HomeMy WebLinkAbout10/09/1967 Business Meeting r 337 OCTOBER 9, 1967 The Council met in regular session, Assistant Mayor Robinson presiding, Councilmen Brown, Kurbitz, Lynch and McNeice, Assistant City Manager Friedline&City Attorney Andrews present on roll call. Councilman Lambert and Mayor Larson absent on roll call. Mayor Larson having been excused from this meeting at the .previous recessed meeting on Wednesday, Octo- ber 4, 1967, it was MOVED by McNeice, seconded by Brown that Councilman Lambert be excused from this meeting: carried, Brown, Kurbitz, Lynch, McNeice and Robinson voting aye by voice vote. •. The Invocation was given by Councilman Lynch. The minutes of the regular meeting of October 2, 1967 and the Recessed Meeting of October 4, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Assistant Mayor Robinson declared said minutes approved as recorded. An Ordinance appropriating and transferring $260,000 within the Domestic Water Improvement Fund to Construction Expenditures, having been read -in its-entirety at the regular meeting on October 2, 1967, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Lynch that Ordinance No. 961 providing for said appropriation and transfer, be passed as read: carried, Brown, Kurbitz, Lynch, McNeice and Robinson voting aye on roll call. Lambert and Larson absent. ORDINANCE NO. 961, AN ORDINANCE transferring the amount of 8260,000 from the Cumulative Reserve Fund for Domestic Water Supply Development to the Domestic Water Improvement Fund, and appropriating 8260,000 within the Domestic Water Improvement Fund to Account 7 -950, Construction Expenditures, of the Capital Outlay Classification. This being the time fixed for a Hearing on Petition No. 533, filed by Phillip J. Robillard & Others, requesting the Vacation of a portion of Bell Avenue, and the Planning Commission recommending that this vacation request be denied, and there being no one present to speak for or against this requested Vacation, it was MOVED by Brown, seconded by McNeice that Resolution No. D -1132 denying said Vacation, be passed as read: carried, Brown, Kurbitz, Lynch, McNeice and Robinson voting aye on roll call. Lambert and Larson absent. RESOLUTION NO. D -1132, A RESOLUTION denying a petition to vacate a portion of Bell Avenue in the City of Yakima, Washington. . This being the time fixed for a Hearing on the Assessment Roll for L.I.D. No. 952,. Fair brook Addition and Other Streets, and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by McNeice that Ordinance No. 962 confirming the assessment roll and every part thereof, be passed as read: carried, Brown, Kurbitz, Lynch, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 962, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 952 as created and established by Ordinance No. 796 of the Ordinances of the City of Yakima. . Petition No. 557, having been filed with the City Clerk on October 4, 1967, by I. H. Meyer and Others, protesting unsanitary conditions at 103 to 109 S. Ninth Avenue, it was MOVED by Lynch, seconded by McNeice that this matter be referred to the City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Lynch, McNeice and Robinson voting aye by voice vote. Lambert and Larson absent. MOVED by Lynch, seconded by Brown that Resolution No. D -1133 directing payment of 51,580.50 to Etta J. Mercer in settlement of a Damage Claim, be passed as read: carried, Brown, Kur- bitz, Lynch, McNeice and Robinson voting aye on roll call.. Lambert and Larson absent. City Attorney Andrews explained that Mrs. Mercer had tripped and fallen over a rise in the sidewalk at 105 S. 4th Street and had filed a Claim for Damages against the City of Yakima on July 6, 1967, and an amended Claim on August 15, 1967, in the amount of S20,280.50.. He further explained that after investigation and consultation with Mrs. Mercer's attorney, she has offered to accept the amount of $1,5$0.50 in full settlement of said Claim, and he recommends that this be paid. Councilman Kurbitz asked if there is any way we can antici- pate some of these things by inspecting sidewalks and repairing them so we can avoid some of this in the future. Public Works Director John Mayo explained that there is a general problem in the deterioration of many sidewalks in the City, and that a program has been started whereby sidewalks are being inspected and repaired, but this one hadn't been done at that time. He further explained that there are some thirty or forty miles of sidewalks in the City and it will take a considerable amount of time to do this work. Mr. Mayo stated that he is working on some legislation to be brought before the Council this winter, which will take care of the bad sidewalk situation. Councilman Kurbitz suggested that this matter be brought to the attention of City Manager McMicken. RESOLUTION NO. D -1133, A RESOLUTION directing payment of 81,580.50 to Etta J. Mercer in settlement of a Damage Claim. The City Engineer reporting on the completion of L.I.D. No. 957, . Coonse State Addition Sewer, it was MOVED by Lynch, seconded by McNeice that November 6, 1967, be fixed as the time of Hearing on the Assessment Roll for this district and that the City Clerk give due notice of publication and to each property owner as provided by law: carried, Brown, Kur- bitz, Lynch, McNeice and Robinson voting aye by voice vote. Public Works Director reported that the City - County 16th Avenue Urban Arterial Street Program has been approved by the State Urban Arterial Board and we are authorized to start work on the engineering phase of it immediately. He further stated that the engineering plans should be completed so that bids can be called for in February, 1968.
