The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Lambert, Lynch, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Kurbitz absent on roll call. It was MOVED by Robinson, seconded by Brown that Councilman Kurbitz be excused from this meeting: carried, Brown, Lambert, Lax- 111 son, Lynch, McNeice and Robinson voting aye by voice vote.. The Invocation was given by Councilman Lynch. The minutes of the regular meeting of September 1$, 1967, and the Special Meeting of Septem- , ber 21, 1967, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. 0 . An Ordinance appropriating S3,000 for hot water tank replacement in City Hall, having been read in its entirety at the regular meeting on September 1$, 1967, and being read by Title only at this meeting, it was MOVED by Robinson, seconded by McNeice that Ordinance No. 956 . providing for said appropriation, be passed as read: carried, Brown, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz absent. City Manager McMick- en stated that the Purchasing Agent Kermit Smith had explained that this appropriation is necessary in order that we may replace a domestic hot water tank that is condemned due to the action of electrolysis on the tank. ORDINANCE NO. 956, AN ORDINANCE appropriating the amount of S3,000 from unappropriated monies in the Current .Expense Fund to Account 10$.- 340, Stationary Equipment, Land, Build- ing and Plant - Maintenance and Operation, of the Maintenance and Operation Classification, in the 1967 Budget for 10$, City Hall. An Ordinance appropriating S350 from unanticipated revenue to Fund 911 - the 1962 Street Improvement Construction Fund, having been read in its entirety, was ordered laid on the table for one week or until the next regular meeting of the City Council on October 2, 1967. Public Works Director John Mayo, explained that this 8350 is actually a refund from a job finished several years ago and this appropriation provides for the means to put the money into the Street Improvement Construction Fund. MOVED by Robinson, seconded by McNeice that Ordinance No. 957 fixing the time of delin- quency and providing for Installment Notes for the unpaid portion of L.I.D. No. 916, West Nob Hill Boulevard Curb, Gutter and Paving District, be passed as read: carried, Brown, Lambert,Larson, Lynch, McNeice and Robinson voting aye on roll call. Kurbitz absent. ORDINANCE NO. 916, AN ORDINANCE fixing the time of delinquency of installments of'assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 916, and providing for the issuance of Local Improvement District Installment Notes for the payment of the unpaid portion thereof. . Councilman. Lynch stated that in reference to his statement he made at the Special Meeting on September 21, 1967, regarding the Fluoridation petition, that the Citizens Committee opposed to Compulsory Fluoridation had asked him to either substantiate his charge of rte "Dishonest" or publicly apologize for his remarks, and he read a statement he'had prepared as follows: "September 25, 1967 "The Citizens Committee opposed to Compulsory Fluoridation has asked me to either sub- stantiate my charge of 'Dishonest' in my statement of last Thursday; when I called their petition 'one of the most insidious and dishonest schemes that had ever come before the Council' - or, to publicly apologize for making the statement. "I will apologize to any individual who feels that I called him dishonest for signing the petition but this I did not do: "But I shall not apologize - I shall reiterate, that in my opinion the petition is an insidious and dishonest scheme. . "If this were an 'Honest' attempt to have a vote on Fluoridation - simple question of 'Do you want Fluoride in your water' 'yes' or 'no' would be appropriate. "It is dishonest because many people were told when asked to sign the petition that it was 'For Fluoridation' or, 'To put Fluoridation on the Ballot' - that is not the case for it is neither for Fluoridation - nor does it put the question of Fluoridation on this Ballot. "It is dishonest because under the guise of the 'Fluoridation' issue this proposi- tion prevents any drug or chemical substance being added to our water, which includes chlorine - if a question is raised about the necessity of adding chlorine to our water - chlorine has been added to Yakima's water supply for approximately 45 years. "And as I said before the petition shows lack of faith in duly elected officials because it hamstrings future Councils from looking after the public Health and public Welfare which is one of the basic and proper functions of government. "Again I say that I am not calling any individual dishonest - nor did I - but I do think the petition is:" ill Mr. Don Tait asked Councilman Lynch for names & addresses of people who had called him stating that they had been misled into signing the fluoridation petition. Councilman Lynch stated that he does not wish to embarrass these people and will not devulge their names without their consent, but read an article written to the Editor of the Yakima newspaper by Mr. Schopp', 1019 S. 2nd Avenue, which stated the same things that were said by these people who had contacted him. Mr. Tait stated that he finds it hard to believe that anyone signing this petition could not understand it. He further stated that there have been cases in South Bend and Richland where such a matter went to the Supreme Court and the City Council passed a measure the people had voted down. City Attorney Andrews stated that he ■ r 333 SEPTEMBER 25, 1967 knew of no case where after an Initiative Referendum had been passed by the people that it had gone to the Supreme Court and Mr. Tate stated he would do some research on this matter and inform the Council of his results.. Mr. Bill Pflueger, member of the Citizens Committee opposed to Compulsory Fluoridation, stated that their Committee had circulated the fluori- dation petition only after no action was taken on their request for a hearing on this matter and they had no way of knowing what the Council would do. Mayor Larson stated that he was of the opinion that the request had been answered and that this Council had previous- ly stated that they would always bring such matters to a vote of the people and that all the committee would have had to do was to bring the matter to the Council in the form of an Ordinance and action would have been taken and a hearing held. City Manager McMicken informed the Council that there will be extended Bus service to the Fairgrounds during the Fair which begins on Wednesday and that this fact will be published so that Bus patrons can get back and forth to the Fair. City Attorney Andrews introduced Mr. :Gary ilo;Glothlen, the new Assistant City Attorney, to the Council members who welcomed him to the Staff. There being no further business to come before the Council, it was MOVED by Lynch, seconded by McNeice that we do now adjourn at the hour of 3:30 P.M.: carried, Brown, Lambert, Larson Lynch, McNeice and Robinson voting aye by voice vote.
