Councilmen Brown, Kurbitz, Larson, Lynch, McNeice, and Robinson, City Manager McMicken, and City Attorney Andrews present on roll call. Councilman Lambert absent on roll call: It was MOVED by Robinson, seconded by Brown, that Councilman Lambert be excused from this meeting: carried, Brown, Kurbitz, Larson, Lynch, McNeice,- and Robinson voting aye by voice vote. • • The Invocation was given by Councilman Brown. . . The Salute to theFlag was led by Mayor:Larson. . The minutes of the regular meeting•of November 13, 1967, having -been duly certified . accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Since the Council was about to adjourn sine die, Councilman Lynch asked permission to say a few words regarding his term on the City Council. Mr. Lynch spoke of the many accom- plishments of the City during his term of office, such as the completion of the Lenox Avenue Overpass, street arterial improvement program, improvement of intersections to aid traffic flow, designing.-and building of the new sewage disposal plant and interceptor • line, beginning of improvements at Airport, adoption of the General Plan, the adoption . of the Central Business District Plan, and study and design of a water system on which .construction will start this coming year. • There being no further business to come before this Council, it was MOVED by Lynch, • seconded by Robinson, that this Council adjourn sine die at the hour of 8:10 PM: carried, • Brown, Kurbitz, Larson, Lynch, McNeice, and Robinson voting aye by voice vote. Mullins administered the Oath of Office to these Councilmen. • The netw•City Council was convened by Councilman Larson on this date. Councilmen Brown, • Keith, Kurbitz, Larson, McNeice, and Robinson present on roll call. Councilman Lambert absent on roll call. • It was MOVED by Brown, seconded by Kurbitz, that Larson be nominated for Mayor and Robinso for Assistant Mayor: carried, Brown, Keith, Kurbitz, and McNeice voting aye by voice vote. Larson and Robinson not voting. Lambert absent. • Mayor Larson presenting a Resolution of appreciation and commendation for the services performed by Robert R. Lynch during his tenure as a member of the Yakima City Council, it was MOVED by Robinson, seconded by McNeice, that Resolution No. D -1139 be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye by voice vote. Lambert absent. RESOLUTION NO. D -1139, A RESOLUTION of appreciation and commendation for the services performed by Robert R. Lynch during his tenure as a member of the Yakima City Council. It was MOVED by McNeice, seconded by Kurbitz, that.the Council adjourn temporarily at • 8:15 P.M. for a reception to honor retiring Councilman Lynch, and new Councilmen Brown, Keith, Larson, and McNeice: carried, Brown, Kurbitz, Larson, Keith, McNeice, and Robinson voting aye by voice vote. Lambert absent. The Council reconvened at 8:30 P.M., Mayor Larson presiding. • An Ordinance appropriating $3,000 within the 1967 Budget for Water -Sewer Fund, having been read in its entirety at the regular meeting on November 13, 1967, and being read by Title only at this meeting, it-was MOVED by Brown; seconded by. McNeice, that Ordinance No. 973 providing for said appropriation be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye on roll call. Lambert absent. • ORDINANCE NO..973, AN::.OINANCE appropriating the amount of $3,000 from unappropriated monies in the Water -Sew Fund to Account 7 -280, Light and Power, of the Maintenance and Operation Classification, in the 1967 appropriation for 520, Water -Sewer Fund. Petition No. 565, having been filed with the City Clerk on November 13, 1967, by Elry Granstrand and Margaret Granstrand; requesting rezone of property located at 1011 South 28 ■h Avenue; and Petition No. 567,* having been filed with the City Clerk on November 16, 1967, by Estate .of Avery Combs, requesting rezone of property at 2002 Lincoln Avenue; and Peti- tion No. 568, having been filed with the City Clerk on November 16, 1967, by Va -Alta, Inc., for rezone of property on the east side of North 9th Street between A Street and East Yakima Avenue, it was MOVED by Robinson, seconded by Brown, that said Petitions be referre to the City Planning Commission for study and recommendation: carried, Brown, Keith, • .Kurbitz, Larson, McNeice, and Robinson voting aye by voice vote. NOVEMBER 20, 1967 