have been previously authorized this travel, to Oregon,' was MOVED by Keith, seconded by McNeice that said travel be allowed with expenses paid: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown absent. AA 337 FEBRUARY 5, 196$ City Manager McMicken reporting on the Damage Claim filed by Pacific Power & Light Company in the amount of 558.57, for damages caused by a City Garbage truck brieaking some electri- cal lines, and referring to City Attorney Andrews' report that Dale Samuelson, Sanitation Superintendent stated that said claim is justified, he recommended payment of said claim. It was MOVED by Lambert, seconded by Robinson that Resolution No. D -1172 authorizing the payment of said Claim for Damages, be passed as read: carried, Keith, Kurbitz, Lambert., Larson, McNeice and Robinson voting aye on roll call. Brown absent. RESOLUTION NO. D -1172, A RESOLUTION authorizing the payment of a Claim for Damages filed against the City by Pacific Power & Light Company. . City Manager McMicken presenting the Civil Defense Manual covering the rules and regula- tions of the City of Yakima Civil Defense Department pertaining to the management of emergency shelters to be approved by the City Council in accordance with the City of Yakima Municipal Code, it was MOVED by Lambert, seconded by Robinson that Resolution No. D -1173 approving said rules and regulations, be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown not voting. .(Brown present after 3:45 P.M. and not voting as he arrived just previous to the vote on this matter.) RESOLUTION NO. D -1173, A RESOLUTION approving City of Yakima Civil Defense Department rules and regulations pertaining to the management of emergency shelters. City Manager McMicken reporting that the annual contract for publishing legal notices for the City of Yakima ends February 19, 1968, and it is necessary to pass a resolution prescribing the form of contract, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1174 prescribing a form of contract for City advertising and directing publication of notice for proposals, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1174, A RESOLUTION prescribing a form of contract for City advertising and directing publication of notice for proposals. City Manager McMicken reporting that Monthly Estimate No. 2, in the amount of 847,$53.74, has been received from CH2M covering work accomplished through January 31, 1968, by Teeples and. Thatcher, Inc., on the Naches River Water Treatment Plant and that CH2M recommends payment of same, it was MOVED by Robinson, seconded by Lambert that the report of CH2M dated February 1, 1968, with respect to the progress on the Naches River Water Treatment Plant, be approved and that the progress estimate therein se forth be approved and payment of the same authorized: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. City Manager McMicken reported that Villesvik & Smith, Architects on the Yakima Airport �� ° Terminal Building Improvements, have submitted a progress report of coistruction work performed by W. M..Yeaman during January, 1968. Villesvik & Smith recommending payment of Estimate #4 in the amount of 39,690.9$, on said project .. and also submitting their -it; request for Architect's payment #7 in the amount of 81,261.91, it was OVED by Robinson, seconded by McNeice that the Report of Villesvik & Smith, with respect to the progress on 0 k;t work performed by W. M. Yeaman, Contractor, and Architect's payment #7, be approved and j� that the progress estimates therein set forth be approved and payment of same authorized: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice � - vote. . . .
