Councilman Kurbitz absent on roll call. It was MOVED by Robinson, seconded by Lambert, that Councilman Kurbitz be excused from this meeting: carried, • Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. The Invocation was given by Councilman Keith. The minutes of the regular meeting of January 15, 1968, having been duly certified . accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on Petition Nos. 548, 549, and 550, filed by the Yakima Mall - Shopping Center Corp. & Others., requesting Vacation of a portion of 4th Street and adjacent T Alleys, and City Manager McMicken stating that there is still some legal work to be done on this matter and recommending that the Council continue said Hearing, it was MOVED by Lambert, seconded by McNeice, that said Hearing be continued for three weeks, or until February 12, 1968: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. This being the time fixed for the Hearing on Petition No. 570, filed by Elry and Margaret Granstrand, requesting rezone of property located at 1013 S. 28th Avenue, it was MOVED by Brown, seconded by Lambert, that Ordinance No. 992 accepting the recommenda- tion of the Planning Commission and rezoning said . property, be passed as read: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye on roll call. Kurbitz absent. Mr. Granstrand, being present, explained that as he stated at the Council meeting on January 2, 1968, when his property, located at 1011 S. 28th Avenue, was rezoned, there . had been a misunderstanding and he had been under the impression that both of these properties had been included in his first rezone request, and he had since discovered that this property at 1013 S. 28th Ave. had not been included, which is the reason for the request for rezone of this property to have it rezoned the same to add to the existing El -Rey Apartments on Nob Hill. ORDINANCE NO. 992, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 1013 South 28th Avenue, in the City of Yakima, Washington, from R -2, Two Family. Zone, to R -3, Multiple Family Zone, and declaring an emergency. . . This being the time fixed for the Hearing on the Appeal from the Planning Commission's decision on Petition No. 572, filed by Lester & Syble Beaver, Barbara Sears, and Others, requesting rezone of property located at Glen Drive south of Summitview and Nagles Nob Hill Half Acre Tracts, Mayor Larson called for discussion on this matter. Mr. Ed Loidhamer, Acting Planning Director, explained that the applicants are requesting rezon- ing from R -1, One Family Zone, to R -3, Multiple Family Zone, to build a. 32 unit, two - story apartment building and that the Planning Department staff recommended to ,the Planning Commission that this rezone request be approved. He further reported that at the Planning Commission meeting on January 3, 1968, the Petition failed because of a tie vote. One member was absent; four voted for and four against rezoning this property as requested. Mr. Loidhamer explained that the next day after the Planning Commission meeting on January 4, 1968, an Appeal from the Planning Commission's decision was filed with the City Clerk. Mr. Howard Hettinger, Attorney representing Mr.larid Mrs. Lester Beaver, spoke in favor of the rezone request, stating that after the Planning Department had recommended to the Planning Commission the rezoning of this property he and his clients, the Beavers, had been very surprised when the rezone request failed because of a tie vote by the Planning Commission. He further explained that the Beavers had dis- cussed the matter of rezoning this property with all of the neighbors, explaining to them their plans, and had filed a list of signatures with their rezone petition of 100% of the neighbors in favor of this rezone. He stated that since this list of signatures had been obtained, one other person has bought property in the vicinity. Mr. Hettinger stated that two of the Planning Commission members had been concerned about adequate parking for the people in the proposed apartment house and had been assured that there are plans for 12 parking places per unit and room for more parking to be put in if neces- sary. Mr. Hettinger displayed pictures arid.a plot of the proposed apartment building and property. Mr. Terry, new property owner in this vicinity, stated that he is objecting to this rezone because he is worried about the parking and thinks that property owners will not have parking space enough. Mrs. Beaver, being present and speaking in favor of the rezone, stated that there will be restrictions in renting these units that no children, pets, or college students will be allowed, and the rent charged will be such that there will not be a rapid turnover of renters, but more permanent ones. MO Breadner, property owner in this vicinity, spoke in favor of the rezone, stating that the property as it now exists is an eyesore and belie es this proposed'apartment building will be an improvement. Councilman McNeice stated that he has lived in this area for over twenty years and it has not been improved since he has been there, and he is in favor of following the Planning Department's recommendation and