Petition No. 566 having been filed with the City Clerk on November 16, 1967, requesting improvement of property by the paving of the alley from Walnut to Spruce between 12th and 13th Avenues, it was MOVED by Brown, seconded by McNeice, that said Petition for the creation of a Local Improvement District be referred to the City Manager and Staff for study and recommendation: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye by voice vote. Lambert absent. MOVED by Robinson, seconded by McNeice, that Ordinance No. 974 relating to utility taxes on certain utilities for 1968 and amending the Yakima Municipal Code, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye on roll call. Lambert absent. Discussion indicated that rates therein set forth are the same as for 1967. ORDINANCE NO. 974, AN ORDINANCE relating to taxes upon certain utilities, fixing tax rates, providing for a surcharge, saving certain taxes and amending Section 5.50.050 of the City of Yakima Municipal Code. . MOVED by Brown, seconded by Robinson, that Ordinance No. 975, fixing the time of delin- quency and providing for the issuance of bonds for the unpaid portion of L.I.D. No. 952, Fairbrook Addition and Other Streets, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye on roll call. Lambert absent. ORDINANCE NO. 975, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 952, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. MOVED by Robinson, seconded by McNeice, that Ordinance No. 976 relating to traffic control and to the redemption of impounded vehicles; and amending Section 9.36.340 of the City of Yakima Municipal Code, be passed as read: carried, Brown, Keith, - Kurbitz, Larson, McNeice, and Robinson voting aye on roll call. Lambert absent. This ordinance increases impound fee from $7.50 to $10.00. ORDINANCE NO. 976, AN ORDINANCE relating to traffic control and to the redemption of impounded vehicles; and amending Section 9.36.340 of the City of Yakima Municipal Code. MOVED by Brown, seconded by McNeice, that Resolution No. D-1140 authorizing and directing the payment of.$394.50 to Cecil M. Warriner in satisfaction of a Claim for Damages against the City, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye on roll call. Lambert absent. Councilman Robinson explained that this claim is due to an inadequate sewer line and that many of the homes in the area lack a trap to prevent such backups. RESOLUTION NO. D -1140, A RESOLUTION authorizing and directing the payment of $394.50 to Cecil M. Warriner in satisfaction of a Claim for Damages against the City. MOVED by Robinson, seconded by McNeice, that Resolution No. D-1141, authorizing the pay- ment of $35 to Guy S. Wheeler in satisfaction of a Claim for Damages, be passed as read: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye by roll call. Lambert absent. RESOLUTION NO. Damage Claims having been filed with the City Clerk on November 10, 1967, by Alice Naudack, 115 No. Naches Avenue, . in the amount of $150 for medical expenses and $10,000 general damages as a result of an accident on West B Street between 1st and 2nd Avenues on August 13, 1967; and by Linda Abels, 704 Keyes Road, with the City Clerk on November 10, 1967, in the amount of $10,000 damages as a result of an accident on West B Street at crossing of Union Pacific Railroad tracks; it was MOVED by McNeice, seconded by Brown, that said damage claims be referred to the City Manager and Staff for study and recommenda- tion: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye by voice vote. Lambert absent. City Manager McMicken reported that the City is still on schedule on the study of grade separation projects; that the Planning Commission will meet Tuesday night, November 21, and there will be a hearing before the City Council next Monday. He stated City officials have met with the downtown architects and other interested persons who helped prepare the Central Business District Plan, and that there will about four alternative plans to be presented. He is still hopeful of meeting the deadline of December 1st for presenting a proposal to the Urban Arterial Board. • 356 NOVEMBER 20, 1967 • There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Keith, that we do now adjourn at the hour of 9:00 P.M.: carried, Brown, Keith, Kurbitz, Larson, McNeice, and Robinson voting aye by voice vote.
