HomeMy WebLinkAbout01/02/1968 Business Meeting i 371 JANUARY 2, 1968 The Council met in regular session, Mayor Larson presiding, Councilmen 1Brown, Keith, Kur- bitz, Lambert, McNeice and Robinson, Assistant City Manager Friedline and City Attorney Andrews present on roll call. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of December 18, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 565, filed by Elry and Margaret Granstrand, requesting rezone of property located at 1011 S. 28th Avenue, it was MOVED by Brown, seconded by Lambert that Ordinance No. 984 accepting the recommendation of the Planning Commission and rezoning said property, be passed as read. Mr. Granstrand, being present, explained that his request for rezoning this property is to add to the existing El -Rey Apartments on Nob Hill Blvd., and will also give an egress from the rear of the property on south 28th Avenue, which will be an improvement on traffic flow. He also explained that due to a misunderstanding, he was under the impression that all of lot 15 was zoned R -3, but has since discovered that the northerly portion is still zoned R -2 and a petition has been submitted to request rezoning of that portion to R -3. Mr. Granstrand further stated that at the present time he has some materials on this property covered by Petition No. 565, and asked if the 30 -day period before Ordinance No. 984 is effective can be waived so he can start work immediately. After due discussion, it was MOVED by Robin- son, seconded by Keith to amend Section 4, of Ordinance No. 984, to include an emergency clause declaring "this Ordinance to be in full force and effect immediately upon its passage, approval and publication as provided by law and the City Charter ", and to also amend the Title to add, "and Declaring an emergency ": carried, Brown, Kurbitz, Keith, Lambert, Larson, McNeice and Robinson voting aye by voice vote. - Mayor Larson then called for the roll call vote on the Motion to pass Ordinance No. 984 as amended and it carried, Brown, Kurbitz, Keith, Lambert, Larson, McNeice and Robinson voting aye' on roll call. • ORDINANCE NO. 984, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 1011 South 28th Avenue in the City of Yakima, Wash- ington, from R -2, Two Family Zone, to R -3, Multiple Family Zone; and declaring an emergency This being the time fixed for the Hearing on the Assessment Roll for L. No. 954, 1966 Alley Paving Projects, and there being no protests in writing or otherwise, it was MOVED by Robinson, seconded by Brown that Ordinance No. 985 confirming the assessment roll and every part thereof, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 985, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 954 as created and established by Ordinance Nos. 803 and 812 of the Ordinances of the City of Yakima. Petition No. 576, having been filed with the City Clerk on December 28, 1967, by Chester S. and Lillian M. Meyer & Others, requesting annexation of property located on both sides of S. 44th Avenue from Nob Hill Blvd., south to Storm Avenue extended, it was MOVED by Brown, seconded by Lambert that. the Petition for Annexation filed by Chester S. and Lillian M. Meyer & Others, being Petition No. 576, be approved as meeting the requirements of law; . that said Petition be referred to the City Manager and Planning Commission for study and recommendation; that the Mayor be authorized to obtain waivers of a meeting by a Review Board; and that February 12, 1968, be set as the date for a public hearing by the City Council on this Petition: carried, Brown, Keith, Kurbitz, .Lambert, Larson, McNeice and Robinson voting aye by voice vote. Petition No. 578, having been filed with the City Clerk on December 21, 1967, by Va -Alta, Inc., by Conrad Hergert, President, requesting Vacation of the entire alley in Block 190 Huson's Addition, it was MOVED by Robinson, seconded by McNeice that said Petition be referred to the City Manager and the Planning. Commission for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. It was then MOVED by Brown, seconded by McNeice that Resolution No. D -1159, fixing January 29, 1968, as the time for a hearing by the City Council on Petition of Va -Alta, Inc., being Petition No. 578, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. RESOLUTION NO. D -1159, A RESOLUTION fixing the time and place for hearing on petition for vacation of a public alley. . The following Petitions having been filed with the City Clerk: No. 577, filed on December.21, 1967, by J. F. Lindeman, 4507 Scenic Drive, requesting improvement of property by the construction of a sewer No. 579, filed on December 22, 1967, by Robert L. ORDINANCE NO. 986, AN ORDINANCE of the City of Yakima, Washington, specifying and adopting a plan for the acquisition, construction and installation of certain additions and improve- ments to and extensionsof the combined water and sewerage of the city, and declaring the estimated cost thereof; authorizing the issuance of $2,000,000 principal amount of water and sewer revenue bonds of the city to pay part of.the cost of carrying out part of said plan; providing that said bonds will be issued on a parity with certain outstanding water and