rezoning this property. After due discussion, it was MOVED by McNeice, seconded by Keith, that the formal Motion disapproving the recommenda- tion of the Planning Commission on the matter of this rezone be read: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. It was then MOVED by Brown, seconded by Lambert, that the Motion disapproving the recom- mendation of the Planning Commission on the matter of said rezone be passed as read. Councilman Robinson questioned the wording in the Motion which requested a re- hearing by the Planning Commission. He stated that we do sometimes rehear matters if the Council feels all the information has not been previously given to the Planning Commission, but in this rezone matter the petition failed because of a tie vote, not because of lack of information, and recommends that the Motion be amended to change the �ording so that the Planning Commission should reconsider the matter and make a further report to the City Council, who will then make the final decision. After due discussion it was MOVED by. Robinson, seconded by McNeice, that said Motion be amended as suggested by Councilman Robinson: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. Mayor Larson then called for the vote to pass the Motion as amended and it carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. Pinget & Others, by Vince Beaulaurier, Attorney representing the people in the • area adjacent to North 58th Avenue (between Englewood and Lincoln Avenue) requesting cer -. tain sledding privileges, it was MOVED by Lambert, seconded by McNeice, that said.Petition be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Public Works Director John Mayo stated that he is not in favor of putting up barricades . and blocking off any streets for sledding purposes, because he feels it is a traffic hazard to the people living in the area who have to get to their homes and to the children ' ' who are sledding, and stated that the last time this was done,the barricades were used for fire wood. Council members stated that since this petition is signed by most of the peopl: in this area, they will be the ones concerned as far as safety is:.concerned, and feel that the City Manager and Staff should study this matter and report back to the Council. After due discussion, it was MOVED by Robinson, seconded by Brown, that the Motion referring . said Petition to the City Manager and Staff for study and recommendation be amended to • state that if there should snow conditions that would permit sledding, before the staff reports back to the Council, authorization should be given to block off the asked -for ,streets in this petition in such a way that the residents may get to their homes: carried, Brown, Keith, Lambert, Larson,. City Manager McMicken stated that this Ordinance amends the Code. by transferring the responsibility for . street breaks, driveway approaches, and . curb cuts from the Building .Inspector to the Director of Public. Works. ORDINANCE NO. 993, AN ORDINANCE regulating the removal, alteration and construction of driveway approaches and curb cuts; requiring a permit therefor and specifying conditions for the issuance of such permit; .and amending Sections 8.64.020, .030, .040, .070, 080 (b), and ..080 (c), .100 (b) and .120 of the City of Yakima Municipal Code. • MOVED by. City Manager McMicken stated that . this Ordinance also amends the Code by transferring the responsibility for regulating excavations in and obstructions to and sidewalks from the Building Inspector to the Director of Public Works and raises the permit fee from $2.50 to $4.,00. . Kurbitz absent. City Manager McMicken explained that only change in the bus. ' . schedule is to include the Country Store and return. • RESOLUTION NO. D -1170, A RESOLUTION revising the schedule of routes for the public bus transportation system operated by the City of Yakima. . Mr. Lee Campbell, Glascam Builders, being present, and filing with the City Clerk at this • meeting Petition'No. 586, requesting annexation of property situated west of 56th Avenue ' between Summitview and W. Chestnut Avenues, it was MOVED by Robinson, seconded by Lambert, . that the Petition for Annexation filed by Lee Campbell, being Petition No. 586, be approved as meeting the requirements of law; that said Petition be referred to the City . Manager Planning Commission for study and recommendation; that the Mayor be authorized to convene a Review Board, as required by law, for a hearing and review of this'proposed annexation; and that February 12, 1968, be set as the date.for a public hearing by the • City Council on this Petition: carried, Keith, Lambert, Larson, 'McNeice, and Robinson voting aye by voice vote. Mr. Perry Hayes and Mr. Waldon, property owners in this vicinity, asked zoning in this new- annexation, stating that they have not signed the Petition to annex, because they would like to know the nature of the zoning City Manager McMicken explained that the zoning is worked out in the Planning Department and suggested they discuss this matter with the Planning Department. City Manager McMicken reported that at the Council meeting on October 23, 1967, the•Counci approved an outside sewer hook -up for Glascam Builders, on the condition that they also accept City water service, and an outside hookup agreement was signed at that time to this effect. He stated that since the Department of Public Works has found that there is an . 