The Council met in regular session, Mayor Larson presiding, Councilmen Brown Lambert and
McNeice, City Manager McMicken and City Attorney Andrews present on roll Call. Councilmen
Keith, Kurbitz and Robinson absent on roll call. Councilman Keith present after $:05 P.M. 9
and Councilman Kurbitz present after $:10 P.M. Councilman Robinson was excused from this
meeting at the last regular Council meeting on January $, 1968.
The Invocation was given by City Manager McMicken.
The minutes of the regular meeting of January $, 1968, having been duly certified accurate
by two Councilmen,. and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded. .

Petition No. 5$4, having been filed with the City Clerk on January 11, 1968, by Straco,
Inc., Robert W. Strausz, President, requesting improvement of property iby the construction
of curbs, gutters and surfacing of streets, and a sidewalk, on Summitview Avenue from
N. 56th Avenue, to a point 700 feet west, more or less, and Petition No. 5$5, having also
been filed with the City Clerk on January 11, 1968, by Straco, Inc.,.requesting improvement

Petition No. 5$6, Notice of Intention to Commence Annexation Proceedings, having been filed
with the City Clerk on January 12, 1968, by Glascam Builders, Inc., Lee Campbell, President,
requesting annexation of property located west of 56th Avenue between Summitview and West
Chestnut Avenues, it was MOVED by McNeice, seconded by Lambert that this date be set as
the time for a meeting with the initiating party, Lee Campbell, who signed the Notice of
Intention to Commence Annexation Proceedings dated January 12, 196$: carried, Brown, Keith,
Lambert, Larson and McNeice voting aye by voice vote. Kurbitz and Robinson absent. Mr.
Lee Campbell, indicating that the area to be annexed is willing to assume its share of
the City's existing indebtedness, it was duly moved, seconded and passed that the annexa-
tion proposed by petition no. 5$6 (Notice of Intention to Commence Annexation Proceedings)
be accepted by the City of Yakima and that the area sought to be annexed be required to
assume the City's existing indebtedness. The above Motion was made by McNeice, seconded
by Lambert and carried: Brown, Keith, Lambert, Larson and McNeice voting aye by voice vote.
Kurbitz and Robinson absent.
MOVED by Brown, seconded by Lambert that Ordinance No. 991 fixing the time of delinquency
and providing for the issuance of bonds for the unpaid portion of L.I.D. No. 953, South
19th Avenue and Other Streets, be passed as read: carried, Brown, Keith, Lambert, Larson
and McNeice voting aye on roll call. Kurbitz and Robinson absent.
ORDINANCE NO. 991, AN ORDINANCE fixing the time of delinquency of installments of assess-
ments levied for the payment of the cost of the improvement in Local Improvement District
No. 953, and providing for the issuance of bonds with coupons attached for the payment of
the unpaid portion thereof. .

