HomeMy WebLinkAbout10/30/1967 Business Meeting 346 OCTOBER 30, 1967 The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz, Lambert, Lynch, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by Councilman Kurbitz. The minutes of the regular meeting of October 23, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read .publicly, Mayor Larson declared said minutes approved as recorded. . An Ordinance appropriating S22,000 within the 1967 Budget for the Water Sewer. Fund, having been read in its entirety, was ordered laid on the table for one week or until the next regular meeting of the City Council on November 6, 1967. City Manager McMicken explained that these funds are to be used for the extension of sewer lines and for emergency repair of the Airport and Kiwanis Wells. . MOVED by Brown, seconded by Robinson that Ordinance.No. 965 relating to resisting arrest and amending the Yakima Municipal Code, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson.voting aye on roll call. City Attorney Andrews referred to the memorandum to the Council from Assistant City Attorney Gary McGlothlen, in which it was explained that the Ordinance is being amended to clarify that the police officer be acting in the discharge of his duty. He further explained that recently in a court case, in which the defendant was charged with the offense of resisting . a police officer, the ordinance defining that offense was held to be vague and unconstitu- tional and therefor invalid, because it did not specifically require that the police officer be acting in the discharge of his duty at the time of the resistance. ORDINANCE NO. 965, AN ORDINANCE relating to public health and morals; declaring a person who resists arrest, or who interferes with or refuses to aid a police officer, to be a disorderly person; amending Section 6.04.200 of the City of Yakima Municipal Code; and declaring an emergency. MOVED by Lynch, seconded by Lambert that Resolution No. D -1136 authorizing the payment of 3151.30 to Dean Van De Venter in satisfaction of a sewer damage claim, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Public Utilities Director Frank Stein explained that the claimant had filed a claim in the amount of $192.9$ to cover several sewer backups. He further explained that the several claims prior to May, 1967, cannot be paid for the reason that this Claim for Damages was not filed within the required time to allow the earlier claims, but recommend- ed that the claim for 3151.30 be paid, as this is for the damage incurred in May, 1967. RESOLUTION NO. D -1136, A RESOLUTION authorizing the payment of $151.30 to Dean Van De III Venter in satisfaction of a Claim for Damages filed against the City of Yakima. MOVED by Robinson, seconded by Lynch that Resolution No. D -1137 authorizing the hiring of work and purchase of materials to repair the motor and electrical controls for the Airport Well, without calling for bids, be passed as read: carried, Brown, Kurbitz, Lambert, Lar- son, Lynch, McNeice and Robinson voting aye on roll call. Public Utilities Director Frank Stein explained that the Airport Well became inoperative because of a malfunction of its motor and controls and that the requested work and materials are necessary to modify the motor and controls and to put said well in operating condition. RESOLUTION NO. D- 1137, A RESOLUTION authorizing and ratifying the hiring of work and purchase of materials without calling for bids. . The City Engineer reporting on the completion of L.I.D. No. 953, South 19th Avenue. and Other Streets, it was MOVED by Robinson, seconded by Lambert that November 27, 1967, be fixed as the time of Hearing on the Assessment Roll for this district and that the City Clerk give due notice of publication and to each property owner as provided by law: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. . Dave Jaeger, Student Body President of Yakima Valley College and Roger Edwards, being present at this meeting, sought support of the City Council for Homecoming Week beginning October 30, 1967, and other College activities. Dave Jaeger explained the numerous problems they have had in getting public support for College activities this year. Coun- cil members suggested that they contact the Junior and Senior Chambers of Commerce and various service clubs. Mayor Larson offered to assist them in getting the Chamber of Commerce to set up a•committee to support Yakima Valley College activities and asked them to contact him any time their committee and Yakima Valley College President Scheidt would like him to accompany them to a Chamber of Commerce meeting to present this matter. Councilman Kurbitz suggested that a Resolution be prepared supporting Homecoming Week at Yakima Valley College, expressing appreciation of the value of the College to the Community and endorsing their activities. After due discussion, it was MOVED by Kurbitz, seconded by Robinson that Resolution No. D -113$ supporting Homecoming Week at Yakima Valley College, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Councilman Brown asked the boys to contact him as he has a few promotional ideas that may help them. . RESOLUTION NO. D -113$, A RESOLUTION supporting homecoming week at Yakima Valley College. City Manager McMicken stated that in the matter of the request for Outside Utility hookup filed by Patrick L. Marshall, that had been post poned until this.meeting, he had contact- ed Mr. Marshall who informed him that other arrangements had been made for sewage dis- posal and that Mr. Marshall wishes his application for an outside utility connection to be withdrawn from the City Council Agenda. After due discussion, it was MOVED by Robinson, seconded by Lambert that this matter be indefinitely post poned: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. City Manager McMicken stated that previously Council members had asked if there is any metering of electrical service at the Yakima Municipal Airport and he has reviewed this matter. He reported that except for Puget Aviation who have a separate meter, the City pays the electricity cost of the various operations at the Airport. He further explained that the City does take into consideration the cost of electricity as a part of the negotiations that go into the various rental agreements at the Yakima Municipal Airport. 347 . . . OCTOBER 30, 1967 City Manager McMicken asked. Director of Public Works John Mayo to report on the recent Northwest Pacific Pollution Control Convention and a Plaque received by the City. Mr. Mayo explained that the City of Yakima was awarded a Plaque in recognition of our contri- bution to industrial waste purification. He stated that the City of Yakima was asked to give a paper on their purification system, which he prepared and presented. He further stated that the City of Yakima was singled out by the pollution people as having one of the finest industrial waste purification systems in the Northwest, and that it is unique with one collective system with a good layout for industrial waste . He explained further that industrial concerns in other cities have their own separate systems. After due dis- cussion, it was MOVED by Robinson, seconded by Lynch that the Council go on record as congratulating John Mayo and the staff on their excellent work, and to express apprecia- tion for the paper that was prepared and given by John Mayo, all of which enabled the City to receive this Plaque: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. There being no further business to come before the Council it was MOVED by Kurbitz seconded by Lynch that we do now adjourn at the hour of 4:05 P.M.: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote.'