8 inch relatively new water line of the. Nob Hill Water Company lying in the street on 56th Avenue and it is felt that this line should not be duplicated because it would mean an unnecessary expense and recommends that the requirement that Glascam Builders must also i 381 • JANUARY 22, 1968 . • accept City water service be deleted from the outside hookup agreement formerly signed. After due discussion, it was MOVED by Robinson, seconded by McNeice, that the provision that Glascam Builders must also accept City Water service be deleted frjom the agreement approving outside sewer hookup: carried, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. (Brown refraining from voting because of a conflict of interest.) • A Damage Claim having been filed with the City Clerk on January 16, 1968, by Stewart Johnson, 2201 West Yakima Avenue, in the amount of $24.82 for damages to water main by City of Yakima Water Dept., and. a Damage Claim having been filed with the City Clerk on January 14, 1968, by Pacific Power & Light Co., in the amount of $58.57 for damages caused to a guy wire by a City Garbage truck, it was MOVED by Lambert, seconded by McNeice, that said DAMAGE CLAIMS be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. . • City Manager McMicken referred to his report #12 regarding the Proposed Department of • Planning and Community Development, and recommended that an Ordinance lie prepared to amend. the Municipal Code to reassign duties and responsibilities of the Planning and Inspection Departments, and at the appropriate time authorize the additional expenditure required. • for the remainder of this fiscal year as outlined in this report. After due discussion, it was MOVED by Robinson, seconded by Lambert, that an Ordinance be prepared in accordance with the City Manager's Report #12: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. City Manager McMicken reported that several members of the Staff are meeting this week with the people in the North 4th Street district and showed a map of the district prepared by the Planning Department. He stated that he had met once with them and they now felt that annexation should be considered by the neighborhood. He further stated that the people in this vicinity seem to be more interested in annexation on an election basis than on a petition basis. Mr. McMicken reported that this neighborhood represents 105 acre's, with. approximately 110 units, and has 138 registered voters. He invited Council mem- bers, as well as the Staff, to attend this meeting. • R. S. Cameron, Architect, having submitted a progress report of the construction work per - formed on the Airport Office Building by Cook -Lewis Company in the amount of $8,110.87 and recommending payment of same, it was MOVED by Robinson, seconded by Brown, that said report dated January 16, 1968, with respect to the progress on this project, be approved and that the progress estimate therein set forth be approved and payment of the same authorized: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. Public Works Director John Mayo reported that the Traffic Advisory Board recommended that no parking be allowed on 16th Avenue between Nob Hill Boulevard and Lincoln Avenue. He stated that this street will soon become a four -lane street with construction probably . starting in March and recommended that the parking should be removed now to get the people out of the habit of parking on this street. Councilman Robinson stated that he does not feel it is necessary to remove the parking before letting the contract for con- struction work on this'street. Manager McMicken reported that Leonard Crose, Assistant Finance Director, has been appointed Finance Director to replace Ray McGraw who recently resigned • City Manager McMicken reported that the Staff has reviewed the matter of the Application for Sewer connection outside Yakima City Limits, that was filed with the City, Clerk on January 11, 1968, by the Corporation of the Catholic Bishop of Yakima, and referred to the City Manager and Staff by the Council at the Council meeting of January 15, 1968, and recommends that this outside sewer hookup be approved. After ,clue discussion, it was MOVED by Robinson, seconded by- Lambert, that said application for outside sewer hookup be approved when the Outside Hookup Agreement is signed:. carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Kurbitz absent. - City Manager McMicken stating that Fire Chief Jules Shockley is requesting authorization for three firemen, Lee Willson, Matt Young, and Rex Laffoon, to attend the Fire Department Management School in Portland, Oregon, this week at an approximate cost of $80.00 per man, and recommending same, it was MOVED by Lambert, seconded by McNeice, that said trip be allowed with expenses paid: carried, Brown, Keith, Lambert, Larson, McNeice Robinson voting aye by voice vote.