MOVED by Keith, seconded by McNeice that Resolution No. D -116$, being a Resolution of
intention to improve property by the construction of a sewer in accordance with Petition
Nos. 544, 556, 564 and 577, and fixing the time of Hearing by the City Council on said
matter for February 12, 1968, be passed as read: carried, Brown, Keith, Kurbitz, Lambert,
Larson and McNeice voting aye on roll call. Robinson absent.
RESOLUTION NO. D -116$, A RESOLUTION of intention to create a local improvement district.
MOVED by Lambert, seconded by Brown that Resolution No. D -1169 authorizing the purchase of
materials and labor without calling for bids in order to upgrade the City Hall heating
system, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson and McNeice
voting aye on roll call. Robinson absent. City Manager McMicken explained that the City
Hall heating system was put in twenty years ago, and it is now necessary that some main-
tenance and repair work be performed on the controls and since Johnson Service Company is
the only source for equipment to match existing equipment, he recommends that the Council
authorize said purchase of materials and labor in the amount of $3,51$.00 without calling
for bids.
RESOLUTION NO. D -1169, A RESOLUTION authorizing the hiring of labor and the purchase of
materials without calling for bids.
The City Engineer reporting on the completion of L.I.D. No. 949, Fairb9ook Addition and
South 21st Avenue Domestic Water, it was MOVED by Brown, seconded by McNeice that
February 12, 1968, be fixed as the time of Hearing on the Assessment Roll for this district
and that the City Clerk give due notice of publication and to each property owneras pro-
vided by law: carried, Brown, Keith, Kurbitz, Lambert, Larson, and McNeice voting aye by
voice vote. Robinson absent.
Villesvik & Smith Architects, Yakima Airport Terminal Building Improvements, having sub-
mitted a progress report of construction work performed by W. M. Yeaman during December,
1967, and approving payment #3 on said project, it was MOVED by McNeice, seconded by Brown
that said report dated January 10, 1968, with respect to the progress on this project, be
approved and that the estimate of 526,206.09 be approved and payment of same authorized:
carried, Brown, Keith, Kurbitz, Lambert, Larson and McNeice voting aye 'by voice; vote.
Robinson absent.
CH2M, Engineers, Naches River Water Treatment Plant, having submitted a progress report of
the work performed by Teeples & Thatcher Contractors, Inc., through December 31, 1967, and
recommending payment #1 on said project, it was MOVED by McNeice, seconded by Brown that
said report dated January 5, 1968, with respect to the progress on this :project, b approve��
and payment of same authorized: carried, Brown, Keith, Kurbitz, Lambert, Larson a nd McNeice
voting aye by voice vote. Robinson absent.

An Application for Utility Connection Outside the. City Limits, having been filed with the
City Clerk on January 11, 1968, by the. Corporation of the Catholic Bishop of Yakima, it
was MOVED by .Brown, seconded by Keith that said application be referred to the City Manager
and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson and
McNeice voting aye by voice vote. Robinson absent.
A Damage Claim having been filed with the City Clerk on January 12, 1968, by LeRoy Fair-
banks, 91$ S. 22nd Avenue, in the amount of $104.50 for damages to his car by a City of
Yakima Fire Dept. car, it was MOVED by Keith, seconded by McNeice that said Damage Claim
be referred to the City Manager and Staff for study and recommendation :•carried, Brown,
Keith, Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Robinson absent.
Mayor Larson stated that he is considering the following persons as members of an Airport
study committee to work with the Planners on the development of our Airport:

After due discussion, it was MOVED by Brown, seconded by Keith that said persons be con -
tacted and asked to serve on this Committee: carried, Brown, Keith, Kurbitz, Lambert,
Larson and McNeice voting aye by voice vote. Robinson. absent.
City Manager McMicken requesting authorization of travel outside of the State to Beaverton,
Oregon, for three Utilities Department :employees, Paul Page, Al Miller and Jerry Hensley,
at an approximate cost of $30 each, and recommending same, it was MOVED by Lambert, secon-
ded by Brown that said travel be allowed with expenses paid: carried,. Brown, Keith, Kurbitz.
Lambert, Larson and McNeice voting aye by voice vote. Robinson absent.
City Attorney Andrews reported that a Damage Suit has been filed against. the City by Mrs.
Bivens, who was injured when she fell on a sidewalk by the Bus Depot. He referred to the
Damage Claim which had been filed with the City Clerk and Council by Mrs. Bivens, for an
unspecified amount, some time ago and was referred to the City Manager and Staff by the
Council at that time. He reported that no action had been taken awaiting the filing of a
law suit as has now been done, in the amount of S25,000 general damages, $l5,000 loss of
work and $1,000 for doctor bills, etc. Mr. Andrews further stated that the P.P. & L. Co.
is also being sued along with the City of Yakima in this Law Suit.
There being no further business to come before the Council, it was MOVED by Kurbitz,,
seconded by Keith that we do now adjourn at the hour of 9:00 P.M.: carried, Brown, Keith,
Kurbitz, Lambert, Larson and McNeice voting aye by voice vote. Robinson absent.