sewer revenue bonds of the city; creating a bond redemption fund; fixing the date, form, terms, maturities and covenants of said bonds to be issued; providing and adopting certain covenants and protective features safeguarding the payment of the principal of and interest on said bonds; authorizing the sale thereof; and declaring an emergency. MOVED by Lambert, seconded by McNeice that Resolution No. D -1160 authorizing the burning of a house situated on the City Sewage Treatment Plant Site, by the Fire Department for training purposes, be passed as read: carried, Brown, Keith, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz voting nay on roll call. Frank Stein, Public Utilities Director, explained that this house has been vacant for more than two years, and needs to be removed so that some landscaping can be done. Hr further explained that the City has no need for this house on the property and an effort has been made to sell the house, which was unsuccessful. Fire Chief Jules Shockley stated that the Fire Depart- ment could use this house for training purposes of new men, and that they can get about 25 to. 30 fires out of it. He further stated that it would cost more to build structures to use for Fire Department training purposes. Councilman Kurbitz, in voting nay, stated that he is against destroying this house and feels that it might be able to be used in the future. . RESOLUTION NO. D- 1160, A RESOLUTION authorizing the burning of surplus City property for Fire Department training purposes. III MOVED by McNeice, seconded by Lambert that Resolution No. D -1161 changing the name of a portion of Conestoga Boulevard to North Conestoga Boulevard, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Public Works Director John Mayo explained that a portion of Conestoga Boulevard runs in a northeasterly direction to the intersection of Conestoga Boulevard with Fechter Road, causing confusion for anyone trying to find an address on_Conestoga Boulevard, and recommended that this portion be named North Conestoga Boulevard. RESOLUTION NO. D -1161, A RESOLUTION changing the name of . a portion of Conestoga •Boulevard in the. City of Yakima to North Conestoga Boulevard. An Application for Sewer Connection Outside the Yakima City Limits, having been filed with the City Clerk on December 1$, 1967, by the Methodist Church of Yakima, it was MOVED by Robinson, seconded by Keith that said Application be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by'_voice vote. A Damage Claim having been filed with the City Clerk on December 19, 1967, by Elmer Nelson, 911 S. 23rd Avenue, in the amount of 325.1$, for damages caused to his lawn mower when it struck a fire hydrant, and a Damage Claim, having been filed with the City Clerk on December 26, 1967, by the Yakima Hardware Co., Inc., in the amount of $190.93, for damages caused to an employee's vehicle by a Police car, it was MOVED by Lambert, seconded by Brown that said Damage Claims be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. . Assistant. City Manager Friedline referred to City Manager McMicken's report #11, regarding the Adoption of Latest Building and Fire Codes, and stated that the Chief Building Inspec- tor and the Fire Marshall have reviewed the new codes and recommend the adoption by reference, of the ones listed in this report. Mr. Friedline further stated that City Manager McMicken in his report #11 has suggested an orderly way of adopting all . or part of these Codes by reference and recommends that these procedures be followed, After due dis- cussion, it was MOVED by Robinson, seconded by Keith that with regard to these updated Codes, that we instruct the staff to follow the suggested procedures as listed in City Manager McMicken's report #11: carried, Brown, Keith, Kurbit2, Lambert, Larson, McNeice and Robinson voting aye by voice vote. II Assistant City Manager Friedline stated that there'have been several inquiries regarding the flying of model airplanes in the City Parks. City Attorney Andrews explained that the City Parks are under the administration of the Metropolitan Park District and not the City of Yakima, but the City contributes financially to the City Parks. He further explained that the Park Board lacks authority and cannot pass Ordinances, so at the request of the Park Board, in..1952, the City of Yakima adopted an Ordinance setting out rules and regula- tions applying to the use of and conduct in public parks. He stated that in 1962, the question of flying model airplanes in public parks was brought to the attention of the Park Board who at that time requested the City Council to amend that Ordinance so that it pro - hibits the flying of model airplanes in City parks, which was done at that time. In dis- cussion, Council Members suggested that this matter be discussed with the Park Board and they may have some suggestions as to the possibility of a program whereby the flying of Model Airplanes may be allowed, and that this information can be brought back to the City Council. • 373 January 2, 196$ There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Keith that we do now adjourn at the hour of 4:10 P.M.: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.
